Special Investigations Unit Comments on Ontario Court of Appeal Decision in Peel (Police) v. Ontario (Special Investigations Unit)
Today, the Ontario Court of Appeal released its decision in Peel (Police) v. Ontario (Special Investigations Unit). It confirmed an earlier Superior Court of Justice ruling that the SIU has jurisdiction to investigate alleged criminal acts committed by individuals who were serving police officers at the time of the acts, whether they are now retired or not. In addition, the Court affirmed that the SIU has the authority to investigate incidents that happened prior to the SIU’s formation in 1990.

Toronto Police Officer Faces Second Charge
On November 30, 2010 the Director of the Special Investigations Unit, Ian Scott, laid a charge of Manslaughter against Toronto Police Constable David Cavanagh in relation to the firearm death of Eric Osawe in September of 2010. After consultation with the Crown Law Office-Criminal, Director Scott has now caused a charge of Second Degree Murder contrary to s. 235(1) of the Criminal Code to be laid against the officer.
