SIU Discontinues Investigation into Serious Injuries Reportedly Suffered by Man in Course of Arrest in Barrie

The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into a reported concussion and broken teeth suffered by a 19-year-old man in the course of his arrest by Barrie Police Service officers last August. The man filed a complaint with the Office of the Independent Police Review Director, which then advised the Barrie Police Service. Due to the nature of the incident, the police service notified the SIU of the incident on November 15, 2021.

On April 10, 2021, a 42-year-old male was struck by a sock round from a less-lethal shotgun fired by a Toronto Police Service (TPS) officer after he threatened members of his family with a knife. The arresting officer – the SO – was identified as a subject official for purposes of the SIU investigation. The SIU Director, Joseph Martino, has determined there are no reasonable grounds to believe that the SO committed a criminal offence in connection with the shooting.

SIU Investigating Firearm-related Death of Woman in Burks Falls

On Thursday August 5, 2021 at approximately 8:19 pm, members of the Ontario Provincial Police (OPP) responded to a Burks Falls residence for an unwanted person. Two officers arrived and were confronted by a female wielding a knife.  An interaction ensued and both officers discharged their pistols.  The female was struck and mortally wounded.  A third responding officer performed CPR, but the resuscitation attempts were unsuccessful.

On July 15, 2021, the Ontario Provincial Police (OPP) reported that a 33-year-old man in their custody had been diagnosed with a fractured right heel.  The SIU initiated an investigation. Based on the Special Investigations Unit’s (SIU) preliminary inquiries, which included an interview with the man and a review of a video recording of his time in police custody, Director Joseph Martino concluded that there is patently nothing to investigate as far as the potential criminal liability of any police officer is concerned in connection with the man’s injury.

On Wednesday July 28, 2021, officers from the London Police Service (LPS) responded to a domestic disturbance call at an apartment in London. Attending officers were met by the complainant who was armed with knives.  Two officers deployed their conducted energy weapon (CEW) and a third officer discharged his pistol. The complainant was struck with the projectiles.

On Tuesday July 27, members of the Brantford Police Service (BPS) were executing a search warrant at a house in Brantford. A male party ran from the residence and he was chased by officers, including a member of the Canine Unit. An interaction between the male and the officers took place and a conducted energy weapon (CEW) was discharged and an ‘Anti Riot Weapon ENfield’ ARWEN was also discharged. Both stuck the male.

On July 15, 2020, Leslie Hegedus passed away following an exchange of gunfire with two Ontario Provincial Police (OPP) officers in Dysart, Ontario. On November 12, 2020, following a brief police pursuit, a male driver was involved in a motor vehicle collision at the intersection of Highway 73 and Highway 52, Malahide. SIU Investigating Firearm Discharge in Chatham-Kent

On Wednesday July 7, 2021 at approximately 4:30am, the Chatham-Kent OPP responded to a call about a theft of gas from a local station.  A responding officer spotted the suspect vehicle. While police were following the vehicle, it lost control and rolled into the ditch.  An interaction took place with a male occupant and the officer discharged his pistol.  The male was transported to a hospital where he was pronounced deceased.

SIU Terminates Investigation of Woman’s Arrest in Orillia

On June 2, 2021, the Ontario Provincial Police (OPP) contacted the SIU to report that a 30-year-old woman they had taken into custody that date had sustained stab wounds in the course of her arrest.  Following an altercation with a couple of OPP police officers that marked her arrest for trespass to property, in which one-half of a pair of scissors was reportedly produced by the woman and responsible for her injuries and the officers, the woman was taken to hospital for treatment.

On February 27, 2021, a 62-year-old male succumbed to injuries incurred in a motor vehicle collision in the area of Northumberland Road and Roseneath Landing Road, Ontario.  As the vehicle in which he was traveling had almost struck an Ontario Provincial Police (OPP) cruiser just before the collision, the SIU was notified and opened a file. The driver of the OPP vehicle was identified as the subject official for purposes of the SIU investigation.  The investigation has now been concluded.

SIU Concludes Investigation in Fatal Police-involved Shooting in Toronto

On February 23, 2021, members of the Emergency Task Force (ETF) attended at an apartment building in Toronto.  They were deployed to make entry into two apartments ahead of the execution of search warrants by investigators in relation to a homicide investigation.  As the officers broke open the door of one apartment, they were confronted by a 46-year-old man – Gedi Ali Gedi – rushing at them with a knife and cleaver in his possession.  Two of the ETF officers – identified as subject officials in the investigation – discharged their firearms at Mr. Gedi, striking him once.  Mr. Gedi was taken to hospital and succumbed to his injuries.

The Director of the SIU, Joseph Martino, has concluded that the officers were in the lawful execution of their duties and that their resort to gunfire was legally justified in the circumstances.

On August 17, 2020, a 24-year-old male was diagnosed in hospital with a fractured right hand.  He was in the custody of the York Regional Police Service (YRPS) at the time, having earlier been arrested by a YRPS officer.  The arresting officer was identified as the subject official for purposes of the SIU investigation. 

The Director of the Special Investigations Unit, Joseph Martino, has determined that there is no basis for proceeding with criminal charges in this case and the file is closed.

SIU Investigating Sexual Assault Allegation

The Special Investigations Unit (SIU) is investigating a sexual assault that is alleged to have been committed by two Toronto Police Officers against a woman in the course of her arrest.  The arrest reportedly took place in the evening of July 22, 2019 in the parking lot of a Wild Wing restaurant in the area of Kingston Road and Brooklawn Avenue, Scarborough.

SIU Finds No Basis to Proceed with Criminal Charges in Relation to Man’s Arrest in Windsor

On February 22, 2021, a 26-year-old male was seriously injured in the course of his arrest by the Windsor Police Service (WPS) officers, the result of a bite by a police dog. The dog’s handler was identified as the subject official for purposes of the SIU investigation.

The case has been concluded with a finding by the SIU Director, Joseph Martino, that there were no reasonable grounds in the evidence to cause charges to be laid against the subject official.

Durham Regional Police Service Officer Charged with Careless Use of a Firearm

On April 16, 2021, Durham Regional Police Service (DRPS) officers responded to a call regarding a theft that had reportedly occurred at an LCBO in Oshawa. 

The responding officers located the suspects’ vehicle in a plaza parking lot. As the police officers approached the vehicle, the driver drove forward and proceeded east along a walkway. One of the officers discharged his firearm multiple times. 

As a result of the SIU investigation, Cst Kevin Wintle has been charged with careless use of a firearm contrary to section 86 (1) of the Criminal Code.

Cst Wintle is required to appear before the Ontario Court of Justice in Oshawa on July 8, 2021.

