SIU Discontinues Investigation into Man’s Fall from Mississauga Motel Window

Case Number: 22-OCI-049

Mississauga, ON (20 June, 2022) ---
The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into the broken hip suffered by a 22-year-old man while attempting to flee from Peel Regional Police (PRP) officers in February.

In the early morning hours of February 17, 2022, PRP officers arrived at a third-floor unit of the Studio 6 motel on Brittania Road East in Mississauga. They were there following a report about a domestic disturbance. As the officers knocked on the door and announced their presence, the man attempted to scale down outside the building out a window. The man fell and landed in some bushes at ground level underneath the room, fracturing his hip.  He was discovered by officers after they had gained entry into the room and looked out the window.

Director Martino concluded it was apparent that the man was responsible for his injury, and that the officers did nothing to contribute to his misadventure in any fashion that could attract criminal sanction. Accordingly, the file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
