SIU Concludes Investigation into Man’s Death in Penetanguishene
On August 31, 2023, a 36-year-old man in Penetanguishene was grievously wounded when he shot himself in the head with a semi-automatic pistol. The man never recovered from his wound. He was removed from life support in hospital and passed away on September 4, 2023. As Ontario Provincial Police officers were engaged with the man at the time of the shooting, the SIU was notified of the incident and initiated an investigation. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer in charge of police operations committed a criminal offence in connection with the man’s death.29 December, 2023
SIU Concludes Investigation into Arrest of Man in Brantford
In the morning of September 2, 2023, Brantford Police Service officers were dispatched to check on a Jeep that was stationary in the area of the Grey Street and Market Street intersection. Upon arrival, officers saw a man slumped over the steering wheel. When the man awoke and saw police, he placed his vehicle in reverse and drove into the front of a cruiser, traversing a tire deflation devise. The Jeep accelerated away, and officers followed. Shortly after, the Jeep collided with another vehicle, and the Jeep driver fled on foot. Officers confronted the man, and a after a struggle, the 31-year-old man was arrested. He was taken to hospital and diagnosed with a fractured right wrist. SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.29 December, 2023
SIU Concludes Investigation into Drug Overdose by Man While in London Cell
On the afternoon of September 1, 2023, a 31-year-old man was arrested by a London Police Service officer for violating the term of a conditional sentence order. The man was searched twice at the scene of his arrest and a glass pipe was seized. He was searched again at the police station, and then lodged in a cell. He denied being in possession of drugs. At approximately 5:30 p.m., the man was located unresponsive in his cell. Unbeknownst to police, the man had a quantity of fentanyl secreted on his person, which he had ingested at some point. CPR was performed and several doses of Narcan were administered. Paramedics transported the man to hospital where he was treated and eventually recovered from a drug overdose. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s overdose.29 December, 2023

SIU Concludes Investigation into Broken Ankle Suffered by Man in Toronto
In the evening of July 5, 2023, a York Regional Police officer was investigating a BMW in the area of Highway 400 and Steeles Avenue West when the officer came to learn that it was a vehicle of interest to the Toronto Police Service. The BMW struck the cruiser and then accelerated away. The BMW traveled through a red light and struck another vehicle. The 23-year-old BMW driver fled on foot while an officer gave chase. The man then attempted to carjack a vehicle, pointing a gun at the driver. The officer directed the man to exit at gunpoint, and the man did so. The officer then fired his conducted energy weapon (CEW) at the man and continued to discharge his CEW until the arrival of other officers. The man was transported to hospital where he was diagnosed with a fractured right ankle. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injury.29 December, 2023

On June 27, 2023, a 43-year-old man was seriously injured when he was shot by a Halton Regional Police Service officer in Burlington. SIU Concludes Investigation into Man’s Arrest by Halton Officers in Mississauga
In the morning of August 28, 2023, Halton Regional Police Service Tactical Unit officers convened in front of the door to an apartment in Mississauga. They had been called by the Peel Regional Police to assist with the execution of a search warrant for the premises The PRP had identified the occupants of the apartment as having been involved in a recent incident involving a firearm. Officers forced open the apartment door and stormed inside following the deployment of a distractionary device. Officers saw a 44-year-old man lying on the bed in the bedroom face down, and they handcuffed him behind the back. The man was later taken to hospital where he was diagnosed with fractures of the left orbital and zygomatic bones. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injuries.22 December, 2023
No Grounds to Charge Officers in Relation to Arrest of Man at Hamilton Park
In the evening of August 25, 2023, two Hamilton Police Service officers were dispatched to Woodlands Park following reports of a motorcyclist speeding in the park. The officers approached the 48-year-old motorcyclist and told him that he was being investigated for the manner in which he was operating his motorcycle. The man told the officers he was not who they were looking for and then turned to walk away. A struggle ensued as the officers attempted to handcuffed the man behind the back. He was transported to the station and then to hospital where he was diagnosed with a fractured right wrist. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.22 December, 2023
SIU Concludes Investigation into Drug Consumption by Man in Presence of Peel Police Officers
On August 24, 2023, a 41-year-old man was admitted to hospital for a possible drug overdose. As the drug consumption occurred while the man was in the custody of Peel Regional Police officers, the SIU was notified of the incident and initiated an investigation. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s hospital admission.22 December, 2023
SIU Concludes Investigation into Hamilton Pursuit
In the evening of August 25, 2023, a Hamilton Police Service officer was operating a marked police cruiser on Burlington Street East when his attention was drawn to a sedan travelling straight in a turn lane. He decided to stop the sedan for a Highway Traffic Act infraction. The sedan picked up speed, and when the officer caught up to it, he activated his emergency lights. The sedan failed to stop. Shortly after, the sedan ran over the foot of a 58-year-old female pedestrian, causing the pedestrian to fall. The officer stopped to render assistance as the sedan continued out of sight. The pedestrian was transported to hospital and diagnosed with a fractured foot. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the woman’s injury.22 December, 2023

