SIU Finds no Basis to Proceed with Criminal Charges in Relation to Fatal Midland Collision
Just after midnight on September 29, 2020, a 35-year-old man and a friend were on foot on Highway 12 near its intersection with Jones Road in Midland. At about the same time, an Ontario Provincial Police officer was operating a police SUV east on Highway 12 toward Jones Road. As the officer approached and entered the intersection, the officer struck the 35-year-old man. The man had been walking diagonally toward the southeast corner of the intersection at the time. The officer had entered the intersection on a green light. Despite life-saving efforts by the officer, other police officers and paramedics, the man succumbed to his injuries at the scene. The Director of the Special Investigations Unit, Joseph Martino, has determined that while there are reasonable grounds to believe that the officer, particularly with respect to her speed in bad weather and lighting conditions, operated her cruiser in a dangerous fashion, he is not satisfied that the officer’s transgressions on balance rose to the level of criminal conduct.22 December, 2020
Former Peel Regional Police Detective Charged with Sexual Assault
The Director of the Special Investigations Unit (SIU), Joseph Martino, has caused a charge to be laid against a former detective with the Peel Regional Police (PRP) in relation to an incident that reportedly occurred in Barrie in the summer of 1992.22 December, 2020
SIU Determines Charges not Warranted in Relation to Man’s Arrest in St. Thomas
On the morning of May 24, 2020, the St. Thomas Police Service received a 911 call from a citizen reporting that he had just been threatened with a hatchet by a man. Officers were dispatched to the area and they observed the person of interest ride a bike into a wooded area. A perimeter was established and officers entered the wooded area along with a police service dog. The man was located. When he wouldn’t comply with demands to get on the ground, an officer ordered his dog to engage. The dog attacked the man, and the officers were able to apprehend him. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the 56-year-old man’s arrest and injuries that consisted of broken ribs.22 December, 2020

Understanding the Process of the SIU’s City of Kawartha Lakes Investigation
On November 26, 2020, a 33-year-old man and his one-year-old son sustained gunshot wounds during an interaction between the father and OPP officers in the City of Kawartha Lakes. The baby was pronounced deceased at the scene, and the father later succumbed to his injuries. Understandably, there is a pressing public interest in this case, including how the child died and whether it was gunfire from the father or OPP officers that caused the death. It will take time to make these determinations.14 December, 2020

On the evening of April 6, 2020, 26-year-old D’Andre Campbell lost his life after being shot by a Peel Regional Police officer inside his Brampton home. SIU Determines Charges not Warranted in Relation to Fatal Scarborough Shooting
On January 18, 2020, officers with the Toronto Police Service Guns and Gangs Task Force located a 37-year-old man who was wanted for the murder of a woman. In the course of the man’s arrest, three officers discharged their firearms at the man. He was taken to hospital and subsequently died on February 3, 2020. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any of the three officers who discharged their firearms committed a criminal offence in connection with the shooting of the man.4 December, 2020

No Basis to Charge Officers in Relation to Fatal Shooting of Man in Exeter
On the evening of December 3, 2019, Ontario Provincial Police officers attended a residence in Exeter to assist firefighters who were trying to enter the home to put out a kitchen fire. A 44-year-old man, alone in the home, had armed himself with an axe and refused to open the door to allow the firefighters entry. When officers forced the door open using a battering ram, the man confronted them while wielding an axe and approaching in their direction. Two of the officers fired their guns at the man. The man was transported to hospital where he succumbed to his gunshot wounds. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s death.3 December, 2020
Update: Man Involved in City of Kawartha Lakes Shooting Succumbs to Injuries
On November 26, 2020, a 33-year-old man became involved in an interaction with Ontario Provincial Police (OPP) officers in the City of Kawartha Lakes. When three officers discharged their firearms at the man, the man was struck. He was airlifted to hospital. Last night at 8:40 p.m., the man succumbed to his injuries.3 December, 2020
No Charges to Issue in Relation to Man’s Death Days After Arrest in Kenora
On June 10, 2019, a 35-year-old man was admitted to hospital after lapsing into acute medical distress following his arrest by Ontario Provincial Police officers in Kenora. The man was subsequently airlifted to the Winnipeg Health Sciences Centre where he passed away on June 15, 2019. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis for proceeding with criminal charges against the officers in this case, and the file is closed.3 December, 2020

On May 22, 2020, a 24-year-old man was seriously injured in Trenton when his vehicle lost control, careened into a ditch and rolled over several times. Moments before the collision, an Ontario Provincial Police (OPP) officer has been pursuing the vehicle. New Legislation in Effect Today for SIU
After more than 30 years of operating under the Police Services Act, the SIU now has its own governing legislation - the Special Investigations Unit Act (SIUA). No Basis to Charge Officer in Relation to Pursuit Prior to Oshawa Collision
On May 12, 2020, a 34-year-old woman was driving on King Street West in Oshawa when her vehicle was broadsided by a speeding pickup truck. The woman suffered serious injuries in the collision, including a pelvic fracture, spleen laceration and shoulder dislocation. Because the pickup truck was being pursued at the time by a Durham Regional Police Service officer, the SIU commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.26 November, 2020

On May 20, 2020, a 42-year-old man was arrested by Peel Regional Police officers and subsequently taken to hospital where he was diagnosed with a fractured right rib. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either of the arresting officers committed a criminal offence in connection with the man’s arrest and injury.24 November, 2020
Force Used to Arrest Man in Richmond Hill was Excessive, but SIU Unable to Attribute Force to Any One or More Identifiable Officers
On February 2, 2020, officers with the Toronto Police Service Emergency Task Force and the Major Crime Unit arrived at a home in Richmond Hill to execute a search warrant. The police had reason to believe that the residence was being used to confine the victim of a kidnapping being held for ransom. Upon entering the home, the hostage was located and two individuals were arrested. In the course of his arrest, a 28-year-old man sustained multiple facial fractures and a fractured spine. The Director of the Special Investigations Unit, Joseph Martino, has determined there are reasonable grounds to believe that excessive force was used, but he is unable to attribute said force to any one or more identifiable ETF officers. As such, there is no basis for proceeding with charges in this case.23 November, 2020