The matter is now properly before the courts. In consideration of the fair trial interests of the accused, the SIU will make no further comment pertaining to this investigation.

No Charges Warranted in Relation to Woman’s Arrest in Toronto

On February 11, 2021, the Toronto Police Service (TPS) responded to a possible impaired driver in the area of Charles Street. A 43-year-old woman had been living in her vehicle for several days. While stopped in the intersection of Charles Street East and Church Street, the woman noticed a TPS police cruiser approaching her vehicle.  She panicked at the sight of the officers and fled the area. TPS officers eventually arrested the woman and was taken to the police station. She complained of pain and was taken to hospital where she was diagnosed with serious injury.

No Charges to Issue in Relation to Arrest of a Man in Stratford

On November 19, 2020, at around 6:00 a.m., two Ontario Provincial Police (OPP) officers in Stratford responded to a call for a 41-year-old male who was found to be "passed out" in the driver's seat. When the police officers approached the vehicle, the man drove off and into a corn field where he remained for some time.  Additional police officers arrived and set up containment around the field.  The man eventually drove out of the field and struck several police cruisers that were unattended on the road.  A spike belt was deployed, and the man drove over it.  As a result, the man’s vehicle eventually became disabled a short distance away. After the arrest, the man was transported to hospital and subsequently diagnosed with serious injuries.

The Director of the Special Investigations Unit, Joseph Martino, has determined that the officers comported themselves with due care and regard for public safety in their participation in the events resulting in the man’s arrest, there is no basis for proceeding with criminal charges in this case. The file is closed.

No Basis to Lay Charges Against Officers Involved in Fatal Shooting of Man in Mount Albert

On February 6, 2021, York Regional Police (YRP) began to receive 911 calls about a stabbing incident at Ridge Gate Crescent in Mount Albert. Soon after entering the residence, the officers located a 37-year-old man armed with a knife and holding a child suffering from a knife wound. In the presence of police, the man stabbed another child. Two officers discharged their firearms and the man was fatally struck. At the home, officers located the man’s wife who had earlier been lethally wounded by the man, and another woman who had been injured. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either officer committed a criminal offence in connection with the man’s death.

On November 21, 2020, the Greater Sudbury Police Service (GSPS) officer responded to a housing complex in Chelmsford for a report of a domestic dispute.  The officers tried to arrest a 38-year-old male for public intoxication. The man resisted arrest and was taken to the ground.  He was later transported to hospital and diagnosed with a non-displaced fracture to his nose. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer acted other than lawfully in his interaction with the male, there is no basis for proceeding with criminal charges against the officer and the file is closed.

On February 4, 2021, the Peel Regional Police Service (PRP) responded to a report of a woman in distress. A PRP officer deployed a Controlled Energy Weapon (CEW) and Anti Riot Weapon ENfield (ARWEN), disarmed the woman, and took her into custody.  Following her arrest, the woman was taken to hospital where she was admitted for psychiatric examination.
The Director of the Special Investigations Unit, Joseph Martino, said, “as I am satisfied that the officer used no more force than was reasonably necessary to safely take the woman into lawful custody, there is no basis for proceeding with charges in this case and the file is closed.”

On February 3, 2021, Toronto Police Service officers responded to a condo on Adelaide Street for a report of a person damaging vehicles in the underground garage. After a search, officers located the 18-year-old man at a Green P parking on Richmond Street East. When the man proceeded to pull a knife on the officers, two officers discharged their Conducted Energy Weapons (CEWs) at the man. Unaffected by the discharge, the man continued to make his way westbound on Richmond Street East. A third officer subsequently fired beanbag rounds from her less-lethal shotgun, striking the man. The man continued to walk away, but collapsed to the ground minutes later. He was arrested and taken to hospital for treatment of a fracture of the right forearm/wrist. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer who discharged the less-lethal shotgun committed a criminal offence in connection with the man’s injury.

Woman Jumped from Bridge in Odessa; No Basis to Lay Charges Against Officers who Tried to Save Her

On February 20, 2021, an 18-year-old woman jumped from a bridge in Odessa, suffering very serious injuries in the process. As two Ontario Provincial Police officers had interacted with her prior to the fall, the SIU was notified and opened a file. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either officer committed a criminal offence in connection with the woman’s injuries.

On November 2, 2020, a 45-year-old man died when he jumped from the Dundas Street bridge over the Don River and Don Valley Parkway. As Toronto Police Service officers were on the bridge and had engaged with the man in the hours prior to his death, the SIU was notified and opened a file. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s death.

On February 1, 2021, a 24-year-old woman fell to her death from the rooftop of a municipal parking garage in Oshawa. In the early morning hours of November 22, 2020, a 24-year-old man was arrested in Brampton by Peel Regional Police officers for failing to provide a breath sample, and released at the scene. Officers who Attempted to Box-in Vehicle did Not Commit Criminal Offence; SIU Closes File into Toronto Investigation

On October 24, 2020, a 55-year-old man suffered a serious injury when the vehicle he was operating was struck by a Honda Pilot. In the moments prior to the collision, Toronto Police Service officers had attempted to box-in the Honda and had pursued it, thus invoking the SIU’s mandate. The principal officers in the attempted box-in of the Honda were identified as subject officers for purposes of the SIU investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either subject officer committed a criminal offence in connection with the man’s injury.

No Charges to Issue Against Officer Who Struck Man with Cruiser in Brampton

In the evening of February 3, 2021, two vehicles became involved in a collision in the area of Chinguacousy Road and Williams Parkway. Both drivers exited their vehicles to check on each other’s wellbeing. At about the same time, a Peel Regional Police officer was traveling north on Chinguacousy Road south of the collision site. He noticed debris on the road in the area of the stopped vehicles and was taking note to avoid objects on the road when his cruiser struck one of the drivers from the earlier collision. The 39-year-old man was taken to hospital and diagnosed with multiple fractures. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injuries.

On January 21, 2021, Ottawa Police Service officers attended an apartment to arrest a 56-year-old man in relation to a domestic disturbance involving his former girlfriend. Officers were let into the residence, and they permitted the man to go into a bedroom to get changed and to call his lawyer. When the man did not come out after a period of time, an officer attempted to open the door but the man closed it shut. The officer then rammed the door open with his body weight and the man was apprehended shortly after. At hospital, the man was diagnosed with fractured left-sided ribs. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and injuries.

On April 28, 2020, a Honda CRV was being pursued by Peel Regional Police (PRP) officers eastbound on North Park Drive in Brampton when it struck an Acura MDX traveling southbound on Torbram Road. The impact sent the Acura into the northbound lanes of Torbram Road, where it collided head-on with a Kia Forte, which in turn struck a Volkswagen Jetta. As a result of the collision, the 53-year-old male driver of the Kia suffered a fractured right knee. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer of the lead PRP vehicle in pursuit committed a criminal offence in connection with the pursuit and the man’s injury.

