SIU Terminates Investigation into Malton Multi-Vehicle Collision

The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into a collision that occurred in June in Malton, resulting in serious injuries to two people.

On June 18, 2022, a Peel Regional Police officer observed a black Jaguar XE being operated erratically at a high rate of speed westbound on Derry Road East. The officer followed the vehicle, and attempted a traffic stop on Airport Road in the area of Ripon Street. The driver of the Jaguar stopped momentarily, but then accelerated away northward. The officer disengaged. When a motorist alerted the officer to a collision north of his location, the officer made his way to the Airport Road overpass over railway tracks north of Thamesgate Drive. He observed that the Jaguar had collided with two southbound vehicles – a Lexus sedan and a Chevrolet SUV. A 17-year-old female passenger from the Lexus sustained a fractured shoulder and a 55-year-old female passenger from the Chevrolet suffered a break in her cervical spine.  

Based on the SIU’s preliminary inquiries, including a review of the GPS data associated with the officer’s cruiser and video footage that captured the incident in parts, Director Martino was satisfied that the investigation should be discontinued at this time. It was evident that the officer did not cause or contribute to the collision in any way that could conceivably attract criminal sanction; the driver of the Jaguar was alone to blame. The file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