The SIU investigation into the circumstances surrounding the death of a 30-year-old woman in Toronto on October 26, 2020 is ongoing. The woman – who died in hospital that morning – had earlier been apprehended by Toronto Police Service (TPS) officers who had attended her apartment unit.19 November, 2020

On the morning of May 30, 2020, Toronto Police Service (TPS) officers were dispatched to a home after a mother reported that her 37-year-odl son was making threats of suicide. After further investigation, the decision was made to apprehend the man and to take him to the hospital. An interaction ensued between the officers and the man, and eventually the officers were able to handcuff him and escort him to an ambulance. At hospital, the man was diagnosed with a fractured nose. Update: Man who Sustained Gunshot Wound in Petrolia Succumbs to Injuries
On October 26, 2020, the SIU commenced an investigation in Petrolia. At approximately 7:30 p.m. that evening, Ontario Provincial Police officers had responded to a residence for a man in distress. Hours later, the officers located the man at the rear of the property and observed that the man had sustained a gunshot wound. The 40-year-old man was taken to hospital for treatment. On November 1, 2020, while in hospital, the man succumbed to his injuries and was pronounced deceased.2 November, 2020

SIU Determines Officer Did Not Commit Criminal Offence in Connection with Collision with Motorcycle in Toronto
Around noon on July 15, 2020, a man was operating his motorcycle westward on Kingston Road in Toronto, and a woman occupied the backseat of the motorcycle. At the same time, a Toronto Police Service officer, en route to deal with a call for service involving a person having threatened suicide, was traveling eastward on Kingston Road. When the police officer proceeded to turn left at the Harewood Avenue intersection, the police vehicle became involved in a collision with the motorcycle. The 24-year-old motorcycle passenger suffered serious injuries. The Director of the Special Investigations Unit, Joseph Martino, has determined that while the officer caused the collision that regrettably caused serious injuries to the woman, there are no grounds for proceeding with criminal charges against the officer and the file is closed.30 October, 2020

No Basis to Charge Officer in Relation to Pursuit Prior to Napanee Collision
On the night of April 5, 2020, an Ontario Provincial Police officer was performing speed enforcement on Highway 401, west of Beechwood Road in Napanee, when he clocked an approaching Jeep Compass at 176 km/h. The officer began to pursue the vehicle with the intention of stopping it, but the driver would not stop. Instead, she continued to speed eastward for a short period before taking an off-ramp. The driver lost control of the vehicle as she attempted to negotiate the exit curve and crashed into a ditch. Two passengers from the vehicle – a 27-year-old woman and a 31-year-old man – were seriously injured. The Director of the Special Investigations Unit, Joseph Martino, has determined that the officer comported himself within the limits of the law as he pursued the Jeep Compass, and as such, there is no basis for proceeding with criminal charges in this case and the file is closed.29 October, 2020
Man’s Death in Kingston Attributed to Drug Overdose; No Charges to Issue
On July 23, 2019, Kingston Police officers attended a local restaurant to assist paramedics by apprehending a 52-year-old man. Following a struggle, the officers were eventually able to gain control of the man who was then transported to hospital by paramedics. At the hospital, the man later stopped breathing and passed away. The pathologist at autopsy attributed the cause of the man’s death to sudden cardiorespiratory arrest due to methamphetamine, fentanyl and carfentanil toxicity. On June 18, 2020, a woman and her three young children tragically lost their lives in a motor vehicle collision at the intersection of Torbram Road and Countryside Drive in Brampton. The woman had been operating an SUV that was struck by an Infiniti. The Infiniti driver suffered unspecified serious injuries as well in the collision. As the Infiniti driver was fleeing from a police cruiser at the time, the matter was reported to the SIU and an investigation was commenced. On the evening of June 2, 2020, a 30-year-old man was arrested by an Ontario Provincial Police (OPP) officer in the parking lot of the ONroute Service Centre along Highway 400 north in King City. The man subsequently attended hospital and was diagnosed with a herniated disk. Charges not Warranted in Relation to Man’s Death 1.5 Weeks After Thunder Bay Arrest
On February 28, 2020, a 29-year-old man was admitted to hospital following his arrest by Thunder Bay Police Service officers. The following morning, he fell into acute medical distress. On March 10, 2020, the man passed away in hospital. Two of the officers who had custody of the man in the hospital when he was rushed to the Intensive Care Unit were identified as the subject officers for purposes of the SIU investigation. On the morning of July 13, 2020, a 54-year-old woman was apprehended under the Mental Health Act and taken to hospital. After the woman had been admitted into a secure room, a nurse entered the room to sedate the woman with an injection. As the needle made contact with the woman’s arm, she jumped up and advanced on the nurse, who backed away toward the door. A Sault Ste. Marie Police Service officer who was standing outside the room advised the woman to step back into the room. A struggled ensued until the woman was restrained and sedated with the help of hospital staff. Officers Acted with Tact and Professionalism; No Basis to Proceed with Charges in Relation to Woman’s Injury in Niagara Falls
On June 18, 2020, paramedics were dispatched to a complex of townhomes at an address in Niagara Falls as a woman had fallen in the parking lot and had hit her head. When paramedics located the 39-year-old woman on the porch of one of the homes, she was intoxicated, refused to be examined by the paramedics and she exhibited strange and irrational behaviour. Officers with the Niagara Regional Police Service were called for assistance. Many attempts were made to convince the woman to go with the paramedics, but this was to no avail. Suddenly, the woman ran from the porch and then fell, fracturing her left knee. She was taken to hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined that the involved officers acted lawfully throughout their dealings with the woman and thus there is no basis to proceed with criminal charges.7 October, 2020

Shortly after midnight on February 9, 2020, two Ontario Provincial Police officers attended an apartment in Hawkesbury following a call to police reporting that a 39-year-old man had been playing music very loudly and was throwing objects outside through his window. When the officers attempted to speak with the man, he tried to shut the apartment door on them. The man then spat on one of the officers. The officers reacted by taking hold of the man and forcing him to the floor. A short struggle ensued on the ground ending with the man in handcuffs. He was later taken to hospital where he was diagnosed with a fractured left elbow. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis for proceeding with criminal charges against either of the involved officers in relation to the man’s injury, and the file is closed.6 October, 2020