On August 23, 2023, a 26-year-old woman cyclist died after being struck by a motor vehicle in Malton. As the vehicle was being pursued by Peel Regional Police officers at the time, the SIU was notified of the incident and initiated an investigation. SIU Concludes Investigation into Man’s Fall from Toronto Apartment Balcony
In the afternoon of August 23, 2023, a team of Emergency Task Force officers with the Toronto Police Service convened outside a Toronto apartment. They were there at the request of the Durham Regional Police Service, which had plans to execute a search warrant at the apartment and to arrest a 31-year-old man who was wanted for serious firearms-related offences. Shortly after ETF officers forced open the door and announced their presence, the man fell to the balcony below in his attempt to flee the apartment. The man was taken into custody. He had fractured his right arm in the fall and dislocated the right elbow. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injuries.21 December, 2023

In the morning of August 8, 2023, Toronto Police Service officers accompanied a child welfare worker to a residence as a court order had been issued directing the child welfare agency to apprehend the two children of a 33-year-old man. The man refused to turn over his children. Sometime later, a decision was made to take physical custody of the children. At this point, the man was holding the children on his lap. The officers unclasped the man’s hands, and one of the officers forced the man’s left arm away from one of his children, in the course of which a cracking sound was heard. The children were taken away from the scene, and the man was transported to hospital where he was diagnosed with a fractured left arm. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.6 December, 2023

SIU Concludes Investigation into Brampton Interaction Between Police and Man
On July 29, 2023, Peel Regional Police officers were dispatched to a residence in Brampton to take custody of a 42-year-old man. The man was placed in a cruiser and transported to the police station. The man protested that the police had the wrong person, and he grew increasingly frustrated with his arrest. When the man responded in the affirmative when asked if he was suicidal, the booking sergeant decided that the man should be assessed at hospital. The man was then placed in the rear seat of a cruiser for transport to the hospital. The man began to thrash about in the vehicle, striking his head against an interior plastic partition and rear window. The officers removed the man from the cruiser and held him down when he continued to jerk his body and flail his legs. Paramedics attended at the station and took the man to hospital where he was eventually diagnosed with a fractured left ankle. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.27 November, 2023

SIU Concludes Investigation into Lindsay Cruiser Crash
On July 28, 2023, a 59-year-old man was in the rear seat of a cruiser, being transported from one OPP detachment to another OPP detachment. In the area of Greenfield Road and Harvest Street in Lindsay, the officer operating the cruiser lost control of the vehicle and crashed into a field. The man in the rear of the cruiser was taken to hospital where he was diagnosed with serious injuries, including a broken clavicle and facial fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injuries.24 November, 2023
Officer Comported Himself with Due Care During Toronto Pursuit; No Charges to Issue in Relation to Fatal Collision
In the afternoon of July 29, 2023, a team of surveillance officers had gathered in and around the area of Dixon Road and Kipling Avenue as they were aware of a stolen pick-up truck in the vicinity. When the person of interest was observed making his way on foot towards the pick-up, unmarked police vehicles unsuccessfully attempted to surround the vehicle before it could be put in motion. Realizing what was happening, the 25-year-old man quickly entered the pick-up and accelerated away. The vehicle was briefly pursued by officers. In the area of Martin Grove Road and Dixon Road, the vehicle left the roadway and struck the concrete south-facing abutment of the Highway 401 off-ramp overpass. The vehicle exploded on impact. The man was declared deceased on scene by attending paramedics. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s death.24 November, 2023
No Charges to Issues Against Officer in Relation to Apprehension of Man on Toronto Overpass
In the morning of April 24, 2023, two Toronto Police Service officers were traveling travelling in a cruiser over Highway 401 on the Kipling Avenue overpass when they noticed a man straddling the east side railing of the bridge. Concerned the man was going to jump, the officers exited the cruiser and went towards him. Attempts were made to communicate with the man, but the man told them not to get any closer. After a couple of minutes, the man stood on the concrete ledge of the railing briefly before jumping to the sidewalk below. The officers moved in and attempted to grab hold of the man, and a struggle ensued. He was shortly after apprehended. At hospital, the 23-year-old man was diagnosed with a fracture of the right orbital bone. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.24 November, 2023
SIU Concludes Investigation into Milton Grocery Store Arrest
In the evening of July 27, 2023, Halton Regional Police Service officers were dispatched to The Home Depot at 1013 Maple Avenue in Milton to investigate a theft in progress. As one of the two persons of interest exited the store – a 48-year-old man – he saw police officers and fled across a parking lot and into a nearby Longo’s grocery store. Officers gave chase. When the man wouldn’t stop when ordered to do so, an officer deployed his conducted energy weapon at the man, and the man was struck. The man’s body locked-up and he fell forward, striking the floor with his face, and losing teeth and breaking his nose in the process. The man was arrested and taken to hospital for treatment of his injuries. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injuries.24 November, 2023
Ontario’s SIU to Review Nova Scotia’s Onslow Firehall Incident
In April 2023, in the interests of avoiding any potential or perceived conflict of interest, the Nova Scotia Serious Incident Response Team (SiRT) asked Ontario’s Special Investigations Unit (SIU) to review information considered by the Joint Federal/Provincial Commission into the April 2020 Nova Scotia Mass Casualty, with respect to shots fired by two RCMP officers at the Onslow Fire Hall on April 19, 2020.23 November, 2023

