Peel Officer Comported Himself Lawfully in Arrest of Man; No Charges to Issue

Mississauga, ON (8 July, 2022) --- The Director of the Special Investigations Unit, Joseph Martino, has found no reasonable grounds to believe that a Peel Regional Police (PRP) officer committed a criminal offence in connection with the March arrest of a 26-year-old man in Brampton.

 On March 12, 2022, PRP officers were dispatched to Williams Parkway east of Dixie Road, after receiving reports of a violent assault in progress. An officer confronted the person of interest and ordered him to the ground. The man complied and lowered himself onto his knees. Officers arrested the man and placed him in the rear seat of a cruiser to be transported to the police station. While in the cruiser, the man banged his head on the Plexiglas partition. When the man complained of pain, he was transported to hospital and reportedly diagnosed with a fractured right hand and jaw. Other than the contact the officers had with the man to secure his arms in handcuffs, no force was brought to bear by the officers.

Director Martino concluded there were no reasonable grounds to believe that the officer comported himself other than lawfully in his dealings with the man. Accordingly, there was no basis for proceeding with criminal charges and the file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
