No Charges Against Peel Officers in Man’s Fall from Mississauga Overpass

The Director of the Special Investigations Unit, Joseph Martino, has found no reasonable grounds to believe that two Peel Regional Police Service officers committed a criminal offence in connection with serious injuries suffered by a 38-year-old man after a fall from a Mississauga overpass last April.
On April 19, 2022, officers were called about a man in distress who was about to jump onto Highway 403 from the Erin Mills Parkway overpass. One of the officer’s grabbed the man as he was about to jump. The other officer arrived seconds later and also grabbed ahold of the man. The officers pleaded with the man to return to safety. The man eventually slipped out of his jacket and fell onto the highway. The man was transported to hospital in an ambulance and diagnosed with multiple fractures.
Director Martino found that the officers comported themselves with due care and regard for the man’s well-being and concluded there was no reason to believe that either officer transgressed the limits of care prescribed by the criminal law in their brief engagement with the man. The file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