In the evening of July 25, 2023, Toronto Police Service officers were called to a residence after an occupant reported that a tenant was acting strangely, and the occupant was worried for the safety of others in the home. Two officers entered the home and made their way to a bedroom where there was a 48-year-old man. The man indicated he felt fine and denied wanting to hurt himself. Asked if he wanted to go to hospital, the man declined. About ten minutes later, another officer and two members with the Mobile Crisis Intervention Team arrived at the residence, and the man was engaged in conversation. Shortly thereafter, the man admitted to having thoughts of suicide. At about the same time the man was advised that there were grounds for an apprehension under the Mental Health Act, the man lifted a bottle from a nearby table and drank from it. Those in attendance quickly came to learn that the bottle contained automobile brake fluid. An ambulance was called, and the man received treatment in the ICU. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s apprehension.22 November, 2023
SIU Finds Shooting of Man by Toronto Police Service Officer Justified
On July 25, 2023, undercover Toronto Police Service officers were on the lookout for a 44-year-old man who was wanted in relation to a murder that had been committed the day before. When the man was seen walking towards a vehicle, a takedown was called. The man discharged his handgun multiple times at an officer, and he then fled on foot towards Kingsview Boulevard. Aware of the man’s general location, police established a perimeter and called in a dog handler to help locate the man. Shortly after the dog entered some brush in one of the rear yards, the man fired his weapon and the dog was fatally struck. An officer returned fire and the man sustained a gunshot wound to his right buttock. The man was arrested. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with shooting.22 November, 2023

The man produced a switchblade and then fled on foot while the officers gave chase. Another officer was driving in the area when he came across the man. The officer at some point fired his conducted energy weapon at the man twice, causing the man to fall to the ground and strike his head. He was transported to hospital where he was diagnosed with a brain bleed. In the morning of July 24, 2023, the Brockville Police Service received a call of a disturbance being created on King Street East by a group of inebriated individuals. Officers located the group and stopped their vehicles to speak with them. They recognized one of the group members as a person wanted for a robbery. At the sight of the police, the 25-year-old man ran. An officer confronted the man and told him he was under arrest. When the man failed to get on the ground when ordered to do so, the officer took him down. The man was handcuffed by the officer and transported to the station. When the man was subsequently taken to hospital, he was diagnosed with a fractured right forearm and left wrist. In the morning of July 23, 2023, the Ontario Provincial Police received a call informing them that a man, having fired a number of shots on his property from a rifle, had told the caller to contact the OPP, indicating he would be waiting for them outside. Officers were dispatched to the Picton residence and established a perimeter around the residence. When the man made his way on foot down this driveway towards the road, while holding a rifle, he was struck and felled by multiple Anti-Riot Weapon ENfield (ARWEN) rounds. He was then bit in the neck by a police dog. The man was handcuffed, and then taken to hospital where he was assessed under the Mental Health Act. The dog bite wounds were superficial. Officers surrounded the area and attempted to negotiate his peaceful surrender. The man told police he was on drugs and had a knife. When the man ran towards officers, an officer discharged his Anti-Riot Weapon ENfield, and the man was struck. The 46-year-old man was taken into custody. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the discharge of the ARWEN. Shortly after midnight of July 16, 2023, the Toronto Police Service dispatched officers to a residence on Thirtieth Street after 911 received a call about a possible break and enter. Upon learning that there were children that resided in the house, the officers forced open the front door and entered. In a second-floor bedroom, officers located a 37-year-old man and they took him into custody. The man was taken to the police station, and then transported to the detention centre. When the man complained of pain to his right hand, he was taken to hospital where he was diagnosed with fractures to the hand. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injuries.11 November, 2023
SIU Concludes Investigation Involving York Regional Police
On July 13, 2023, York Regional Police officers attended a plaza in Richmond Hill following a report of a stolen vehicle. Officers located the vehicle and conducted mobile surveillance. As the driver travelled west on Highway 9 east of Highway 400, he travelled over a tire deflation device that had been deployed by an officer. Soon after, the vehicle lost control and crashed into a ditch. A struggle ensued between the man and officers, and the man was eventually handcuffed. At hospital, he was diagnosed with a front nasal fracture. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injury.10 November, 2023

On July 7, 2023, a 21-year-old man was seriously injured in a motor vehicle collision in Vankleek Hill. On July 13, 2023, Halton Regional Police Service officers were dispatched to a home in Oakville after family members of a 22-year-old man called 911 reporting concern for the man’s welfare. Attempts to communicate with the man were made, and officers set up containment around the home as the man was in possession of weapons. The following morning, officers smashed a window and an officer discharged his Anti-Riot Weapon ENfield (ARWEN) at the man multiple times. The man was eventually taken into custody. In the afternoon of July 11, 2023, two OPP officers travelled to a house in West Nipissing, with the intention of arresting a 47-year-old man for whom there were warrants of arrest. The officers encountered the man outside the residence. As he was pushing a person in a wheelchair, the officers allowed the man to take the person into the home. Once inside the threshold of the front door of his home, the man attempted to close the door shut on the officers. The officers pushed back and entered the home. A struggle ensued, and more officers arrived to assist. After some time, the officers were able to wrench control of the man’s arms and handcuff them behind the back. At hospital, the man was diagnosed with a fractured left rib. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer involved in the man’s arrest committed a criminal offence.7 November, 2023