On the evening of June 11, 2020, the manager of a Mississauga motel called 911 to report that a man – a guest of one of the persons residing at the motel – had damaged property in the resident’s unit and assaulted another individual. When a Peel Regional Police officer located the 40-year-old man at the back of the motel property, the man was on his bicycle attempting to the flee the scene. Despite orders from the officer for the man to stop, the man kept riding but soon after fell off his bike. The man was arrested. When he complained of chest pain, the man was taken to hospital where he was diagnosed with a rib fracture. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and injury.2 October, 2020

On the morning of May 4, 2020, the superintendent of a building contacted police to report the presence of a minivan, parked but running, in a driveway by the building. Inside the minivan were two men who appeared to be passed out. Officers arrived and surrounded the vehicle with their cruisers. Shortly after, the officers opened both front doors of the minivan. The passenger was removed and taken into custody without incident. The 27-year-old man sitting on the driver’s side was roused by the officers, and an interaction ensued. He was eventually arrested. The man was transported to hospital where he was diagnosed with fractures of the left orbital bone and nose. Shortly after 1 a.m. on March 15, 2020, the Chatham-Kent Police Service received a 911 call from a woman reporting that her estranged partner had confronted her in the backyard of her home, was threatening her and had pointed a handgun at the garage door where she had sought refuge. Officers quickly located the person of interest – a 42-year-old man – emerging from his residence. When an officer called out to him, the man rode away on a bicycle. The officers pursued him in their cruisers for a short distance. The man then got off his bicycle, raised his arms as directed to do so, and was arrested and taken to the police station. He was subsequently transported to hospital where his fractured hand and possible concussion were diagnosed. On the morning of April 4, 2020, an Ontario Provincial Police (OPP) officer was on patrol traveling west on Highway 401 when he observed two vehicles speeding ahead of him. When the officer pulled up alongside one of the vehicles, that vehicle slowed down. The other vehicle, a Hyundai Sonata, continued to speed and ultimately exited on the Bathurst Street off-ramp. The officer pursued the vehicle and soon after another officer joined the pursuit. A short time later, the Sonata drove through a red light at Keele Street and Sheppard Avenue West and struck the front left area of a bus. The occupants of the Sonata, a 23-year-old man and a 24-year-old woman, were taken to hospital for treatment of serious injuries. On the afternoon of June 2, 2020, a Toronto Police Service officer was conducting speed enforcement for eastbound traffic on Lakeshore Boulevard West. When he observed two motorcycles traveling at high rates of speed, the officer maneuvered his motorcycle onto the roadway intending to stop the motorcyclists. When the riders sped away, the officer decided against a pursuit. At the intersection of Lower Simcoe Street, the riders disregarded a red light and one of the motorcycles collided into the driver’s side rear door of a SUV that had been traveling northbound on Lower Simcoe Street. The 34-year-old male rider would ultimately be diagnosed with fractures to both wrists and left elbow, as well as a bone chip in his neck. On June 12, 2020, a Greater Sudbury Police Service (GSPS) officer was dispatched to a townhouse complex after the groundskeeper reported a man was sleeping on the ground in the parking lot. The officer roused the 28-year-old man, and upon further investigation learned the man was wanted by police. Another officer was dispatched to assist with the arrest. The man was subsequently lodged in police cells and then taken to hospital where he was diagnosed with a fractured left hand. On the night of May 10, 2020, the Peel Regional Police (PRP) Tactical & Rescue Unit was dispatched to a Mississauga home after a 37-year-old woman told a crisis centre she was distraught and feeling suicidal, and that she had a gun and was planning to harm herself with it. Once they arrived, the officers saw the woman sitting on a step on the front porch. When the woman failed to adequately respond to the directions of the officers, she was taken to the ground. When the woman was seen to be reaching for something, a conducted energy weapon was deployed. The woman was apprehended and transported to hospital for treatment of a broken nose. On July 30, 2020, a 47-year-old woman was driving a vehicle south on Adelaide Street North approaching the roadway’s intersection with Nelson Street. At the same time, a London Police Service was on-duty and traveling north on Adelaide Street North toward Nelson Street. His intention was to proceed straight through the intersection. Each vehicle entered the intersection on a green light. They collided as the woman’s vehicle turned left in front of the police cruiser. The woman was transported by ambulance to hospital where she was diagnosed with a fracture to the radial bone in one of her arms. On the morning of July 23, 2020, a 30-year-old man got into a fight with another individual at a motel in Delhi, and then collapsed. Upon the arrival of Ontario Provincial Police officers and paramedics, the man got up and exhibited irrational and erratic behavior. The man was eventually apprehended under the Mental Health Act and taken to hospital. When the man later attempted to leave the Observation Room of the hospital, the officers took hold of the man and escorted him back. Moments after entering the room, the man lost his balance and fell to the floor. The man then rose to his feet and began to punch and kick the door. He was diagnosed with a break of one of his lower forearms. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any OPP officer committed a criminal offence in connection with the man’s apprehension and injury.17 September, 2020