Man Died as a Result of Self-Inflicted Gunshot Wound; SIU Determines No Basis to Proceed with Charges in London Case

On February 22, 2021, a 24-year-old man sustained a self-inflicted gunshot wound while in Greenway Park in London. He was taken to hospital but passed away the following day. As London Police Service officers were on scene and had interacted with the man for a time before the shooting, the SIU was notified and commenced an investigation. The officer with overall command of the police operation at the park was identified as the subject official for purposes of the SIU investigation. On October 8, 2020, the manager of a restaurant in King City called 911 to report that a man was causing a disturbance. Upon arrival, York Regional Police officers encountered the 42-year-old man, and they directed him to leave the premises. When he would not leave, he was informed that he was under arrest for trespassing. A struggle ensued, and the man was eventually arrested. Several days after the arrest, the man went to health clinic and was later informed he had sustained a fractured sternum. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either of the arresting officers committed a criminal offence in connection with the man’s arrest and injury.

In the early morning hours of November 1, 2020, a 26-year-old man was at the OPP detachment in Rockland, having been arrested for drunk driving. After the release papers were signed, and while in the parking lot, the man became belligerent, and when he threatened to kill the officers, he was told he was under arrest. An officer forced the man to the ground face first, and a physical altercation ensued in the course of which the man was punched multiple time to the face by the officers. He was ultimately handcuffed and transported to hospital where his fractured nose was diagnosed. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injury.

No Charges to Issue in Relation to Downtown Toronto Arrest of Man

On the evening of April 12, 2020, Toronto Police Service officers were dispatched to the area of King and Bathurst Streets in Toronto after 911 calls from citizens reported a robbery in progress. A man had attacked and was attempting to steal a bike from a person while brandishing a knife. Officers located the 28-year-old man and attempted to communicate with him. The man continued to walk as officers followed. On repeated occasions, conducted energy weapons were discharged at the man with the intention of incapacitating him sufficiently to allow for officers to move in safely and disarm him, but this was to no avail. Police vehicles were also used in an attempt to stop the man. When the man reached Front Street, an officer drove up behind the man and used the driver’s side front corner of the cruiser to strike him. The man fell and was arrested. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and subsequent admission to hospital.

On January 8, 2021, following a standoff at his home in Saul Ste. Marie with Ontario Provincial Police officers, a 60-year-old man was taken into custody. Though the man did not suffer any serious injuries in the course of the arrest, he was struck by several ARWEN rounds. Accordingly, the SIU opened a file on the basis of its relatively new mandate under the Special Investigations Unit Act, 2019 to investigate firearm discharges at persons. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

From the evening of December 12, 2020 into the morning of December 13, 2020, a 42-year-old man was involved in a lengthy standoff with Peel Regional Police officers in Brampton. On the night of October 17, 2020, an individual contacted 911 to report a suspected impaired driver in the area of Prince of Wales Drive and Barnsdale Road in Ottawa. When officers arrived at the scene and located the vehicle of interest, the 46-year-old driver exited the vehicle and fled on foot. Officers caught up with the man. After a struggle, he was apprehended. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and fractured ribs the man reportedly suffered.

On October 8, 2020, a 15-year-old male broke his nose in a motor vehicle collision. Because he was being pursued at the time by a Durham Regional Police Service officer, the SIU was notified by the police service and initiated an investigation. The driver of the cruiser who had pursued the teenager and the officer who had laid out a stop stick in and around the area of the collision were identified as subject officers for purposes of the SIU investigation. No Charges to Issue in Relation to Man’s Arrest in Moosonee

In the morning of September 2, 2020, Ontario Provincial Police attended a residence in Moosonee to arrest a 58-year-old man. While officers were at the door, the man locked himself in a bathroom armed with a box cutter-type knife.  The officers entered the home and began to speak with the man through the bathroom door, encouraging him to disarm himself and exit. There ensued a standoff over the next several hours, until officers were able to obtain a warrant allowing them to force the bathroom door open. As the officers entered, the man took the knife he was holding and cut himself several times. An officer discharged his conducted energy weapon at the man, and he was arrested. The man was transported to hospital for treatment. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injuries.

No Charges to Issue in Relation to Arrest of Man in Barrie

In the afternoon of January 1st, 2021, Barrie Police Service officers were dispatched to a residence to investigate a domestic incident that had been reported. Officers entered the home and located a 45-year-old man lying on a bed. On his hip was a leather sheath containing a knife with a long blade. When the man did not respond to the officers, the officers left the residence until further assistance arrived. Four officers then entered the home and an interaction ensued with the man, including the discharge of conducted energy weapons by three of the officers. The man dropped the knife and was apprehended after a period of struggle. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an arresting officer committed a criminal offence in connection with the man’s arrest and his injuries, namely a fractured nose and orbital bone.

No Criminal Wrongdoing Found in Connection with Woman’s Arrest in Hamilton

On September 12, 2020, a 70-year-old woman was arrested by Hamilton Police Service officers. As she had experienced pain in her left shoulder at the time and in the days after her arrest, the woman underwent an ultrasound examination on October 19, 2020. She was diagnosed with a partial tendon tear in the left shoulder. This information was reported to the police service, who then reported the matter to the SIU on November 10, 2020. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an arresting officer committed a criminal offence in connection with the woman’s arrest and injury.

On November 3, 2020, Ontario Provincial Police officers were dispatched to a home in Arva following a 911 call from the homeowner reporting suspicious activity on his property. Officers located a person of interest – a 31-year-old man – who then proceeded to run away. Officers gave chase on foot and arrested the man. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an arresting officer committed a criminal offence in connection with the man’s arrest and injuries.

No Charges to Issue in Relation to Fatal Collison in Toronto that Followed Brief Police Pursuit

On January 1, 2021, a Toronto Police Service officer briefly pursued a Mercedes Benz that had been traveling at a high rate of speed. Shortly after the officer terminated the pursuit, the Mercedes Benz became involved in a collision with other vehicles in the intersection of Keele Street and Sheppard Avenue West. The 23-year-old male driver of the Mercedes-Benz was taken to hospital, as was the 67-year-old female driver of another vehicle involved in the collision. The woman passed away on January 30, 2021 while still in hospital, the result of a traumatic brain injury incurred in the collision. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

On October 24, 2020, a 32-year-old man was seriously injured in the course of being arrested by Toronto Police Service officers. SIU Appealing for Witnesses to Discharge of Firearm by Police Officer at Vehicle in Oshawa

The province’s Special Investigations Unit is appealing for witnesses to a shooting that occurred earlier this month in Oshawa. While three civilian witnesses were located and interviewed, video evidence obtained has led investigators to believe that there were other individuals in the parking lot who witnessed the shooting. The SIU is urging these individuals – and anyone else who may have information or video evidence – to contact the lead investigator at 1-800-787-8529.