In the evening of June 16, 2023, Ontario Provincial Police officers were dispatched to an address in Wasaga Beach after a woman reported that a man was locked inside an apartment with a knife in his hand threatening to kill himself. Upon arrival, officers made attempts to de-escalate the situation. When the man eventually exited the front doors with his hands up, the officers approached him and took hold of his arms. The man began to resist the officers’ efforts to position his arms behind the back, dropping them down towards his waist. One of the officers reacted by tripping the man to the ground, after which the officers handcuffed him. Following his arrest, the man was taken to hospital where he was diagnosed with a fractured right knee. In the afternoon of June 16, 2023, an individual called 911 to report that a man had discharged a firearm at a building in the area of Kingston Road and Woodbine Avenue. Officers located a vehicle that was believed to have been involved in the shooting, and attempted a takedown of the vehicle. The driver was apprehended, but the 31-year-old male passenger escaped. He was last seen running into a ravine. A police service dog handler, and his dog were dispatched to assist with the search. While in the ravine, the officer deployed the police service dog on a long lead. Shortly after, the dog had located the person of interest and bit into the area of the back of his upper right arm/shoulder. The man was transported to hospital following his arrest. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the police service dog handler committed a criminal offence in connection with the man’s injuries. In the early morning of June 2, 2023, Peel Regional Police officers gathered outside an Etobicoke apartment to arrest a 39-year-old man who was wanted on firearm and domestic violence charges. The Tactical and Rescue Unit announced their presence outside the door, and attempts were made to enter the apartment. Upon entering, officers located the man, deceased. He was lying on the bed and was holding a gun in his right hand. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s death. On the night of May 30, 2023, Hamilton Police Service officers were dispatched to a residential area after reports had been received of a person travelling between the houses and garages. Two officers located a person of interest in the backyard of a house, and they confronted him. The 40-year-old man attempted to escape apprehension by running towards a gate in the fence that led to the front of the house. Other officers grabbed the man and tripped him to the ground. A struggle ensued before the man was handcuffed and taken into custody. At hospital, he was diagnosed with a fractured right orbital bone. In the evening of May 19, 2023, Peel Regional Police officers were dispatched to a break and enter in progress at a home in Mississauga. At the sight of the arrival of police officers in the area, a 16-year-old male and several acquaintances fled from the scene. At the north end of McKenzie Park, officers observed the teenager walking away from a police officer. The officers travelled across the park towards the Complainant, stopped and exited their cruiser, and confronted him. An interaction ensued. Following the man’s arrest, he was transported to hospital where he was diagnosed with a broken nose. The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe an Ontario Provincial Police (OPP) officer committed a criminal offence in connection with shooting a firearm in the direction of a man in May 2023. The shooting on May 11 was part of a series of events at a home in Bourget, where one officer was fatally shot by the man. The subject official was grievously wounded by the man. In the morning of May 18, 2023, a joint forces operation involving officers from several police services attended a residence in Niagara Falls to execute a search warrant for drugs. The team forcibly entered through the front door of the home with the use of a ram, after which three of them made immediately for the stairs to the second floor. As the officers neared the second floor landing, a 36-year-old man leapt over the railing and descended upwards of three metres. He landed on the first flight of stairs, fracturing his right foot in the process, and was struck by a conducted energy weapons deployment before he was handcuffed behind the back and taken into custody. On the morning of August 31, 2023, Halton Regional Police officers went to a property in the area of Laurier Road in Penetanguishene to execute search warrants. The person of interest – a 35-year-old man – barricaded himself in an RV on the property. Ontario Provincial Police Tactical Unit officers and a negotiator also attended. At approximately 9:30 p.m., OPP officers deployed pepper spray into the RV. The man exited the RV and was observed to have suffered a self-inflicted gunshot wound. On May 4, 2023, a woman attended the OPP Orillia detachment to provide a statement detailing an assault that had been perpetrated on her by a man earlier that day. When officers drove her back to her residence, one of the officers remained in the vicinity in the event the man returned. The 33-year-old man lived at the residence but had left following the assault. The officer watched as the man re-entered the ground-floor apartment. Once other officers arrived, they entered the residence. The man pushed one of the officers. An interaction ensued, and the man was eventually subdued and handcuffed. They had been informed that a man and woman had been involved in a quarrel which became physical when the woman threatened the man with weapons. At one point, the woman had retrieved a knife and used it to stab the man several times. The man left the home just as police and paramedics were arriving. From outside the home, an officer called out to the 30-year-old woman, and the woman exited the house onto the front deck. The officer approached the woman and placed his hands on her to take her into custody, after which the two went to the ground. She was handcuffed and taken to hospital where she was diagnosed with a fractured sternum and broken ribs. The man was taken into custody and lodged in a police cell. About 40 minutes later, the man fell forward in his cell, striking his forehead on the floor. SIU Concludes Investigation into ARWEN Discharge at Man in Kenora
In the morning of May 1, 2023, two Ontario Provincial Police officers were on foot patrol in McLeod Park in Kenora when they came across a man lying on live railway tracks. As the officers neared the man to check on his well-being, the man rose to his feet and advanced on the officers holding a knife. The officers drew their firearms and the man turned away. Additional officers arrived on scene. There was an interaction, and one of the officers fired his Anti-riot Weapon ENfield (ARWEN) at the man, striking him in the lower back. The man, still in possession of the knife, then climbed over the railing of the bridge and sat on the ledge. After some negotiations, the man threw the knife and climbed back onto the bridge. He was arrested and taken into police custody. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the ARWEN discharge. When the officers advised that his vehicle would be towed and he would be arrested, the 58-year-old man started his engine and fled. The officers chased after the man for a distance before discontinuing their pursuit. Shortly thereafter, the Jetta was located at a townhouse complex in Burlington. The officers engaged the man, and an interaction ensued. The man was subsequently arrested. When the man complained of pain, he was taken to hospital where he was diagnosed with a rib fracture. In the morning of April 28, 2023, Toronto Police Service officers arrested a 32-year-old man who was observed in what appeared to be a drug transaction. The man was handcuffed behind his back, subjected to a search and then placed in a cruiser for transport to the police station. When the officer driving the cruiser could not see the man in his rearview mirror, the cruiser was stopped. Officers checked on the man and noticed that the man had placed a plastic bag with a white powder in his mouth. The bag was removed from the man’s mouth, and he was taken to hospital. He was pronounced deceased in the evening. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in this case. At approximately 2:30 a.m. on April 29, 2023, Durham Regional Police Service officers responded to an Oshawa residence after an individual reported that a man was in their apartment refusing to leave, and they wanted him out. On April 23, 2023, a 14-year-old male passed away, the result of a self-inflicted gunshot wound. As Timmins Police Service officers were either responding to the scene, or present in the vicinity, at the time of the shooting, the SIU was notified and initiated an investigation. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the youth’s death. SIU Concludes Investigation into East Garafraxa Collision Between Cruiser and Civilian Vehicle
In the morning of April 21, 2023, an off-duty officer was making his way home in a marked police vehicle. While travelling north on County Road 24, near Side Road 10 , the cruiser was struck by a southbound Volkswagen Jetta. The 30-year-old male driver of the Jetta was taken to hospital and diagnosed with multiple serious injuries, including various fractures and internal bleeding. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision. There was no basis for proceeding with criminal charges in this case, and the file has been closed.18 August, 2023
SIU Concludes Investigation into Woman’s Fall from Bedroom Balcony in Listowel
In the evening of April 19, 2023, Ontario Provincial Police officers were dispatched to an apartment building in Listowel for a domestic disturbance call. One of the involved individuals – a 40-year-old woman – was wanted by police for breaching the terms of a judicial release order. She had removed a monitoring device from her person. When no one answered their knocks on the door, the officers entered an apartment unit and eventually located the woman hiding in a closet. She stepped out from the closet at the officers’ request and proceeded to walk past them out of the room. The officers followed her into an adjacent bedroom as she made her way onto a balcony and jumped. The woman was taken to hospital and diagnosed with multiple fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the woman’s fall. There was no basis for proceeding with criminal charges in this case, and the file has been closed.17 August, 2023
SIU Concludes Investigation into Fatal London Collision
In the early morning hours of April 19, 2023, a London Police Service officer was on patrol when a GMC 3500HD pick-up truck caught her attention. The officer travelled behind the GMC until it fled. In the intersection of Thompson Road and Adelaide Street South, the GMC collided with a Ford F150 pick-up truck. The 62-year-old woman operating the Ford died at the scene. The 38-year-old driver of the GMC fled from the wreckage but was later captured and taken into custody. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision and the woman’s death. There was no basis for proceeding with criminal charges in this case, and the file has been closed.17 August, 2023

