SIU Concludes Investigation into Fatal Police-Involved Shooting of Man in Port Colborne
On September 4, 2022, a 52-year-old man was fatally shot by a Niagara Regional Police Service officer in his apartment in Port Colborne. SIU Director Joseph Martino determined there were no reasonable grounds to believe that any of the officers comported themselves other than within the limits of the criminal law in connection with the man’s tragic death. There was no basis for proceeding with charges in this case and the file has been closed.30 December, 2022
SIU Concludes Investigation into Man’s Arrest in Toronto
In the afternoon of August 31, 2022, Toronto Police Service officers were dispatched to a building after the property manager reported that a resident of the building had assaulted another individual. After speaking to individuals and reviewing video footage, the offices made their way to the 46-year-old man’s residence. In the course of attempting to arrest the man, an altercation ensued between officers and the man. He was eventually apprehended. The man was taken to hospital after his arrest and diagnosed with a broken nose. While accepting that the man broke his nose when it was forced to the floor by a knee strike from an officer, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the injury was attributable to unlawful conduct on the part of either of the arresting officers. There was no basis for proceeding with criminal charges in this case and the file has been closed.30 December, 2022
No Criminal Charges to Issue in Connection with North York Collision that Injured Teenager
On September 3, 2022, a 17-year-old male suffered a collapsed lung and fractured collarbone when the stolen vehicle in which he was an occupant became involved in a motor vehicle collision with an Ontario Provincial Police cruiser in North York. SIU Director Joseph Martino was unable to reasonably conclude on the evidence that the officer operating the cruiser failed to comport himself with due care and regard for public safety throughout the incident. As there was no basis for proceeding with criminal charges in this case, the file has been closed.30 December, 2022
SIU Finds No Criminal Offence Committed in Connection to Man’s Arrest and Injury in Ottawa
In the late evening of September 2, 2022, Ottawa Police Service officers were dispatched to a residential complex after an individual called 911 to report that a woman had been assaulted. Upon reviewing security camera footage from the complex, an officer was able to identify the perpetrator, a 44-year-old man. The officer located the man near a business, and upon telling the man he was under arrest, the man fled on foot. The officer caught up with the man and brought him down to ground. In the course of a struggle, the officer discharged his conducted energy weapon multiple times and delivered several knee strikes. With the help of other officers, the man was eventually handcuffed behind his back. The man was transported to hospital from the scene when he complained of difficulty breathing. He was diagnosed with a right-sided lateral rib fracture. SIU Director Joseph Martino determined there were no reasonable grounds to believe that the man’s injury was attributable to unlawful conduct by the arresting officers. As such, there was no basis for proceeding with criminal charges in this case and the file has been closed.29 December, 2022
SIU Finds Takedown of Man in Barrie was Legally Justified
In the evening of August 30, 2022, a Barrie Police Service officer was dispatched to a business after an employee had called police to report that a man had been threatening staff and customers. The officer located the 40-year-old man a short distance away from the business. After they spoke briefly, the officer decided to arrest the man for public intoxication. As they walked to the officer’s cruiser, the man kicked the officer in the knee and the officer forced him to the ground. The man’s face struck the pavement in the fall, resulting in facial fractures. SIU Director Joseph Martino determined there were no reasonable grounds to believe the man’s injuries were attributable to any unlawful conduct on the part of the officer. There was no basis for proceeding with criminal charges in this case and the file has been closed.28 December, 2022
SIU Concludes Investigation into Sudbury Arrest
In the evening of August 29, 2022, Greater Sudbury Police Service officers were dispatched to a residence to investigate an altercation between two individuals. Upon arrival, officers saw one of the parties, a 32-year-old man, standing on the driveway. Within moments, an officer forced the man to the ground, after which the man was handcuffed by another officer. The man was taken to hospital following his arrest and treated for a fractured knuckle of the right hand. It was unclear whether the man’s injury was incurred in his confrontation with police or with another civilian prior to the arrival of police . Be that as it may, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any of the officers comported themselves unlawfully throughout their engagement with the man. There was no basis for proceeding with criminal charges in this case.28 December, 2022