On May 5, 2020, London Police Service officers were dispatched to a high-rise apartment building in London following a call from a woman who expressed concern for her 27-year-old son’s well-being. When officers arrived at an apartment on the 15th floor, they couldn’t get into the unit, but briefly were able to talk to the man by phone. Evidence soon came to the officers that the man was sitting unsupported on the balcony railing. The man then scaled down to the balcony directly below, and then down to the next balcony. As the man endeavoured to maneuver to the next balcony below, he lost his grip and fell to the ground. The man was rushed to hospital but succumbed to his injuries on May 8, 2020. An officer approached the woman, who was seated in the driver’s seat of her vehicle parked in front of the bar. He spoke with her and made a demand for a breath sample. In the early morning hours of April 12, 2020, several Ontario Provincial Police officers were dispatched from the Nottawasaga detachment to investigate two men who were going in and out of vehicles in Angus. When officers observed a truck which had been stolen, they briefly pursued the truck. Hearing radio transmission of the truck heading in her direction, an officer, of the Huronia West detachment, observed the truck and began pursuing it. Shortly after, the driver lost control of the truck and crashed into a traffic control signal pole. The 24-year-old driver was subsequently arrested and taken to hospital where he was diagnosed with a fractured cheekbone. The Director of the Special Investigations Unit, Joseph Martino, has determined the Huronia West detachment officer comported herself within the confines of the law as she briefly pursued the truck before the collision. On February 29, 2020, Thunder Bay Police Service officers were dispatched after police received a 911 call from an individual indicating that a man was armed with a hunting knife and breaking windows in the area of May Street South. Officers located the 45-year-old man and confronted him. The man was non-responsive and continued to walk away from the officers as the officers followed at a distance. Armed with the knife, the man then made his way to the Victoriaville Mall and the Civic Centre, eventually entering the parking garage. Officers located the man when he was heard to be moaning. He had fallen from a height and suffered multiple fractures. SIU Determines Intervention by Officers in Sault Ste. Marie Likely Prevented Man from Self-Inflicting Further Grievous Harm
On April 23, 2020, the Sault Ste. Marie Police Service received a call from personnel with the Sault Area Hospital expressing concern about the welfare of a 29-year-old man. Officers were dispatched to the hospital and they located the man in a vehicle. The man drove away, but officers located him soon after when they arrived at his residence. He was observed to be in possession of two knives. When the man made his way down a staircase, an officer positioned behind the man observed the man motioning with one of the knives across his neck. The officer deployed his conducted energy weapon in the man’s back. The man fell forward onto the ground but he continued to cut himself. CEWs were deployed by two officers, and the man was quickly subdued and handcuffed. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injury.18 August, 2020

No Charges Warranted in Relation to Man’s Death in Shuniah Township
On March 12, 2020, a woman called 911 to report that her son had threatened to take his life as well as hers. As a result, Ontario Provincial Police officers were dispatched to a Shuniah Township address. A sergeant was able to make contact with the 31-year-old man by phone. About an hour-and-a-half after the conversation ended, the man exited the home holding a rifle and he began walking towards a forested area. Soon after, the man suffered a fatal, self-inflicted gunshot wound to the head. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis for proceeding with criminal charges and the file is closed.18 August, 2020