SIU Concludes Investigation into Discharge of ARWENs by Police at Man in Brantford
On April 13, 2023, Brantford Police Service officers were dispatched to a residence for a domestic dispute between a woman and a 34-year-old man. Officers arrived to find the man seated on the front stoop of a residence, while holding a knife up against his neck. The man was distraught and indicated he wanted to die. He cried and told the officers to shoot him. Attempts were made to communicate with the man and de-escalate the situation. The man did eventually drop the knife. However, when he quickly moved to retrieve it, he was struck with the probes of a conducted energy weapon fired by an officer. At the same time, two other officers fired a single round from their ARWENs, neither of which struck the man. Officers took the man into custody. He had suffered no serious injury. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with their use of the ARWENs. There was no basis for proceeding with criminal charges in this case, and the file has been closed.11 August, 2023

SIU Concludes Investigation into Discharge of Firearm at Man in Norwich
In the afternoon of April 10, 2023, after a report that a 44-year-old man was intending to shoot himself, Ontario Provincial Police officers responded to a residence in Norwich. Officers set up containment around the address and a crisis negotiator was enlisted to attempt to resolve the situation peacefully. As the standoff continued into April 11, 2023, the police decided on a more proactive posture after learning that the man had inflicted cuts to his neck and hands. A team entered the home and encountered the man in the kitchen. An officer ordered the man to drop the knife that he was holding, and then fired a single-round from his Anti-riot Weapon ENfield (ARWEN). The man was struck, he dropped the knife and was then bit in the shoulder by a police service dog. After being arrested, the man was taken to hospital for treatment. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injury. On March 13, 2023, officers were called to the apartment and found a man with stab wounds. Following a 12-hour standoff, during which the man shot at police and injured two officers, police deployed tear gas into the man’s bedroom. During his arrest, an officer struck the man with several knee and hand strikes. The man was handcuffed and taken to hospital.10 July, 2023

The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe three Ottawa Police Service officers committed a criminal offence in connection with shooting a 28-year-old man. On March 4, 2023, officers were called to a residence on Garden Glen Private in Nepean for a call about the man being in mental distress and in possession of firearms. Officers located the man inside, behind the door and holding a gun. As the officers retreated, the man opened the door and fired in their direction. He was met with return fire, which struck and wounded his right forearm and right leg. He later surrendered and was arrested.30 June, 2023