On November 4, 2020, while in the care of the Thunder Bay Police Service, a 55-year-old man became acutely ill. He was transported to hospital by ambulance and passed away the following day. In the afternoon of October 12, 2020, Toronto Police Service officers attended an address where a 31-year-old man who was wanted on several arrest warrants was believed to be. Officers went to the third-floor and exited through a door onto a rooftop patio. Within seconds of police seeing the man hiding behind a patio railing, the man jumped from the roof to the ground below, fracturing his back in several places. Notwithstanding his injuries, the man took flight from the police on foot.  He was arrested a short time later. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injuries.

On January 2, 2021, a 25-year-old man died in Ottawa. As Ottawa Police Service officers had interacted with the man moments before his death, the SIU was notified by the police service and commenced an investigation. On January 1, 2021, a 44-year-old man’s nose was broken in the course of his arrest by two Guelph Police Service officers.  The arresting officer identified as likeliest to have inflicted the injury was designated a subject official for purposes of the SIU investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and injury.

On January 9, 2021, a 58-year-old man was arrested in Trenton by Ontario Provincial Police officers and subsequently diagnosed at hospital with serious injuries. Following a lengthy standoff with the Kingston Police Emergency Response Unit, a 33-year-old man was arrested on September 23, 2020. The man was taken from the scene to hospital in ambulance. He was diagnosed with four fractured right-sided ribs, a fracture to the left foot, a partial right-sided pneumothorax, and numerous bruises. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any of the involved officers committed a criminal offence in connection with the man’s arrest and injuries.

In the evening of August 6, 2019, Chatham-Kent Police Service officers were dispatched to a residence in Chatham to assist paramedics transport a 35-year-old man to hospital. Once at the hospital, the officers assisted in keeping the man on the stretcher as a nurse attempted to place soft-restraints on his ankles. Within several of minutes of being in the trauma room, man lost vital signs. The medical attempted CPR and other life-saving measures. The man could not be resuscitated and was declared deceased. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s death.

Man Fractured Heel while Attempting to Flee Police; No Criminal Charges to Issue Against Officer in Trenton Case

On the night of November 28, 2020, Ontario Provincial Police officers were dispatched to a residence in Trenton after a report was received of a domestic dispute. At the sound of police sirens, a 22-year-old man attempted to escape the residence via the back doorway, but in the process he was seriously injured. Officers located the man hiding behind garbage in the backyard of the residence and he was arrested without incident. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and fractured right heel.

Thunder Bay Arrest of Man who Assaulted Officer Deemed to be Lawful; No Criminal Charges Warranted

On the night of October 28, 2020, two Thunder Bay Police Service officers were dispatched to a tavern to investigate a disturbance. The officers walked in on a brawl, ordered the combatants to stand down and then physically intervened to pull them apart. Both officers were then confronted and attacked by an unruly crowd of patrons. Following the assault, a 27-year-old man was arrested and subsequently taken to hospital where he was diagnosed with lacerations of his left leg and right buttock. The Director of the Special Investigations Unit, Joseph Martino, has determined the officers did not cause the man’s injuries, and that their conduct was lawful throughout their interaction with him.

No Charges to Issue in Relation to Arrest of Man in Ottawa

On October 8, 2020, a 25-year-old man was arrested by Ottawa Police Service (OPS) officers outside an apartment building, taken to hospital and reportedly diagnosed with a serious injury. In and around the same time, OPS officers were seeking to enter an apartment at the same address to apprehend a woman under the Mental Health Act.  As there was some suggestion that the two incidents were related – the man was found limping on the ground below the woman’s apartment – the SIU was notified and commenced an investigation. On October 5, 2020, a 30-year-old man was an occupant of a vehicle that had been involved in a collision. Realizing that police would soon be at the scene, and aware of outstanding warrants for his arrest, the man fled into a wooded area. Officers soon located the man and arrested him. He was later diagnosed with a fractured left foot. While it remains unclear whether the injury was aggravated by police in the course of his arrest, the Director of the Special Investigations Unit, Joseph Martino, is unable to reasonably conclude that any of the arresting officers acted other than lawfully in their dealings with the man.

On the morning of November 13, 2020, multiple 911 calls were made by residents of an apartment building in York expressing concern about the behavior of a 29-year-old man staying with a friend. Officers located the man in a hallway and shortly after noticed he was in medical distress. Firefighters who were also present initiated CPR until paramedics arrived and took over care of the man. He was transported to hospital and subsequently declared deceased. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any of the officers committed a criminal offence in connection with the man’s death.

On December 16, 2020, a 33-year-old man reportedly suffered serious head trauma and internal bleeding when the vehicle he was operating smashed into a concrete sound barrier wall on a road in Brampton. As he was being pursued by Peel Regional Police officers at the time, the SIU was notified and commenced an investigation. On December 11, 2020, an employee of the Willowdale Welcome Centre contacted police out of concern for a 33-year-old man who was in mental distress, and concern for the safety of other residents and staff.  Officers attempted to establish a line of communication with the man and encouraged him to put away a knife he was in possession of. However, the man refused all the officers’ overtures and yelled that he wanted to die and wanted police to shoot him. A short time later, an officer fired his bean bag gun at the man two times. The man was eventually arrested. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

No Charges to Issue in Relation to Injury Sustained by Man During Altercation with Police at Toronto Hospital

On December 11, 2020, Toronto Police Service officers were dispatched to an address in Toronto for a man who called 911 to report that he was despondent and suicidal. Concerned for his safety, the officers apprehended the 35-year-old man under the Mental Health Act so that he could be detained and taken to hospital for psychiatric assessment. When the man attempted to leave the hospital, the officers took hold of him and an altercation ensued. He was eventually subdued, restrained and administered a sedative by a nurse. The man was later diagnosed with a fracture to his right leg. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.

On October 5, 2020, Peterborough Police Service officers were dispatched to the area of the Go Bus terminal on Simcoe Street. The police had received a call about a woman lying on a ramp to an underground parking. Upon their arrival, the officers located the 24-year-old woman and it soon became apparent that she was of unsound mind. When their repeated efforts to have the 24-year-old woman vacate the area went unheeded, the officers decided to apprehend her under the Mental Health Act. The woman resisted, but eventually the woman was apprehended. Paramedics arrived at the scene and transported the woman to hospital, where she was diagnosed with a broken right arm. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the woman’s arrest and injury.

