SIU Determines Discharge of CEW by Police Officer in Hamilton was Reasonable

The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a Hamilton Police Service officer who deployed a conducted energy weapon (CEW) in June of 2019 at a 50-year-old man in order to prevent the man from committing an offence. When the man was struck by the CEW discharge, he fell and struck his head on the ground.

No Charges to Issue in Relation to Injuries to Teenager who Attempted to Exit Moving Police Cruiser in Kenora

In the early morning of June 27, 2019, an Ontario Provincial Police (OPP) officer in Kenora was transporting a 17-year-old female in a police cruiser to an OPP detachment. The teenager, who was seated in the back behind the driver’s seat, opened the door and proceeded to exit the cruiser. When the officer heard the door open behind him, he applied the brakes and the 17-year-old fell to the ground beside the police vehicle. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the broken right ankle sustained by the teenager.

The Interim Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into an interaction that occurred earlier this month between a 34-year-old man and a Windsor Police Service officer.

No Basis to Lay Charges in Relation to Man’s Fatal Fall from Bridge in Waterloo

On June 4, 2019, a 40-year-old man fell to his death from the Northfield Drive bridge over Highway 85 in Waterloo. At the time of the man’s fall, three Waterloo Regional Police Service (WRPS) officers were present on the bridge. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a WRPS officer in relation to the man’s death.

No Charges to Issue in Relation to Man’s Fall from Apartment Balcony in Toronto

On June 9, 2019, a 22-year-old man fell from the 4th floor balcony of a building in Toronto and suffered injuries in the process.  Moments prior to his fall, three Toronto Police Service officers had been present with the man in a 7th floor apartment of the building. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a TPS officer in relation to this incident.

No Charges to Issue in Relation to Man’s Fatal Fall from Apartment Balcony in North York

On the morning of May 4, 2019, an individual called police to report that a 29-year-old man was threatening to jump from an apartment balcony. Two Toronto Police Service officers made their way to the building. The officers found the man standing on the balcony railing with his hands grabbing the lower railing of the balcony above. From the balcony door threshold, one of the officers attempted to convince the man to step down safely onto the balcony, told him he was there to help and pleaded with him not to jump.  Despite this, the man jumped from the balcony railing to the ground below. He was taken to hospital where he succumbed to his injuries. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any London Police Service officer in relation to the serious injury sustained by a 45-year-old man during his arrest on June 11, 2019.

No Charges to Issue in Relation to Windsor Collision Between Motorized Scooter and Police Cruiser

On the morning of September 2, 2019, an 87-year-old man was on his motorized scooter at the Wyandotte Street East and McDougall Street intersection. He waited for a period of time at a red light and then proceeded into the crosswalk when the light in his direction turned green.  At the same time, a Windsor Police Service officer had embarked on a left-hand turn while south on McDougall intending to travel east on Wyandotte Street East.  The cruiser struck the scooter in the crosswalk. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the head injury sustained by the man.

No Fault Found in Actions of Police in Cambridge Preceding Man’s Self-inflicted Death

In April of 2019, a 39-year-old man was wanted by police on two arrest warrants for having breached various conditions of his release from custody, and he was also a suspect in the shooting death of a woman in Cambridge. On April 27, 2019, Waterloo Regional Police Service (WRPS) officers were following the man when he drove his vehicle into a wooded area behind a gas station in Cambridge. The area was contained, and some time later, the decision was made to arrest the man. When the officers got closer to the man, he ran and the officers gave chase. A short time later, the man shot himself in the head with a handgun. He was taken to hospital where he was pronounced dead. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a WRPS officer in relation to the man’s death.

On April 2, 2019, a 68-year-old man was arrested while in the boardroom of the OPP Norfolk County Detachment in Simcoe.  He was subsequently taken to hospital and treated for three fractured ribs and a collapsed lung. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any of the officers in relation to the serious injuries sustained by the man.

In the morning hours of May 1, 2019, Hamilton Police Service officers were dispatched to a residence to investigate a disturbance. The officers asked a 26-year-old man to leave, but when he refused to do so, he was arrested. The man was released from custody shortly after, but then placed under arrest again. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the fractured hand with which the man was diagnosed.

Charges not Warranted in Relation to Arrest at Barrie Library

In the early morning hours of August 18, 2019, a 61-year-old man was arrested in front of the Barrie Public Library and had his left arm broken in the process. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a Barrie Police Service officer in relation to this incident.

No Basis to Charge Police Officers in Emo for Interaction with Truck Driver Resisting Arrest

In the afternoon of May 2, 2019, the Ontario Provincial Police received 911 calls reporting a drunk driver operating a pickup truck. Officers were dispatched to investigate the matter and located the pickup truck stopped in the middle of Vandrunen Road just north of Highway 11 in Emo. The driver, a 51-year-old man, was found asleep in the driver’s seat. A struggle ensued, and the man was eventually arrested. The man attended a health clinic the following day and was diagnosed with a fractured left elbow and forearm. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to the man’s serious injuries.

No Charges to Issue in Relation to Arrest of Woman in Barrie Operating Vehicle Reported as Stolen

At about 12:40 a.m. on May 18, 2019, two Barrie Police Service officers were on patrol in a marked cruiser when they noticed a black pickup truck that matched the description of a vehicle that had been reported stolen. The truck had pulled into a parking lot. The officers exited the cruiser, walked towards the vehicle and advised the 31-year-old woman driver that she was under arrest. The driver accelerated forward and struck the wall and front entrance of a church. The woman was arrested. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to the fractured right hand the woman sustained.