On February 26, 2023, the woman was arrested for intoxication after having been ejected from Elements nightclub on King Street West in Kitchener. The woman was taken to the police station and while en route to the cell, the woman kicked a special constable. The two officers reacted by pushing the woman against the wall. Following her release from custody, the woman saw a doctor on March 1 who diagnosed her with a mild concussion.30 June, 2023

The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe an Ontario Provincial Police (OPP) officer committed a criminal offence in connection with the serious injuries suffered by a 60-year-old woman during her arrest in Orillia. On February 15, 2023, the OPP went to a residence in relation to the woman who was reported to be trespassing. The woman, who was in the bathtub, did not or could not leave due to intoxication and an officer removed and arrested her. While Director Martino accepted the officer caused the woman’s right shoulder dislocation and fracture when he pulled her from the tub, there were no reasonable grounds to believe the officer comported himself other than lawfully.28 June, 2023
Investigation into Man’s Broken Ribs During Arrest in London Completed
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a London Police Service officer committed a criminal offence in connection with the serious injury suffered by a 39-year-old man during his arrest. On March 1, 2023, officers were called to the London Public Library on Dundas Street about the man who reportedly assaulted another man. Officers told the man he was under arrest, and he refused to be handcuffed. The officer struck the man with a series of knee strikes and punches and a takedown to the ground before he was handcuffed. As a result, the man suffered fractured ribs.28 June, 2023
Investigation into Man’s Self-Inflicted Death in Kingsville Completed

Officers then approached the man on the ground and removed the knife from his possession and arrested him. At hospital, the man was diagnosed with a fracture to the base of his skull. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injury. On January 30, 2023, the SIU was notified of a sexual assault that was reportedly perpetrated by a Sault Ste. Marie Police Service officer against a 42-year-old man on November 4, 2021. The SIU initiated an investigation. On SIU Director Joseph Martino’s assessment of the evidence, there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the complaint of sexual assault. Investigation into Motorcycle Crash in Bowmanville Concluded

On February 19, 2023, the officer attempted to stop the 41-year-old driver for speeding and operating a motorcycle without a licence. On February 14, 2023, the woman slipped her arm under the cell door and took cleaning solution from a nearby cleaning cart and drank it. In the early morning hours of February 12, 2023, a vehicle drove into a ditch between Mavis Road and the on-ramp to westbound Highway 401 from southbound Mavis Road. When both vehicle occupants admitted to drinking to a Peel Regional Police officer, a breath test was administered. The male driver blew over the legal limit and was arrested. The 44-year-old female passenger became upset and began to walk away from the officer down the ramp towards the westbound lanes of the highway, falling twice in the process. The officer caught up with the woman and placed her under arrest with the assistance of a firefighter, who had also responded to the site of the collision. The woman was transported in ambulance to hospital and diagnosed with a fractured right thumb. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the woman’s arrest and injury. In the early morning of February 8, 2023, Toronto Police Service officers were dispatched to an apartment on Ellesmere Road in connection with a domestic disturbance. Once becoming aware that officers were at the door of the apartment unit, a 26-year-old man fled to the balcony where he planned to scale down balcony netting to avoid apprehension. In the process, the man fell and landed on the ground below. The man was transported to hospital and diagnosed with multiple internal injuries. When the driver attempted to navigate around a police cruiser, the man lost control of his vehicle and slid into a another cruiser. The officer contacted the police service, and then proceeded to follow the woman when she began to walk away. Instead of stopping when ordered to do so, the woman picked up her pace. The officer caught up to her and in interaction ensued. The officer kept her there until other officers arrived. The following day, the 42-year-old woman went to hospital and was eventually diagnosed with a fractured right hip. On January 5, 2023, the Thunder Bay Police Service notified the SIU that they were recently in receipt of information in which it was reported that officers had assaulted a 44-year-old man in the course of his arrest on December 19, 2021. The SIU initiated an investigation. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest. There was no basis for proceeding with criminal charges in this case, and the file has been closed.3 May, 2023

SIU Concludes Investigation into Barrie Collision that Resulted in Injuries to Four People
In the evening of January 1, 2023, a Barrie Police Service officer was operating a marked police cruiser on routine patrol travelling north on Yonge Street. His passenger was another officer. When an Infiniti sped past the cruiser, the officer activated his emergency lights and accelerated after the Infiniti. Soon after, the driver of the Infiniti lost control, left the roadway, and struck a concrete utility pole. Continuing further a short distance, the vehicle came to rest on the grass boulevard. Each of the four occupants of the Infiniti was taken to hospital where they were treated for various fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer operating the cruiser committed a criminal offence in connection with the collision. There was no basis for proceeding with criminal charges in this case, and the file has been closed.1 May, 2023
SIU Concludes Investigation into Man’s Fall from Bridge in Hamilton
In the afternoon of January 1, 2023, the Hamilton Police Service received a 911 call from a 57-year-old man asking that traffic be stopped below the King Street East bridge over Kenilworth Avenue South, as he intended to jump from the bridge to end his life. Once officers arrived on scene, they attempted to speak with the man. Meanwhile, the Mobile Crisis Rapid Response Team (MCRRT) unit was asked to attend at the scene to take carriage of the matter. While officers encourage the man not to jump, and while the MCRRT was en route, the man sat on the ledge and, after a short period, pushed himself off the bridge. The man was transported to hospital where he was diagnosed with fractures of the right femur, right pelvis bone and left hip bone, and a tear to the bladder. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s fall and injuries. There was no basis for proceeding with criminal charges in this case, and the file has been closed.29 April, 2023