No Basis to Proceed with Charges in Relation to Teenager’s Arrest in Thunder Bay

On the night of January 23, 2021, two Thunder Bay Police Service officers arrived at an address Academy Drive following 911 calls from tenants of the building that someone was kicking at the front entrance door attempting to get in. The officers confronted a 16-year-old male by the entrance and noticed that the front door glass was broken. Soon after the youth admitted to causing the damage, he fled and an officer gave chase. When the officer grabbed onto the youth, both slipped and fell. The youth was subsequently taken to hospital where he was diagnosed with a serious injury. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the youth’s arrest and injury.

On June 25, 2019, a woman was arrested by Greater Sudbury Police Service officers and grounded in the process. Four days later, on June 29th, the woman gave birth to her baby. Because of the newborn’s premature birth, the baby passed away about an hour after he was born. The SIU commenced an investigation based on a possible nexus between the force used against the mother during her arrest and the death of her child. SIU Finds No Basis to Proceed with Criminal Charges in Relation to Shooting Death of Ejaz Choudry

On June 20, 2020, Peel Regional Police (PRP) officers attended an apartment building in Malton to assist paramedics with 62-year-old Ejaz Choudry, who was in mental distress. Mr. Choudry armed himself with a large kitchen knife and locked himself inside his apartment. Officers attempted to negotiate with Mr. Choudry, but Mr. Choudry eventually stopped responding. Concerned that Mr. Choudry required immediate medical assistance, three members of the PRP’s Tactical Response Unit forcibly breached Mr. Choudry’s apartment through the door of his second-floor balcony. Thereafter, the uncontradicted evidence establishes that Mr. Choudry moved towards the officers while holding a large kitchen knife. After attempts to stop Mr. Choudry with a CEW and a firearm that fired rubber bullets were unsuccessful, an officer fatally shot Mr. Choudry. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis to proceed with criminal charges in this case notwithstanding Mr. Choudry’s tragic death.

No Charges to Issue in Relation to Trenton Collision Following Man’s Flight from Spot Check Moments Earlier

On December 4, 2020, a 35-year-old man rolled his SUV, suffering serious injuries in the process. As his vehicle had turned away from an Ontario Provincial Police RIDE spot check moments earlier, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer involved with the spot check committed a criminal offence in connection with the man’s injuries.

No Charges to Issue in Relation to Man’s Arrest in Kitchener

On December 3, 2020, a 46-year-old man was arrested by Waterloo Regional Police Service officers and subsequently diagnosed with a facial injury. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe either of the arresting officers committed a criminal offence in connection with the man’s injury.

No Basis to Proceed with Charges Against Toronto Officer who Shot Man Armed with Hatchet

In the afternoon of December 3, 2020, multiple 911 calls began to be received by the Toronto Police Service reporting a man’s strange and threatening behavior. Officers were dispatched the area of Lake Shore Boulevard West and Twenty Fourth Street. An officer observed a man walking toward him with a hatchet. The officer yelled at the man to drop the hatchet, and the man did so. However, the man retrieved the hatchet and advanced toward the officer. When the man refused to drop the hatchet, the officer fired his rifle at the man. The 30-year-old man was struck and transported to hospital for treatment. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

No Criminal Wrongdoing Found in Relation to Sault Ste. Marie Arrest

On December 3, 2020, a 38-year-old man was arrested by Sault Ste. Marie Police Service officers and subsequently diagnosed with serious injuries at hospital.  Because there was some prospect that the Complainant’s injuries were incurred in the course of his arrest, the SIU was notified of the incident and opened a file. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe an arresting officer committed a criminal offence in connection with the man’s arrest and injuries.

In the evening of October 13, 2020, a 30-year-old man fell from the Highway 8 bridge over the Grand River in Kitchener, injuring himself in the process. As he had been interacting with an Ontario Provincial Police officer at the time, the SIU was notified and opened a file. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s fall.

On October 3, 2020, a 28-year-old man suffered a fractured left clavicle when he fell from his motorcycle in Clarence-Rockland. On October 1, 2020, a 56-year-old woman and a 27-year-old man were injured in a motor vehicle collision in Sarnia. As their vehicle was being pursued by two Sarnia Police Service cruisers at the time, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer who was operating the lead cruiser in the pursuit committed a criminal offence in connection with the collision.

Man Received Adequate Care while Lodged in Sault Ste. Marie Police Service Cell; No Charges to Issue in Relation to Hospitalization Following Drug Overdose

On December 14, 2020, a 32-year-old man fell into medical distress while in a Sault Ste. Marie Police Service cell. He was taken to hospital and spent time in the ICU, reportedly the result of a drug overdose. The officer with overall responsibility for the care and well-being of prisoners at the time was identified as the subject official for purposes of the SIU investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s time in custody.

SIU Finds Windsor Officer did not Commit a Criminal Offence in Relation to Man’s Arrest and Injury

On December 2, 2020, a 39-year-old man was involved in an aborted police pursuit and two motor vehicle collisions in Windsor. The man was arrested and subsequently placed in a prisoner transport vehicle to be taken to the detention unit. While en route, the man lost consciousness and fell from the bench. The officer stopped, checked on the man, and the decision was made to take the man to hospital. At hospital, the man was diagnosed with a compression fraction of the spine.  The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injury.

On October 14, 2020, a 59-year-old woman suffered serious injuries in a motor vehicle collision. Because the vehicle that smashed into her car had been pursued by a Strathroy-Caradoc Police Service cruiser moments before the collision, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer driving the cruiser committed a criminal offence in connection with the collision and the woman’s injuries.

On November 20, 2019, a 30-year-old man went into acute medical distress shortly after being arrested by Peel Regional Police officers in the backyard of a Mississauga home. Paramedics arrived and made attempts to revive the man, but this was to no avail. The man was pronounced deceased at hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s death.

No Grounds to Lay Charges in Relation to Manitoulin Island Shootout that Claimed the Lives of a Civilian and an OPP Officer

On November 19, 2020, 60-year-old Gary Brohman died in an exchange of gunfire with Constable Marc Hovingh of the Ontario Provincial Police. The shootout cost the officer his life as well. Notwithstanding the fact that Cst Hovingh had succumbed to his wounds, the SIU commenced an investigation as the incident included a death at the hands of a police officer. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that Cst Hovingh committed a criminal offence in connection with Mr. Brohman’s death.

On September 1, 2020, a 55-year-old man was found hanging in the garage of his home in Elgin County. As Ontario Provincial Police officers had attended at his residence in the days prior to his death and were the ones to locate him in the garage, the SIU was notified of the matter and opened a file. The injury came to the attention of the police on October 16, 2020, who, in turn, notified the SIU. An investigation was commenced.

