SIU Concludes Investigation into Man’s Arrest in Toronto

Mississauga, ON (30 December, 2022) ---
In the afternoon of August 31, 2022, Toronto Police Service officers were dispatched to a building after the property manager reported that a resident of the building had assaulted another individual. After speaking to individuals and reviewing video footage, the offices made their way to the 46-year-old man’s residence. In the course of attempting to arrest the man, an altercation ensued between officers and the man. He was eventually apprehended. The man was taken to hospital after his arrest and diagnosed with a broken nose. While accepting that the man broke his nose when it was forced to the floor by a knee strike from an officer, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the injury was attributable to unlawful conduct on the part of either of the arresting officers.  There was no basis for proceeding with criminal charges in this case and the file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