SIU Concludes Kitchener Investigation into Cruiser and Bicycle Crash
In the early morning of December 19, 2022, Waterloo Regional Police Service officers were dispatched to a Kitchener construction site for a theft in progress. An officer called out to a man who was walking away from the site with his bike, but the man refused to stop. The man then climbed onto the bike and began to ride away. Shortly after, another officer in a cruiser spotted the man. Within moments, the man’s bike and the cruiser collided. In hospital, the 30-year-old man was diagnosed with multiple left-sided rib fractures and a hemothorax. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and injuries. There was no basis for proceeding with criminal charges in this case, and the file has been closed.28 April, 2023

On December 29, 2022, a 20-year-old man was arrested by St. Thomas Police Service officers, taken to hospital, and diagnosed with a fractured right clavicle. The SIU’s investigation is now concluded. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s serious injury. On December 27, 2022, a 14-year-old male was seriously injured in the course of his arrest by Toronto Police Service officers. Two of the officers were identified as the subject officials in the ensuing SIU investigation. On December 26, 2022, a 21-year-old man was seriously injured in a motor vehicle collision in Milton. As the vehicle he was operating had been pursued moments before by Halton Regional Police Service officers, the SIU initiated an investigation. The Director of the Special Investigations Unit, Joseph Martino, has found no reasonable grounds to believe a Durham Regional Police Service officer committed a criminal offence in connection with the serious injury suffered by an 18-year-old man in Oshawa. On December 22, 2022, the man was seriously injured when he jumped from a second-story window. As officers were on scene, the SIU investigated. The man was diagnosed with a spinal fracture from the fall, and self-inflicted stab wounds.21 April, 2023

The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe two Windsor Police Service officers committed a criminal offence in connection with the serious injury suffered by a 58-year-old man. On December 21, 2022, officers were called to an apartment in Riverside following a 911 call about a man refusing to leave and fighting with a resident. SIU Concludes Investigation into Shooting Death of Man at Vaughan Condominium
On the evening of December 18, 2022, York Regional Police received 911 calls from residents of a condominium building in Vaughan reporting an active shooter in the complex. One of the first officers on scene located the shooter in the hallway of one of the floors. When the man refused to drop his pistol, and instead raised the hand holding the pistol as if readying to point it at the officer, the officer discharged his weapon four times. The man was struck. Despite officers administering first-aid, the man succumbed to his injuries at the scene. Five other people were found deceased on three different floors of the building. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting. There was no basis for proceeding with criminal charges in this case, and the file has been closed.16 April, 2023

Shortly after 4 a.m. on December 16, 2022, an Owen Sound Police Service officer observed a 23-year-old man in the downtown area who was in violation of a release order curfew condition. When the officer advised the man that he was under arrest, the man ignored the officer and walked away. A struggle ensud, and the officer punched the man two to three times in the face. With the assistance of another officer arriving at the scene, and after some further struggle, the man was eventually handcuffed. He was transported to the police station and then to hospital where he was diagnosed with a fractured right orbital bone. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injury. SIU Concludes Investigation into Belleville Police Pursuit Preceding Collision
In the evening of November 27, 2022, a Belleville Police Service officer was working a spot check when a pick-up truck arrived at the spot check and initially came to a stop before it accelerated away. The officer alerted the officers of what had occurred, entered her cruiser, and chased after the pick-up truck. Shortly after, the pick-up truck collided into the rear end of another vehicle before travelling a further short distance and striking the wall of a business. The 35-year old driver of the pick-up truck exited the vehicle and fled on foot. He was located by officers and taken into custody. Following his arrest, the man was taken to hospital and diagnosed with a fractured right wrist. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the pursuing officer committed a criminal offence in connection with the man’s injury.28 March, 2023
SIU Concludes Investigation into Toronto Arrest
In the late afternoon of November 27, 2022, Toronto Police Service officers were dispatched to a motel on Kingston Road in Toronto following a 911 call to police regarding an armed robbery. Officers set up a perimeter around the area, and with the help of a police dog, the man was located hiding in a refuse bin situated by the front of a nearby home. One of the officers fired his conducted energy weapon at the man and he was quickly grounded before being handcuffed and taken into custody. The man was taken to the police station and then to hospital, where he was diagnosed with a broken nose. While accepting that the man’s broken nose was incurred as he was being arrested by officers, SIU Director Joseph Martino determined there was insufficient evidence to reasonably conclude with any confidence that the man was subjected to excessive force. As such, there was no basis for proceeding with criminal charges in this case. The file has been closed.27 March, 2023