A 28-year-old man was arrested by Toronto Police Service officers on February 13, 2020, in a Toronto apartment unit. A couple of days following his arrest, the man was diagnosed with two and possibly three fractured ribs. On April 23, 2020, a 29-year-old man suffered a broken nose in the course of his arrest in Markham. An Ontario Provincial Police officer and a York Regional Police (YRP) officer – working together with the YRP Organized Crime Enforcement Bureau – were the primary arresting officers and identified as the subject officers for purposes of the SIU investigation. In the morning of December 5, 2019, a Durham Regional Police Service officer was in the area of Simcoe Street South and Olive Avenue in Oshawa when he observed a reportedly stolen Lexus sedan. When the driver attempted to elude apprehension, the officer pursued the Lexus. A short time later, the Lexus broadsided a minivan at the Celina Street and Bruce Street intersection. As a result of the collision, the 63-year-old minivan driver suffered multiple rib fractures and dislocations and a collapsed lung. On that date, the man was riding a bicycle in King Township when he was struck by a vehicle in the area of Keele Street and Cavell Avenue. On March 30, 2020, OPP officers convened in North Bay with a view to arresting a 38-year-old man on drug possession and trafficking charges. It was their plan to arrest the man once he stepped out of the house. Shortly before 6:30 p.m., the man, in the company of a female, exited the home on Percy Street and travelled on foot eastward on the north sidewalk of Cassells Street. The officers approached, and following a brief struggle on the ground, the man was handcuffed and taken into custody by the officers. The following morning, the man was taken to hospital and diagnosed with a broken clavicle. In the evening of October 22, 2019, a 29-year-old woman was traveling eastbound on Sherbrooke Street in Peterborough when her vehicle was broadsided by a police cruiser proceeding south through the intersection at Clonsilla Avenue. The woman’s vehicle was propelled in a southeasterly direction into a private driveway at the corner of the intersection, where it collided with a parked pickup truck. The police officer was en route to the scene of a call for service involving an incident with a knife. The woman was subsequently removed from her vehicle and attended hospital, where she was diagnosed with a concussion. On July 25, 2020, a 56-year-old man fell from the North Augusta Road overpass in Brockville to the westbound on-ramp for Highway 401. He was transported to hospital where he was pronounced deceased. Use of Force by Officers, Including ARWEN and CEW Discharges, Deemed to be Reasonably Necessary in Apprehension of Man in Georgetown
On the morning of January 22, 2020, Halton Regional Police Service officers were dispatched to an address in Georgetown to apprehend a 46-year-old man who, it had been reported, was in mental distress and had guns in the house. Over the course of the next several hours, police tried several options in order to engage the man and convince him to leave the residence without his firearms. When the man exited his home from the rear patio door, attempts were made to continue negotiations with the man. Finally, an officer discharged his Anti-Riot Weapon Enfield at the man multiple times, and another officer discharged his conducted energy weapon. The man was arrested and taken to hospital where it was discovered that he had sustained a fracture of one kneecap. Officer’s Use of Cruiser to Strike Man in Ottawa Constituted Permissible Force; No Charges to Issue
On the evening of February 25, 2020, Ottawa Police Service officers responded to an address following a call to police reporting that a 61-year-old man had threatened his daughter with a knife. Soon after officers arrived, the man approached the driver’s side of one of the cruisers and swung a knife at the officer through the partially open driver’s-side window. The officer was not struck and closed his window fully. As a result, two other officers who were outside their cruiser drew their firearms. When the man began to move towards one of those officers, that officer re-entered his cruiser and decided to use his vehicle as a weapon. The cruiser accelerated forward, and its front right bumper collided with the man. The impact felled the man and dispossessed him of the knife. He was arrested and transported to hospital where he was diagnosed with multiple rib fractures. On the evening of November 15, 2019, Toronto Police Service officers were patrolling the area of 400 McCowan Road when they came upon a 14-year-old male who was outside his residence, which was a violation of a condition of his recognizance. When one of the officers called out to the teenager, he ran away and the officers pursued him on foot. The officers caught up to the teenager and arrested him. From the police station, the teen was taken to hospital where he was diagnosed with a fractured clavicle. On the morning of March 24, 2020, a Thunder Bay Police Service officer observed a vehicle being driven by a 32-year-old man. The police officers pursued the stolen vehicle to a parking lot behind a YMCA. During their efforts to arrest the man, an officer twice discharged his firearm at the vehicle, both times striking the windshield of the vehicle. One of the bullets struck the man’s hand. On the morning of March 26, 2020, Ontario Provincial Police officers were dispatched to the premises of a medical cannabis growing operation in Leamington. They had been sent following calls reporting that someone had been caught breaking and entering into the business. The officers arrived to find a person of interest – a 42-year-old man – in rough shape, and surrounded by workers and security personnel. In the course of the man’s arrest, he was punched and kneed a number of times by officers before he was handcuffed. He was subsequently transported to hospital where he was diagnosed with a fractured right arm. In the afternoon of April 17, 2020, a 21-year-old woman was a passenger in a Honda Accord when the vehicle was involved in an accident with a dump truck at the intersection of Mavis Road and the eastbound exit ramp of Highway 401. The woman broke a finger in the collision. Moments before the collision, an Ontario Provincial Police officer had attempted to pull over the Honda for a speeding infraction and then briefly pursued the vehicle. On September 23, 2019, a 21-year-old man walked into the Ottawa Police Service (OPS) headquarters and said he wanted to confess a murder. A physical struggle ensued and the man was subsequently arrested. The man was later transported to hospital where he was diagnosed with a fracture of his right orbital bone. On the evening of November 17, 2019, a 46-year-old man was a passenger in a Honda Civic involved in a collision with other vehicles at the intersection of Main and Queen Streets in Brampton. In the early morning hours of January 7, 2020, a 32-year-old man fled his home after having ingested a large quantity of medication. Concerned for his safety, an individual called 911 and paramedics and Cornwall Police Service officers were dispatched. An officer located the man in the area of a car wash on Brookdale Avenue. Shortly, the man pulled a knife out of his pocket, prompting the officer to draw his conducted energy weapon (CEW). The man then cut his throat with a knife causing serious injury. At about the same time, the officer discharged his CEW at the man, but the deployment had no effect. The officer provided care to the man until paramedics arrived and transported him to hospital. On September 11, 2019, members of the ROPE (Repeat Offender Parole Enforcement) squad were in the area of Park Street West and Janette Avenue in Windsor for surveillance. Shortly after 11 a.m., an officer came upon an unrelated incident which he believed to be one of domestic violence, and he intervened. He radioed his colleagues for assistance, and a 25-year-old man was arrested. During the course of the arrest, the man sustained a broken nose. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe the officers transgressed the limits of the criminal law at any point. On July 23, 2019, following a BOLO (be on the lookout) for a stolen red Mustang, a Peterborough Police Service officer located the vehicle and initiated a vehicular pursuit. The pursuit ended when the Mustang became involved in a collision with another motor vehicle. As a result of the collision, a 64-year-old woman from the second vehicle sustained a broken arm. After a stand-off with police, the driver of the stolen motor vehicle was shot and killed by an officer. He was subsequently transported to hospital where he was diagnosed with a single right-sided rib fracture. Officer Acted Lawfully in Hamilton Arrest of Man; No Charges to Issue
On November 21, 2019, a Hamilton Police Service officer received information that a 27-year-old man was in possession of a stolen truck. The officer located the truck in a parking lot of a residential building. When the man exited the building and attempted to gain access to the truck, the officer formed the necessary grounds to believe that the man was in possession of stolen property and he therefore had the necessary grounds to place him under arrest. During the course of arresting the man, the officer took him to the ground, resulting in the man sustaining a broken clavicle. The Director of the Special Investigations Unit, Joseph Martino, has determined the officer acted lawfully throughout the incident. On the morning of November 20, 2019, a North Bay Police Service officer observed a 28-year-old man operating a pickup truck in violation of a driving prohibition. The officer followed the man into a Canadian Tire parking lot, parked his unmarked vehicle behind the pickup truck, and made his way to the driver’s door intending to effect an arrest. At the sight of the officer, the man placed his pickup into gear, reversed a couple of times, striking the officer’s vehicle in the process, and drove away. The man was arrested two days later, at which time he claimed that the officer had injured his left hand during their earlier encounter. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injury.25 June, 2020
No Charges to Issue in Relation to Arrest of Man in Toronto Police Station Parking Lot
On the afternoon of December 6, 2019, a 50-year-old man struck a gate while in the 13 Division police station parking lot. When Toronto Police Service officers approached the vehicle to investigate what had happened, the man refused to exit his vehicle. A struggle ensued between the officers and the man, with included the use of an ASP baton and conducted energy weapon discharges by police. The man suffered a series of facial fractures in and around the right eye. The Director of the Special Investigations Unit, Joseph Martino, has determined that the officers who dealt with the man to place him under arrest acted lawfully throughout their encounter. As such, there is no basis for proceeding with criminal charges against any of the officers.24 June, 2020

On June 24, 2019, Toronto Police Service officers arrested a 24-year-old man for assault at the York University, and transported him to the police station. While in a search room, the man resisted the officers’ efforts to search him and a struggle ensued in the course of which the man was taken to the ground. The search was completed and the man was lodged in a cell. After being released from custody, the man attended hospital where he was diagnosed with a fractured rib. Update: SIU Continues Investigation into Man’s Fatal Fall from Balcony in London
The SIU continues to investigate the circumstances surrounding the death of a man last month in London. On the night of May 5, 2020, London Police Service officers responded to an apartment unit after receiving a call regarding a person in distress. While officers were outside the front door of the 15th floor unit, a 26-year-old man fell from the balcony to the ground below. The man was transported to hospital where he succumbed to his injuries on May 8, 2020.21 June, 2020

On December 10, 2019, Ontario Provincial Police officers attended an address in White River following complaints from a woman that a 33-year-old man had threatened to kill her and her daughter. While the officers maintained containment around the residence, the man refused to come out. The following morning, the man emerged from the residence and an interaction ensued. In the course of that interaction, the man was struck several times by rounds discharged by an officer’s Anti-Riot Weapon Enfield. He was taken to hospital where he was diagnosed with a fractured right arm. On the evening of November 12, 2019, a 27-year-old man who was under police guard escaped from an Oshawa hospital. Based on information received, officers located the man at an apartment building. A police service dog was used in the man’s apprehension and inflicted several bite wounds to the man’s left leg. While the Director of the Special Investigations Unit, Joseph Martino, says the officers may have been better advised to confront the man ahead of releasing the dog, Director Martino has determined there is no basis for proceeding with criminal charges in this case.18 June, 2020