Woman Injured as a Result of Falling from Bike While Fleeing from Police; No Basis to Proceed with Charges in Relation to Cambridge Case

On October 11, 2020, a 22-year-old woman fractured her right wrist while on the run from police. Her injury occurred as she fell from her bike in the area of a footbridge that spanned the Grand River in Cambridge. In August of 2020, the woman filed a complaint with the Office of the Independent Police Review Director asserting that the police officers had broken her left wrist in the course of her arrest. This matter came to the SIU’s attention on September 28, 2020, and an investigation was commenced. On August 1, 2020, Ontario Provincial Police officers were dispatched to the South Muskoka Memorial Hospital after an employee reported that an inebriated man who had just left the emergency department had damaged property in the parking lot. Officers located a 30-year-old person of interest and he was taken into police custody. He was subsequently diagnosed with fractures of the right orbit and nasal bone. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injuries.

No Charges to Issue in Relation to Man’s Death in Fort Erie

On January 13, 2021, paramedics were dispatched to a residence in Fort Erie as a 61-year-old man who resided in the home was experiencing pain and lightheadedness. The man was placed in the ambulance, but due to his extreme agitation, the ambulance pulled over to request the assistance of police. Upon arrival, a Niagara Regional Police Service officer decided to apprehend the man under the Mental Health Act. He and the another officer affixed handcuffs to both of the man’s arms, securing them to the stretcher. En route to the hospital, the man’s condition deteriorated. Once they reached the hospital, the man was quickly placed in the care of the hospital’s emergency department. He passed away in hospital later that day. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s death.

On September 13, 2020, a 21-year-old man and a 31-year-old woman were seriously injured in Milton when their vehicles collided.  Moments prior to the collision, a Halton Regional Police Service officer had briefly pursued the vehicle being driven by the 21-year-old man. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

No Charges to Issue in Relation to Toronto Collision Between Cruiser and Civilian Vehicle

In the morning of April 13, 2020, police officers with the Toronto Police Service were dispatched to the area of the Downsview Park subway station for a report of a person with a knife. Proceeding west on Sheppard Avenue West, one of the responding cruisers came to a stop at the red light at the Allen Road intersection and briefly waited before making his way into the intersection on the red light. In the intersection, the cruiser became involved in a collision with a civilian vehicle being operated by a 63-year-old man. Both drivers were transported to hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

No Charges to Issue in Relation to North York Collision that Resulted in Injuries to Vehicle Occupant and to Pedestrian

On August 20, 2020, Toronto Police Service officers were conducting speed enforcement when a Porsche Cayenne was measured traveling at a high rate of speed. An officer signaled the driver to pull over, but instead the driver accelerated past the officer. A pursuit was commenced. In the intersection of Keele Street and Sheppard Avenue, the Porsche collided with a cube truck, resulting in the cube truck hitting another vehicle. A 21-year-old man from this vehicle was taken to hospital for treatment of a serious injury. After hitting the cube truck, the Porsche climbed a sidewalk and struck a bench in the area of a bus stop shelter. A 23-year-old woman waiting for the bus was struck. She suffered serious injuries as a result. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the collision.

No Criminal Wrongdoing Found in Relation to Arrest of Man in Brampton

Around noon on October 13, 2020, 911 calls began to be received by the Peel Regional Police about a man operating a vehicle erratically in Brampton, and that he appeared to be in medical distress. When the vehicle came to a stop, motorists, including an off-duty Toronto Police Service officer, attempted to remove the 31-year-old male driver but he resisted. A Peel Regional Police officer then arrived at the scene and assisted in pulling the man from the vehicle through the passenger door. The man continued to resist, but officers were eventually able to control the man until paramedics arrived. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the fractured rib with which the man was diagnosed.

No Charges to Issue in Relation to Man’s Fatal Fall from Highway 401 Overpass in Brockville

On July 25, 2020, Brockville Police Service officers started looking for 56-year-old Alberto Ayala-Guerrero, a man wanted in the United States in relation to the murder of a woman, and now believed to be in the area. Soon after officers located him on the Highway 401 overpass at North Augusta Road, Mr. Ayala-Guerrero scaled the railing. Despite an officer yelling at him not to jump and attempting to grab hold of him, Mr. Ayala-Guerrero jumped onto the highway below. He was transported to hospital where he passed away. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with Mr. Ayala-Guerrero’s death.

On November 26, 2019, a 16-year-old male was shot by a police officer in the course of his arrest inside a Mississauga bank, and suffered significant internal injuries in the process. The officer who discharged his firearm had made his way to the bank following reports of an armed robbery occurring inside. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

On November 17, 2020, a pickup truck collided with a police cruiser in Haldimand County, resulting in serious injuries to both the police officer and the 30-year-old driver of the truck. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

No Charges to Issue in Relation to Burn-Related Injuries Sustained by Man in Kincardine

On June 16, 2020, a call came into the Ontario Provincial Police regarding a 36-year-old man who was threatening suicide. The man was located in a remoted wooded area on a maintenance road in Kincardine. The first officer to arrive attempted to engage the man in conversation. About 30 minutes later, the man entered his van, closed the door and proceeded to ignite the gasoline in the vehicle. Firefighters, who had been stationed nearby, were able to extinguish the flames with the help of officers. The man was removed from the van and taken to hospital for treatment. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injuries.

SIU Lays Charge Against London Police Officer in Relation to Death of Woman

The Director of the Special Investigations Unit (SIU), Joseph Martino, has reasonable grounds to believe that a London Police Service (LPS) officer committed a criminal offence in relation to the death of 28-year-old Amanda Bolt in November of 2019 in London. As a result, Director Martino has caused a charge to be laid against the officer.

On July 18, 2020, a 42-year-old man was seriously injured when he fell from the Market Street Bridge in Brantford. As he was being chased by a Brantford Police Service officer at the time, who had actually managed to grab hold of the man just before he fell, the SIU was notified and commenced an investigation. On June 30, 2020, a 44-year-old woman riding her bicycle became involved in a collision with a Halton Regional Police Service vehicle in the intersection of Main Street East and Thompson Road in Milton. The woman was sent tumbling onto the ground off her bike. The officer rendered first aid to the woman until EMS arrived and transported her to hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

On December 6, 2020, Barrie Police Service officers attended a hotel after a woman reported she had been assaulted by a man in a room. Officers arrested a 35-year-old man and transported him to the police station. As the man was being booked, he went into acute medical distress and officers administered first aid. Paramedics arrived, took over care of the man and transported him to hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the arresting officer committed a criminal offence in connection with the man’s medical condition.

In the afternoon of August 25, 2020, the body of a 71-year-old man was recovered from the Ottawa River in the area of Moulin Park, Clarence-Rockland.  As he had entered the water from a dock in the park on August 22, 2020 just after he was approached by an Ontario Provincial Police officer, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s death.