On February 20, 2023, an officer attempted to apprehend the man at a coffee shop on McIntyre Road as there was a warrant for his arrest. The man rose to his feet and turned his back as if preparing to surrender his hands to be handcuffed. Before the officer could handcuff him, the man fled and slipped at the front door, breaking his right ankle. The officer followed and slipped, falling on top of the man. While he was initially receptive to the idea of accompanying the officers to hospital for a mental health assessment, he later became defiant. The man was handcuffed and searched, after which he spat at the officers. The man was taken down to the floor and arrested for having assaulted a peace officer. Following his arrest, the man was transported to the detachment and lodged in a cell. When he complained of pain to a leg, the man was taken to hospital and diagnosed with a fractured right knee. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that either officer committed a criminal offence in connection with the man’s arrest and injury. On October 31, 2022, a 57-year-old man was in a cell in the Southwest Detention Centre in relation to his arrest for causing damage to a vehicle. When the man wouldn’t exit the cell to be transferred to the correctional facility, officers with Windsor Police Service were notified. After trying to reason with the man, officers entered the cell and an interaction ensued. The man was eventually handcuffed and taken to hospital where he was diagnosed with two right lateral rib fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injury. SIU Concludes Investigation into Innisfil Interaction
On October 26, 2022, the Barrie Police Service became aware that an 85-year-old man, who suffered from dementia, had gone missing from a retirement home in Barrie. An officer located the man in Innisfil. The man was sitting in the driver’s seat of a car parked in the driveway of a home. When the man refused to give up the key when asked by the officer, and then moved to insert the key in the ignition, the officer grabbed the man by the upper left arm to remove him from the driver’s seat. The man complained that his left arm hurt. At hospital, he was diagnosed with a fractured left humerus. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injury. There was no basis for proceeding with criminal charges in this case, and the file has been closed.24 February, 2023
SIU Finds No Grounds to Charge Officers in Relation to Arrest of Woman in Toronto
On October 27, 2022, building staff contacted police to report that a woman was refusing to vacate her room, despite the room being scheduled for a fumigation. Officers arrived at the building and explained to the 57-year-old woman why she had to leave and gave her 15 minutes to pack her belongings. When she still wouldn’t leave, the officers approached the woman and attempted to lift her from the chair in which she was sitting. In the course of a struggle, the woman lost her balance, falling face first onto the floor and suffering a broken nose in the process. SIU Director Joseph Martino determined there were no reasonable grounds to conclude that any officer comported themselves other than lawfully in their dealings with the woman. As there was no basis for proceeding with criminal charges, the file has been closed.24 February, 2023

In the early morning hours of October 29, 2022, Niagara Regional Police Service officers became aware of a fight in the area of St. Paul and James Streets, in St. Catharines. Officers located one of the individuals, and a foot pursuit ensued. An officer caught up to the 24-year-old man and took him to the ground. There was a struggle, but the man was eventually subdued with the help of other officers that had arrived. The man was later transported to hospital where he was diagnosed with a fractured right clavicle. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injury. There was no basis for proceeding with criminal charges in this case, and the file has been closed.23 February, 2023

On October 25, 2022, Toronto Police Service officers were dispatched to a high-rise apartment building after an individual reported that a 31-year-old man was screaming and throwing things from a fifth-floor balcony. In the presence of police, the man climbed over the balcony railing, moved across the outside ledge of the balcony, attempted to climb down to a balcony below, and fell to the ground. He was transported to hospital where he was diagnosed with multiple fractures and a collapsed lung. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injuries. There was no basis for proceeding with criminal charges in this case, and the file has been closed.21 February, 2023

In the evening of October 24, 2022, the mother of a 23-year-old man called police to report that her son was on the roof of their home and threatening to end his life. Within moments, two Brantford Police Service officers arrived on scene without the use of their emergency equipment, appreciating that their presence might precipitate rash behaviour by the man. When the man saw the officers, he ran towards the corner of the roof and jumped, landing on the ground below. The officers applied first-aid pending the arrival of paramedics. At hospital, the man was treated for a brain injury and multiple fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that either officer committed a criminal offence in connection with the man’s injuries. There was no basis for proceeding with criminal charges in this case, and the file has been closed.21 February, 2023
SIU Concludes Investigation into London Collision
On the morning of October 24, 2022, a London Police Service officer did a licence plate check on a van and learned that the van had been reported stolen. The officer radioed to nearby police officers that the van was headed in their direction. Officers deployed spike belts on the road, and the van traveled over the belts and damaged one or both of the passenger side tires. The initial officer continued to follow the van, and a short time later, the van struck an SUV. The driver of the SUV – a 48-year-old man – was transported to hospital and diagnosed with fractured ribs and a punctured lung. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the collision and the man’s injuries. There was no basis for proceeding with criminal charges in this case, and the file has been closed.20 February, 2023

In the morning of October 4, 2022, Ontario Provincial Police officers attended a residence in L’Orignal as a result of a 42-year-old man expressing concern about the mental health of his partner. Satisfied there were no grounds for an apprehension under the Mental Health Act, the officers exited the home and explained the situation to the man. An altercation ensued, and the man was arrested. At hospital, he was diagnosed with a fractured left orbital bone, and a number of ‘subacute’ spine and rib fractures. While accepting that the man’s injuries were incurred in the course of the altercation with police that marked his arrest, SIU Director Joseph Martino determined there were no reasonable grounds to believe they were the result of unlawful conduct on the part of any officer. In the evening of September 25, 2022, the driver of a Ford Escape became involved in a collision with a Hyundai Sonata in a Hamilton intersection. As a result, the two backseat passengers in the Hyundai lost their lives and the drivers of both vehicles sustained serious injuries. As Hamilton Police Service officers had tried to stop the driver of the Escape moments prior, the SIU was notified of the matter and initiated an investigation. The man was apprehended and taken to hospital where it was discovered that one of the less-lethal projectiles has penetrated his abdomen.