Around the time officers entered the unit, the subject of the investigation – a 40-year-old man - fled through the sliding balcony doors onto the balcony and fell over the railing. He suffered multiple fractures in the process. On January 31, 2020, criminal investigation bureau (CIB) officers from Peel Regional Police were following a stolen van. As the van entered the City of King, the driver lost control of the van and drove into a snowbank at 16th Sideroad and Dufferin Street. As the 31-year-old female driver and her passenger attempted to remove the van from the snowbank, CIB officers moved in to arrest them. The driver was later taken to hospital where she was found to have sustained a broken right-handed finger. In the evening of January 5, 2018, a 26-year-old man was arrested by Ottawa Police Service officers in relation to a domestic assault and subsequently released on a promise to appear. In the early morning hours of December 4, 2019, Peel Regional Police officers were dispatched to investigate a suspicious pickup truck in Brampton. Two cruisers surrounded the parked pickup truck, but the 38-year-old driver struck the cruisers and managed to get away. Officers pursued the vehicle. Two officers deployed stop-sticks across the road, resulting in the tires of the pickup truck deflating. The vehicle was forced to a stop in the area of Advance Boulevard and Dixie Road, but not before the driver struck another cruiser. The driver exited the vehicle, and after a struggle, he was arrested. He was taken to hospital where he was diagnosed with a fractured nose. The Director of the Special Investigations Unit, Joseph Martino, has determined all the involved officers acted lawfully throughout their dealings with the man. On the night of March 5, 2020, a 36-year-old man was arrested without incident by a Gananoque Police Service officer for the theft of a motor vehicle. The man was taken to the police station and lodged in a cell. Several hours later, the man was observed on a video monitor to be wrapping his belt around his neck as a ligature. An officer arrived at the cell, opened the door, and removed the man’s belt. The man then pushed past the officer. He had made it as far as the booking area when he was pushed from behind by the officer into a metal table. Following a struggle between the man and two officers, the man was returned to his cell. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and the two broken ribs he sustained.15 June, 2020

On the evening of October 1, 2019, the North Bay Fire Service was dispatched to a reported car fire. Upon arriving at the scene, firefighters were informed that the driver of the car had gone towards Lake Nipissing. The firefighters went in that direction, and observed a man more than 100 metres from the shore. Emergency Medical Services and North Bay Police Service officers arrived, and along with the firefighters, tried to convince the man to come out of the water. Shortly after, the man disappeared below the water’s surface and did not reappear. Attempts were made to search for the man, but to no avail. His body was recovered the following day by an OPP underwater search and recovery team. The Director of the Special Investigations Unit, Joseph Martino, has determined that the officers went above and beyond what was required in the line of duty to save the man’s life, and as such, there are no reasonable grounds to proceed with criminal charges.11 June, 2020

At approximately 10:15 p.m. on July 9, 2019, an occupant of a Hamilton residence contacted 911 reporting that she had been assaulted by another woman. Officers were dispatched to the area and located the person of interest. The 32-year-old woman was apprehended and subsequently taken to hospital where she was diagnosed with a fractured right hand. On the evening of August 18, 2019, the Ottawa Police Service received a number of 911 calls complaining of a vehicle that was being driven in a dangerous manner. Officers located the vehicle and proceeded to arrest the driver. However, the driver – a 33-year-old man – violently resisted the efforts of the police officers, and on multiple occasions attempted to grab onto the use of force options on the officers’ duty belts. On December 31, 2019, a York Regional Police officer was on patrol when she observed a vehicle traveling at a high rate of speed. The officer followed the vehicle with the intention of stopping it. When the officer lost sight of the vehicle, she turned off her lights and siren, slowed down and disengaged. In the area of Ninth Line and Elgin Mills Road East, the vehicle of interest collided with another vehicle, injuring a 68-year-old man from the second vehicle. CPR was administered, but the man succumbed to his injuries at the scene. In the early morning hours of September 11, 2019, the Sarnia Police Service received a report of a motorcycle having been stolen. Shortly thereafter, the motorcycle was spotted and two officers in separate vehicles attempted to stop it. The motorcycle operator, a 35-year-old man, lost control of the motorcycle and crashed it in an intersection. He was transported to hospital where he was diagnosed with having sustained a fractured right arm. On the morning of April 20, 2020, a 49-year-old man attended the Elliot Lake Probation and Parole Office for a scheduled meeting. A few minutes later, two Ontario Provincial Police officers arrived at the office to arrest the man for having breached a condition of a prohibition order. At news that the officers were there to arrest him, the man became agitated and asked that the officers not enter the room he was in. Shortly thereafter, the man shot himself with a handgun he had retrieved from his waistband. He was pronounced deceased at the scene. On October 11, 2019, Durham Regional Police Service (DRPS) officers were dispatched to a residence in Pickering following a 911 call from the home reporting that a man was in possession of a knife, and there was concern about his behavior. Upon their arrival, the officers saw the 63-year-old man outside his residence and holding the knife. When the man would not drop his knife after being repeatedly asked to do so, an officer discharged his conducted energy weapon at the man. The man was arrested and transported to hospital where he was diagnosed with a fractured wrist. On November 17, 2019, a Walmart store employee in St. Catharines notified police that a man was behaving strangely, and that store management wished to have him removed from the property. Police attended and arrested the man outside of the store. Once the 35-year-old man was handcuffed, it was discovered that he had a cut under his right eye which was bleeding heavily. At hospital, the man was assessed as having a fracture to the orbital bone of his right eye. The Director of the Special Investigations Unit, Joseph Martino, has determined that the level of force used by police was reasonably necessary in the circumstances, and as such, no charges will issue.25 May, 2020

