SIU Appealing for Witnesses to Toronto Arrest

Mississauga, ON (23 December, 2022) ---
On August 28, 2022, Toronto Police Service officers on bicycle patrol were dispatched to a condominium on Front Street East after reports of a man having stolen two electric scooters The officers located the man, who was on a scooter, and pursued him. When the 39-year-old man ditched the scooter, one of the officers ran after him. The officer grabbed the man’s backpack and the man fell and struck his face on the concrete ground resulting in a fractured nose and orbital bone. The man was apprehended. While accepting that the man’s injuries were incurred in the takedown, SIU Director Joseph Martino determined there were no reasonable grounds to believe they were attributable to unlawful conduct on the part of the officer. As such, there was no basis for proceeding with criminal charges in this case.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
