SIU Concludes Investigation into Sudbury Arrest

Mississauga, ON (28 December, 2022) ---
In the evening of August 29, 2022, Greater Sudbury Police Service officers were dispatched to a residence to investigate an altercation between two individuals. Upon arrival, officers saw one of the parties, a 32-year-old man, standing on the driveway. Within moments, an officer forced the man to the ground, after which the man was handcuffed by another officer. The man was taken to hospital following his arrest and treated for a fractured knuckle of the right hand. It was unclear whether the man’s injury was incurred in his confrontation with police or with another civilian prior to the arrival of police . Be that as it may, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any of the officers comported themselves unlawfully throughout their engagement with the man. There was no basis for proceeding with criminal charges in this case.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