On October 4, 2019, a Toronto Police Service (TPS) officer arrested a 37-year-old woman in Scarborough on an outstanding warrant for theft. Man Arrested in Ottawa for Outstanding Warrant Held by Smith Falls Police Service; No Criminal Wrongdoing on Part of Ottawa Police Service Officers
At approximately 12:30 p.m. on September 16, 2019, a 43-year-old man was arrested by Ottawa Police Service (OPS) officers on an outstanding warrant held by the Smith Falls Police Service (SFPS). The man was transported to the OPS station, where he was held pending the arrival of SFPS officers. When the man was picked up by the SFPS, the officers noticed that he had swelling and bruising to his left eye and cheek. The man alleged that an OPS officer had struck him during his arrest. The man was taken to hospital where a CT scan revealed that he had sustained a comminuted fracture involving the wall of the left orbit. The Director of the Special Investigations Unit, Joseph Martino, has determined the evidence establishes that the man was not assaulted during the course of his arrest, nor was any force used against him by either of the police officers involved in his arrest. As such, no charges will issue and this file is closed.20 May, 2020
Arrest of Man in London was Lawful; SIU Closes File
On August 9, 2019, London Police Service (LPS) officers were dispatched to a residence for a domestic incident. When the first officer arrived, a 30-year-old man was brandishing a toy knife and goading the officer to fight him. The officer ordered the man to drop the knife and, when the man did not cooperate, the officer took the man to the floor. Other officers arrived to assist with the arrest. While in police cells, the man complained of pain in his right hand. He was transported to hospital where he was diagnosed with having sustained a fractured metacarpal. On March 25, 2020, two officers with the Barrie Police Service attended a 10th floor unit in an apartment building to check on the well-being of a 79-year-old woman. The officers knocked on the door, announced who they were and indicated they were there to make sure she was fine. There was no response. When one of the officers went to the main floor to get a key to the unit, he was informed that the woman was lying on the ground at the rear of the building. First aid was rendered, but the woman was pronounced dead at the scene. On November 3, 2019, the Hamilton Police Service Emergency Response Unit was called out to an inn in the City of Brantford in regard to a 33-year-old man who was believed to be inside the inn, and who was wanted in relation to a double homicide investigation. After evacuating the guests, attempts were made to contact the man but there was no response from within the man’s room. Shortly after, a single gunshot was heard coming from within the room. Upon entering the room, police officers discovered the man to be vital signs absent on the bed with a gunshot wound and a handgun under his left hand. On the night of January 6, 2020, in Ripley, a 21-year-old man assaulted an individual in the area of Ripley Street. The individual managed to get away. A short time later, the 21-year-old man assaulted another individual in the area. Civilians managed to pin the man on the ground while awaiting the arrival of Ontario Provincial Police officers. Following his arrest, the man was taken to the police station and lodged in cells. He was subsequently taken to hospital where he was diagnosed with a fractured right hand. The Director of the Special Investigations Unit, Joseph Martino, says the man’s hand injury appeared to have occurred prior to the officers arriving at the scene, and there is no evidence that any of the arresting officers acted other than professionally throughout their dealings with the man. On November 25, 2019, the Ontario Provincial Police (OPP) received a 911 call reporting that the driver of a U-Haul truck had filled up at a gas station on Highway 17 in White River and left without paying. An officer who was in the area spotted the truck and initiated a brief pursuit, which was terminated soon after. At some point, the U-Haul truck became involved in a collision. The occupants abandoned the truck and fled on a snowmobile. Shortly thereafter, the snowmobile crashed, resulting in serious injuries to a 29-year-old man. Use of Police Dog in Mississauga Arrest Determined to be Reasonable
On the afternoon of December 3, 2019, Peel Regional Police was notified that an impaired driver had crashed his pickup truck in the parking lot of a self-storage facility on Summerville Court in Mississauga. Officers arrived at the scene and soon after located the driver – a 41-year-old man – inside his storage unit. When the man was confronted by officers outside the unit, the man refused to show them both hands or assist in lifting the door. The officers lifted the door, and one of the officers released his police dog. The dog proceeded to bite into the man’s lower left leg. With the dog still latched to the leg, officers entered the unit and arrested the man. The man was transported to hospital where he was diagnosed and treated for several lacerations and puncture wounds. On August 24, 2019, a Niagara Regional Police Service officer was conducting speed enforcement in West Lincoln when he observed a motorcycle traveling westbound on Silver Street at a high rate of speed. The officer radioed this information to another officer. When the second officer motioned the 39-year-old motorcyclist to pull over, the man made a U-turn and accelerated away. Shortly thereafter, the motorcycle struck the first officer’s vehicle, which had been positioned across the eastbound lanes of traffic. The man was ejected from the motorcycle and transported to hospital where he was diagnosed with serious injuries. On the night of July 24, 2019, Peel Regional Police officers engaged in a pursuit of a pickup truck which was reportedly involved in several break and enters and thefts. Sometime after the pursuit was terminated, that same pickup truck was found to have been involved in a collision. Two people from the truck were located at the scene, and after a search, two other individuals from the vehicle were located hiding in the backyard of a Mississauga residence. A police service dog entered the area and gripped one of the individuals – an 18-year-old female – causing a serious injury that required treatment at hospital. Following his arrest, the man complained that he may have suffered a stroke or a heart attack and he was transported to hospital. On August 23, 2019, an Ontario Provincial Police officer was manning a simulated RIDE checkpoint in Huntsville when he signaled the driver of an Audi to stop. Instead, the driver sped off, almost striking the officer. The officer entered his police vehicle and pursued the Audi for a brief time before terminating the pursuit. Shortly thereafter, the Audi crashed into a parked car resulting in injuries to the 32-year-old male driver of the Audi and his 24-year-old female passenger. On March 15, 2019, a 54-year-old man passed away at the Huntsville District Memorial Hospital. He had been admitted to the hospital 11 days earlier following a cocaine overdose. As the overdose reportedly occurred while the man was imprisoned in a cell of the Ontario Provincial Police Burk’s Falls Detachment, the SIU commenced an investigation. At approximately 1 a.m. on July 28, 2019, Ontario Provincial Police officers attended a bar in Collingwood and arrested a 25-year-old man under the Liquor Licence Act. The man was transported to hospital and diagnosed with a broken nose. The Director of the Special Investigations Unit, Joseph Martino, has determined the officers conducted themselves lawfully throughout the interaction. On the night of September 16, 2019, an Ontario Provincial Police officer observed a vehicle travelling eastbound on 6th Line in New Tecumseth and noticed an issue with the rear licence plate. As a result, the officer made a U-turn to execute a vehicle stop. The driver of the vehicle accelerated, and the officer lost sight of the vehicle. Moments later, the vehicle ran a stop sign at the intersection of 5th Line and 20th Sideroad, striking a Volkswagen. The 23-year-old driver of the Volkswagen sustained serious injuries, and her passenger, a 36-year-old woman, was later pronounced dead at hospital. On the night of June 14, 2019, the mother of a 48-year-old man contacted 911 and informed that her son was holed up with knives in the bathroom of his Tecumseh home and was threatening to harm himself. Following a period of negotiation, a physical altercation ensued between the officers and the man culminating in the man being fatally shot by an officer. On August 13, 2019, a 38-year-old man sustained a fractured ankle and a back injury when the motor vehicle in which he was the rear seat passenger collided with a tree. Immediately prior to the collision, the vehicle was being driven at high speeds in an attempt to evade an officer with the Ontario Provincial Police. The Director of the Special Investigations Unit, Joseph Martino, is unable to reasonably conclude that the manner in which the officer operated his cruiser ran afoul of the criminal law’s proscriptions, notwithstanding the speeds he reached during his engagement with the vehicle. In the early morning hours of December 23, 2018, a Durham Regional Police Service officer was on patrol in his cruiser taking part in the service’s RIDE program. After observing a 23-year-old man leave a bar and enter a vehicle, the officer followed the vehicle. When the vehicle came to a stop, the man was asked to take a roadside breath test. After learning that the test registered an “ALERT”, the man fled on foot into a forested area. Shortly thereafter, officers located the man and arrested him. Later that day, the man was taken to hospital and diagnosed with a fractured finger. On August 2, 2019, a 49-year-old man attended an Immigration, Refugee, and Canadian Citizenship office in London. When the man told the office he was going to kill himself, the office contacted the police. London Police Service officers attempted to dissuade the man from setting himself on fire; instead, however, the man doused himself in gasoline. Officers fired their BIP launchers at the man, hoping to either distract or disable him, but the man ultimately set himself on fire. The flames were doused, and the man was taken to hospital for treatment of his burns. As a result of the collision, the 61-year-old female driver of the minivan sustained a concussion, while her front seat passenger, a 56-year-old male, sustained a fracture to his foot. On the night of June 18, 2019, Toronto Police Service officers were dispatched to a home in East York after a resident of the home reported that a man had forced his way into the residence and was currently barricaded in a bedroom while in the possession of a knife or fork. The house was contained from the outside pending the arrival of the Emergency Task Force (ETF). ETF officers entered the home and attempted to communicate with the man. Concerned for the man’s well-being, the officers forced the bedroom door open and arrested the man. On September 12, 2019, several calls were received by the Ontario Provincial Police from motorists reporting the presence of a man on the metal gantry across the Highway 407 eastbound exit ramp leading to Highway 410. Several officers were dispatched to the scene, with two officers parking their cruisers in the area below the 29-year-old man. As these two officers emerged simultaneously from their vehicles and walked towards the man, the man fell from the gantry and landed in front of the officers. The man was transported to hospital where he was diagnosed with severe injuries, including a fractured skull. On March 1, 2019, officers from the Caledon Detachment of the Ontario Provincial Police (OPP) responded to a 911 call requesting police assistance. OPP officers responded to the residence and arrested and handcuffed a 43-year-old man, following which they transported him to the Nottawasaga OPP Detachment. The man later filed a complaint about the arrest with the Office of the Independent Police Review Director (OIPRD), with the matter coming to the SIU’s attention in August of 2019. On the evening of April 12, 2019, Ontario Provincial Police officers were investigating the driving behavior of a 58-year-old woman who was operating her vehicle on Highway 417. The woman was arrested, and then taken to hospital where she was diagnosed with a fracture to her lower leg. In the early morning hours of June 2, 2019, a 36-year-old woman was arrested and transported to the Orangeville Police Service (OPS) headquarter where she was lodged in a cell. While in the cell, the woman ingested cocaine and fell into medical distress. Paramedics attended the police station and transported her to hospital where she was placed on life support. While SIU Director Joseph Martino says the woman ought to have been subjected to a more thorough search and medical attention secured sooner than it was after she ingested cocaine in her cell, he is unable to reasonably conclude that any of the officers who dealt with the woman transgressed the limits of care prescribed by the criminal law.24 February, 2020