Update: Man who Sustained Gunshot Wound in London Succumbs to Injury

On February 22, 2021, the SIU commenced an investigation in London. At approximately 10:30 a.m. that day, London Police Service officers attended Greenway Park to locate a 24-year-old man who was reported to be in distress. Soon after arriving, officers located the man who was in possession of a firearm. Police made attempts to negotiate with him. Shortly after, he sustained a gunshot wound and was taken to hospital for treatment. On February 23, 2021, while in hospital, the man succumbed to his injury and was pronounced deceased.

On July 4, 2020, a 34-year-old man was diagnosed with a fractured left orbital bone and broken nose following his arrest and while in the custody of the Waterloo Regional Police Service. On October 26, 2020, the Ontario Provincial Police received a 911 call about a 40-year-old man in distress armed with a firearm and threatening suicide. Officers attended the man’s property in Petrolia, and eventually located him inside a barn. He had suffered a penetrating gunshot wound of the head. The man was transported to hospital, but succumbed to his injuries on November 1, 2020. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s gunshot wound and subsequent death.

Officer Justified in Shooting Man Who had Assaulted Others; No Criminal Wrongdoing Found in Relation to Mississauga Case

In the morning of May 2, 2020, Peel Regional Police officers responded to an address in Mississauga following reports of a homicide in the area. Officers located the 29-year-old person of interest in a shed in the backyard of a home. Shortly after the man emerged from the shed holding a knife covered in blood, an officer discharged her firearm three times. The man was struck. He, along with others who had been assaulted by the man, were transported to hospital. The Director of the Special Investigations Unit, Joseph Martino, has determined there are 
no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

No Criminal Wrongdoing Found in Relation to Peterborough County Arrest

On May 26, 2020, Ontario Provincial Police officers initiated a traffic stop of a vehicle in Peterborough County for the purpose of arresting one of the vehicle occupants – a 39-year-old man – in relation to a theft investigation. In the course of the arrest, a struggle ensued. The man was eventually subdued and taken to hospital where he was diagnosed with a serious injury. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injuries.

On March 21, 2020, a 39-year-old man passed away following the attendance of paramedics, firefighters and police officers at his Toronto home in response to a medical call for service. On March 14, 2020, a collision occurred in the intersection of Tecumseh Road East and Rose-Ville Garden Drive in Windsor between a civilian vehicle and a police cruiser. As a result of the collision, the 78-year-old male driver of the civilian vehicle was transported to hospital where he was diagnosed with three fractured left-sided ribs. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision and the man’s injuries.

On June 21, 2020, a 55-year-old man was injured in a motorcycle crash at an intersection in Brampton. Having admitted that he ingested a quantity of drugs, first aid was provided, and the man was rushed to hospital where he was treated for a massive cocaine overdose. On July 24, 2020, while riding his bicycle in King City, 54-year-old Daniel Bertini was mortally injured when he was struck by a vehicle.  As the vehicle had been briefly pursued by a York Regional Police officer just prior to the collision, the SIU was notified and commenced an investigation. Man Died as a Result of Smoke Inhalation in Apartment Unit Fire in Toronto; No Charges to Issue Against Police

In the evening of April 17, 2020, Toronto Police Service officers attended a 12th floor apartment unit where they made attempts to speak with a 32-year-old man who had had barricaded himself inside, and was in distress. After some time, smoke began to seep through the door of the unit and officers realized that a fire had been set. Despite efforts to rescue the man from the unit which had become engulfed in flames, the man died as a result of smoke inhalation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that a criminal offence was committed in connection with the man’s death.

On August 16, 2020, Waterloo Regional Police Service officers arrested a 43-year-old man in Cambridge. As officers were escorting the man, he lunged forward in an attempt to break free. On June 2, 2020, Waterloo Regional Police Service officers transported an inebriated 41-year-old woman from a store to her residence. While outside the residence, the woman walked off a landing and fell onto the lawn, fracturing her left foot in the process. Evidence Indicates Deaths of Father and Son in Kawartha Lakes a Result of Police Gunfire

Upon receipt and review of additional forensic evidence in this case, including the results of the postmortem examination performed on a child, and reports prepared by the Centre of Forensic Sciences of analyses conducted with respect to bloodstains in the pickup truck, the trajectory of shots that struck the truck, and firearms, cartridge cases and projectiles, the SIU can today confirm that the  child’s death on November 26, 2020 in Kawartha Lakes was the result of being shot by police.

At approximately 7 p.m. on July 19, 2020, a 48-year-old woman consumed illicit drugs while lodged in a cell at Kingston Police headquarters. She started to display symptoms of a drug overdose within the hour and was taken to hospital. After a period in the Intensive Care Unit, the woman recovered and was discharged from hospital nine days later. Because the woman was in police custody at the time of her drug ingestion, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer who was in charge of the care of prisoners committed a criminal offence in connection with the woman’s time in custody.

No Criminal Wrongdoing Found in Relation to Injuries Sustained by Motorcyclist in Toronto Collision

In the afternoon of July 24, 2020, a Toronto Police Service officer was performing speed enforcement when he clocked a Chevrolet Malibu exceeding the 50 km/h speed limit. The officer stepped onto the roadway and signaled at the driver to pull over and stop. The Malibu came to a stop, forcing the pickup truck behind to brake hard to prevent an impact with the rear of the Malibu. As the pickup truck driver did so, a motorcyclist behind the pickup truck attempted to maneuver around the rear driver’s side corner of the vehicle to avoid a collision. However, the motorcycle struck the rear of the truck sending him and his motorcycle into the passing lane where the vehicle was again struck by an eastbound Mazda. The 48-year-old male motorcyclist was taken to hospital where he was diagnosed with several facial fractures and fractures of the right leg. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injuries.

On May 10, 2020, a 60-year-old man died in his North Bay home as a result of a self-inflicted gunshot wound. On June 27, 2015, a 23-year-old man was arrested by two Stratford Police Service officers. The following day, the man’s doctor diagnosed him with a mild concussion. Update: Woman Involved in January 1st Multi-Vehicle Collision in Toronto Succumbs to Injuries

On January 1, 2021, a Mercedes-Benz SUV being investigated by police became involved in a collision with other vehicles in the intersection of Keele Street and Sheppard Avenue West. As a result of the collision, the 23-year-old male driver of the Mercedes-Benz was taken to hospital, as was the 67-year-old female driver of a Honda CRV. On January 30, 2021, the 67-year-old woman succumbed to her injuries in hospital.