SIU Closes Investigation into Officer’s Discharge of ARWEN at Man in Thunder Bay
In the evening of August 29, 2022, a team of Thunder Bay Police Service Emergency Task Unit officers was deployed to an address to assist with the arrest of a 24-year-old man who was wanted on arrest warrants for murder and attempted murder. The team set up containment around the address and used a loud hailer to ask the man to surrender. When the man exited the address and ran away, the officers gave chase. One officer fired his Anti-Riot Weapon EnField (ARWEN) three times in the man’s direction, but the man continued his flight. Another officer released his police service dog, which jumped on, and bit, the man. The man was subsequently captured and arrested by the pursuing officers. It was not clear whether any of the ARWEN rounds fired by the officer struck the man. His reported injuries – abrasions and puncture wounds – seemed more likely to have been inflicted by the police service dog. Be that as it may, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer who discharged the ARWEN comported himself other than within the limits of the criminal law.23 December, 2022
SIU Concludes Investigation into Toronto Arrest
On August 28, 2022, Toronto Police Service officers on bicycle patrol were dispatched to a condominium on Front Street East after reports of a man having stolen two electric scooters The officers located the man, who was on a scooter, and pursued him. When the 39-year-old man ditched the scooter, one of the officers ran after him. The officer grabbed the man’s backpack and the man fell and struck his face on the concrete ground resulting in a fractured nose and orbital bone. The man was apprehended. While accepting that the man’s injuries were incurred in the takedown, SIU Director Joseph Martino determined there were no reasonable grounds to believe they were attributable to unlawful conduct on the part of the officer. As such, there was no basis for proceeding with criminal charges in this case.23 December, 2022
SIU Determines no Criminal Charges to Proceed in Halton Hills Arrest Case
On August 25, 2022, Halton Regional Police Service officers entered the garage of a residence in Halton Hills on the strength of a search warrant that had been issued in support of a drug investigation. In the garage, an officer ordered a 20-year-old man to the ground and proceeded to tackle him. There followed a short struggle during which the officer delivered several knee strikes to the man’s right side and back before controlling his arms and handcuffing them behind the back. At hospital, the man was diagnosed with a laceration above the right eye and a fractured nose. While accepting that the man’s injuries were the result of the force used by the officer, SIU Director Joseph Martino determined there were no reasonable grounds to believe they were attributable to unlawful conduct on the part of the officer. As there was no basis for proceeding with criminal charges in this case, the file has been closed.22 December, 2022
No Grounds to Criminally Charge OPP Officer After Man Breaks Wrist in Quinte West Cell
The Director of the Special Investigations Unit, Joseph Martino, has found no reasonable grounds to believe that an Ontario Provincial Police officer committed a criminal offence in connection with the broken left wrist suffered by a 60-year-old man at the Quinte West Detachment. On August 5, the man was arrested for impaired driving following a collision in Trenton. While lodged in a cell, the man prevented an officer from closing the cell door and the officer put his hand on the man’s chest to move him away. The man lost his footing on wet flooring and fell backwards, fracturing his wrist. The next morning the man attempted to harm himself and a struggle ensued where one officer delivered several knee and hand strikes, and another officer repeatedly deployed his Conducted Energy Weapon before he was handcuffed.21 December, 2022
SIU Concludes Investigation into Aurora Collision between Cruiser and Civilian Vehicle
On August 22, 2022, a York Regional Police officer was en route to a call when his cruiser struck an Audi in Aurora. The Audi’s 23-year-old male driver and 22-year-old female passenger were both seriously injured. SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer transgressed the limits of care prescribed by the criminal law. As such, there was no basis for proceeding with criminal charges in this case. The file has been closed.21 December, 2022

SIU Concludes Investigation into Fatal Gunfire Exchange in Hamilton Cemetery
On September 12, 2022, a 40-year-old man was shot and killed in Hamilton in an exchange of gunfire with Hamilton Police Service (HPS) and Halton Regional Police Service (HRPS) officers. Prior to the shooting, the man had killed three individuals, including a Toronto Police Service officer, and had attempted to kill at least eight other individuals. The four officers who fired their weapons during the gunfire exchange were identified as the subject officials.20 December, 2022

SIU Concludes Investigation into Thornhill Police-Involved Shooting
On December 15, 2021, York Regional Police officers were made aware of a recently committed bank robbery at a Scotiabank in Thornhill. While driving in his cruiser, an officer located a man who generally fit the description of the suspect. The officer gave chase on foot and told the man to stop. While the man fled, he repeatedly pointed a BB gun at the officer. The man rounded a corner and hid, and when confronted by the officer, the man held the gun with both hands and aimed it at the officer. The officer discharged his firearm at the man twice. The man was taken to hospital and treated for a penetrating gunshot wound to the area of his left shoulder and a graze wound to the upper left arm. The Director of the Special Investigations Unit, Joseph Martino, concluded there were no reasonable grounds to believe that the officer comported himself unlawfully in the events leading to and including the shooting. There was no basis for proceeding with criminal charges against the officer and the file has been closed.14 April, 2022

On December 18, 2021, paramedics and Durham Regional Police Service officers attended a home in Whitby after learning that a 33-year-old man had consumed an overdose of prescription medication. As a result of the man making it difficult for the paramedics to do their job, an officer applied handcuffs to the front of the man. The officer rode with the man in the ambulance as it made its way to hospital. By the time the ambulance arrived at hospital, the man’s condition had markedly deteriorated. The handcuffs were removed and the man was transferred into the care of hospital staff. The Director of the Special Investigations Unit, Joseph Martino, concluded there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s condition. On December 2, 2021, a London Police Service officer was off-duty and in his home when a rock came crashing through his living room window. The officer went outside where he saw two males, and he pursued them on foot. The officer caught up to one of the males – a 17-year-old – and tackled him to the ground. After an altercation, the officer was able to pin him to the ground until additional officers arrived on scene. Following his arrest, the male was taken to hospital where he was diagnosed with a fractured left orbital bone. On November 25, 2021, an Ontario Provincial Police officer with the City of Kawartha Lakes Detachment attended a home in Bobcaygeon to speak with a 57-year-old man in relation to the theft of gasoline from a gas station that morning. After the officer knocked on the door in the rear yard, the man exited onto the back deck while holding a rifle. The man told the officer to “Get out of here,” as he lifted and pointed the rifle at the officer. In response, the officer shouted at the man to drop his weapon and drew his pistol. The officer discharged several rounds in quick succession. The man was struck and fell to the deck floor. Once officers were able to assure the area was safe of possible threats, they escorted paramedics to the scene where the man was located deceased.24 March, 2022