In the early morning hours of July 3, 2019, a group of individuals pranked a home in Brant County multiple times by knocking on the home’s door, and then fleeing. The home’s owner, a Brantford Police Service officer, and another officer, waited to see if the individuals would return. When they did return, the second officer became involved in an interaction with a 16-year-old male and informed the youth he was under arrest. The officers had the youths wait for the arrival of the OPP. On April 3, 2019, there was a collision between a snowmobile and an Ontario Provincial Police cruiser on Highway 101 in Wawa. The snowmobile operator was transported to hospital where he was treated for multiple fractures of his left leg. While Director Joseph Martino has no doubt that the officer was driving dangerously in the moments before the collision, and that his dangerous driving was largely responsible for what occurred, he is of the view that the evidence falls just short of justifying criminal charges against the officer.18 February, 2020

On the evening of December 7, 2018, Toronto Police Service (TPS) officers were investigating a 24-year-old man in relation to drug trafficking offences. When the vehicle in which the man was a passenger entered a condominium parking lot, plainclothes officers in unmarked vehicles followed and conducted a high-risk takedown of the van and its occupants. The 24-year-old man was arrested and later taken to hospital where he was diagnosed with an orbital bone fracture. In the area of Weston Road and Little Avenue, a TPS officer spotted the stolen KIA and pursued it. A short time later, the KIA crashed into a dump truck. The 39-year-old male driver exited the vehicle following the collision and was arrested. On June 22, 2019, a Toronto Police Service officer attempted to stop a Honda Civic to investigate its occupants. Moments later, the Civic t-boned a Chevrolet Malibu in the intersection of Scarborough Golf Club Road and Lawrence Avenue East. The 77-year-old driver of the Malibu died tragically in the collision, and his 74-year-old wife, who was sitting in the passenger seat, suffered serious injuries.