On August 19, 2020, a Windsor Police Service officer was riding a bicycle when he collided with a motorcycle being operated by a 64-year-old man. Both individuals were ejected from their vehicles. The motorcyclist was transported to hospital and reportedly diagnosed with facial fractures and a brain bleed.  The officer suffered a compound fracture requiring surgery. While the officer appears largely to blame for the collision, the Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the collision.

No Charges to Issue in Relation to Shooting Death of Man in Temiskaming Shores

On the night of April 9, 2020, an individual called 911 from a residence in Temiskaming Shores, reporting a home invasion involving a man armed with a gun and a possible hostage situation. Upon entering the home, officers heard shouts coming from the second floor. One officer yelled upstairs for everyone to come down immediately. A 42-year-old man then emerged at the top of the stairs and began to make his way down the stairs with what appeared to be a handgun. Officers ordered the man to stop, and when the man continued to descend with his gun pointed at one of the officers, two officers discharged their firearms. The man was struck. He was transported to hospital where he was pronounced deceased. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either officer committed a criminal offence in connection with the man’s death.

SIU Finds No Grounds to Charge Police Service Dog Handler in Relation to Bite Injuries Sustained by Man During Arrest Odessa

On June 2, 2020, a 30-year-old man suffered serious injuries to his left leg when he was bitten by a police service dog in the course of his arrest in Odessa. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the dog’s handler committed a criminal offence in connection with the man’s arrest and injuries.

No Basis to Lay Charges in Relation to Woman’s Arrest in Midland

On September 25, 2020, a 32-year-old woman was arrested in Midland by an Ontario Provincial Police (OPP) officer and taken into custody.  The following evening, the woman contacted the OPP to report that her right arm had been fractured in the course of the arrest. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the arresting officer committed a criminal offence in connection with the woman’s arrest.

On May 6, 2020, a 17-year-old male was sent to hospital from the Ontario Provincial Police Leamington Detachment, where he was in custody, for treatment of an apparent drug overdose. The officer who had earlier arrested the teenager and lodged him in cells was identified as the subject officer for purposes of the SIU investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the male’s arrest and subsequent admission to hospital.

No Criminal Wrongdoing Found in Relation to Man’s Apprehension in Brampton

On July 1, 2020, Peel Regional Police officers were dispatched to an address in Brampton to check on the well-being of a 32-year-old man. When an officer decided to apprehend the man under the Mental Health Act, the man – who recognized that he was in mental distress and in need of his medication – peacefully surrendered. However, as the man was being escorted down the stairs, he began to resist his arrest. Officers took the man to the ground and attempted to hold him in place pending the arrival of an ambulance. Paramedics arrived, administered a sedative to the man and he was taken to hospital. There, he was diagnosed with a fractured ankle. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s injury.

No Charges to Issue in Relation to Man’s Death in Alfred

On February 11, 2020, a sheriff attended a home in Alfred to enforce an eviction notice. When the 50-year-old homeowner indicated he had no intention of leaving the home, the sheriff contacted the Ontario Provincial Police for assistance. When an officer spoke with the man, the man explained he had several firearms in the house. As a result, a decision was made to set up containment around the property. At about 12:30 p.m., the man was seen opening a front window and closing the blinds to the same window. Within minutes, flames were seen within the home and smoke was billowing from the window. The man was discovered deceased in the basement of the home. He had sustained a self-inflicted gunshot wound to the head. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s death.

No Charges to Issue in Relation to Man’s Jump from London Apartment Balcony

On September 24, 2020, a 21-year-old man contacted police as he wanted another man removed from his apartment. Two London Police Service officers attended the apartment and executed a peaceful arrest of the man for whom there was an arrest warrant. As officers were escorting the man from the apartment building, they learned that someone had jumped from an apartment balcony. One of the officers went to the scene of the fall in order to help the individual, who turned out to be the 21-year-old man who had earlier contacted police. The man was taken to hospital and diagnosed with pelvic fractures. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the any officer committed a criminal offence in connection with the man’s injuries.

In the early morning hours of June 13, 2020, a 29-year-old man dislocated his left hip and fractured his left femur in a motor vehicle collision. As the vehicle in which the man was traveling was being pursued by a Halton Regional Police Service officer at the time, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s injuries.

No Basis to Proceed with Charges in Relation to Bracebridge Arrest

On June 23, 2020, a 56-year-old man was arrested by Ontario Provincial Police officers in Bracebridge. Several weeks later, the man was diagnosed with multiple un-displaced or minimally displaced rib fractures. As the injuries were not new at the time they were diagnosed, there was evidence to suggest that they were the result of the force inflicted on the man in the course of his arrest weeks earlier. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that any police officer committed a criminal offence in connection with the man’s injuries.

No Criminal Wrongdoing Found in Relation to Marathon Collision Following Police Pursuit

On October 16, 2020, a 47-year-old man suffered a fractured left-sided rib in a motor vehicle collision north of Marathon. As the vehicle he was in had briefly been pursued by an Ontario Provincial Police officer moments before the collision, the SIU was notified and commenced an investigation. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that the OPP officer committed a criminal offence in connection with the collision.

No Reasonable Grounds to Criminally Charge a Peel Regional Police Officer in Connection with the Shooting Death of Jamal Francique

On January 7, 2020, Jamal Francique was shot by a Peel Regional Police (PRP) officer in the course of his arrest in Mississauga.  Mr. Francique was taken to hospital and remained alive on life support until he passed away on January 10, 2020.  The SIU was notified and commenced an investigation.  

Based on his review of the evidence, the Director of the Special Investigations Unit, Joseph Martino, has determined there are no grounds for proceeding with charges against the officer notwithstanding Mr. Francique’s death, and the file is closed.

SIU Lays Assault Charge Against Police Officer in Relation to Orillia Incident

The Director of the Special Investigations Unit (SIU), Joseph Martino, has reasonable grounds to believe an Ontario Provincial Police (OPP) officer committed a criminal offence in relation to an interaction with a 43-year-old woman in September of 2019. As a result, Director Martino has caused a charge to be laid against the officer. The matter was brought to the attention of the SIU by a civilian on April 15, 2020.

Update Regarding Kawartha Lakes Investigation

The SIU investigation into the circumstances of an incident that resulted in the deaths of a one-year-old boy and his 33-year-old father is ongoing. Both sustained gunshot wounds on November 26, 2020 in the City of Kawartha Lakes in the course of an interaction between the father and Ontario Provincial Police officers. The child was pronounced deceased at the scene, and the father succumbed to his injuries almost one week later.

In the early morning hours of September 27, 2020, two police officers from the Durham Regional Police Service, investigating reports of suspicious motor vehicle activity on Simcoe Street in Beaverton, interacted with a man who was driving an ATV. The ATV crashed, and the man suffered four broken ribs on his left side and a broken scapula. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either officer committed a criminal offence during their encounter with the man.