No Charges to Issue Against Officers in Relation to Apprehension of Man at London Motel

On the morning of April 29, 2019, London Police Service officers were dispatched to a motel after receiving a complaint about a 48-year-old man staying at the motel. When the man refused to open the room door for the officers, an employee let the officers in. There was an interaction, and the man was eventually apprehended. He was taken to hospital where he was diagnosed with a pneumothorax and involuntarily admitted for psychiatric examination. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

No Reasonable Grounds to Charge Police Officer in Relation to Minesing Arrest

On March 30, 2019, OPP officers were dispatched to a residence in Minesing after a woman reported that her husband had threatened to kill her and their children. Once the wife and children were safely removed from the home, officers continued their attempts to reach out to the man. Hours later, officers entered the residence with a police dog and the man was located. The man suffered a fractured left rib and dog bites in the course of an altercation with police officers that marked his arrest. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

Arrest of Man Located on Roadway Shoulder in Newmarket Deemed to be Justified

In the evening of May 17, 2019, a 56-year-old man found himself on the north shoulder of Davis Drive, east of Woodbine Avenue, in Newmarket. He was significantly intoxicated. Paramedics and police officers were dispatched to the scene to check on his welfare. Within minutes of the officers’ arrival, the man was arrested and placed in the backseat of a police cruiser. He was subsequently taken to hospital and diagnosed with serious injuries, including a dislocated and fractured shoulder. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

No Charges to Issue in Relation to Brampton Arrest

At approximately 10 p.m. on April 20, 2019, several plainclothes officers with Peel Regional Police went to a residence in Brampton to arrest a 35-year-old man in relation to a breach of recognizance and various thefts. The man suffered a broken nose in the course of a physical altercation that marked his arrest. At some point in the altercation, the evidence indicates that the man’s 59-year-old father was pushed up against a wall and had his arm forced behind him by an officer. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to the injuries sustained by the father and son during this interaction.

Force Used by Officers to Arrest Man in Hamilton Home Determined to be Reasonably Necessary

On April 27, 2019, a 55-year-old man was arrested inside his home by two Hamilton Police Service officers. The man was subsequently taken to hospital where he was diagnosed with serious injuries including a fractured right orbital bone.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this incident.

Force Used by Officers to Arrest Teenager in Belleville Determined to be Legally Justified

On April 11, 2019, 911 received a call reporting that a 16-year-old female had ingested an unknown quantity of prescription medication, and she had locked herself in the bathroom and was threatening to harm herself. Belleville Police Service officers attended the residence. When the teenager refused to unlock the bathroom door, officers forced their way in. Following an interaction, the officers eventually managed to arrest her. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this incident.

No Criminal Wrongdoing Found in Relation to Brampton Collision

Shortly after 3 p.m. on April 18, 2019, a Peel Regional Police officer was on patrol in his cruiser in Brampton when a Dodge Journey vehicle came to his attention. Intending to stop the driver for a traffic infraction, the officer pulled in behind the Journey and activated his emergency lights and siren. The driver brought his vehicle to a stop, but then accelerated away. Shortly after, the Journey became involved in a collision with a Chrysler 200. The 48-year-old male driver of the Chrysler sustained a fractured clavicle. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this incident.

Toronto Police Service Officer Charged

The Interim Director of the Special Investigations Unit (SIU), Joseph Martino, has reasonable grounds to believe a Toronto Police Service (TPS) officer committed criminal offences in relation to an incident that reportedly occurred on July 11, 2019. As a result, Interim Director Martino has caused charges to be laid against the officer.

No Reasonable Grounds to Charge Police Officer in Relation to Welland Arrest

On February 18, 2019, Niagara Regional Police officers were dispatched to a home in Welland in relation to a domestic dispute. A confrontation ensued between an officer and a 64-year-old man. When the man attempted to bite the officer, the officer reacted by delivering two elbow strikes to the man’s head. Other officers arrived and placed the man under arrest. He was taken from the scene to hospital and diagnosed with multiple fractures and a collapsed lung. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

No Grounds to Proceed with Criminal Charges in Relation to Ottawa Pursuit

In the early morning hours of November 11, 2018, an Ottawa Police Service officer was on duty in his cruiser when he initiated a pursuit of a Cadillac sedan that had been reported stolen. When the driver attempted to make a left hand turn onto Lemoine Street from Lévis Avenue, he lost control of his vehicle, whereupon it collided with a utility pole at the southeast corner of the intersection. Paramedics were called to the scene and transported the 44-year-old driver and his two passengers – a 65-year-old female and 58-year-old male – to hospital, where they were treated for various fractures. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in this case.

No Charges to Issue in Relation to Mississauga Arrest

On the night of November 1, 2018, Peel Regional Police officers attended an address in Mississauga in relation to a domestic incident. When officers knocked on the door, a 53-year-old man opened it. A physical altercation ensued between the man and officers, beginning in the hallway leading from the front door and ending in a small bedroom off the hallway. The man was subsequently arrested and transported to the police station. He was later taken to hospital where he was diagnosed with a broken left orbital bone. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this incident.

Officers Acted Lawfully in St Catharines Arrest; No Charges to Issue

On April 8, 2019, a Niagara Regional Police Service officer approached a man who was smoking an illegal substance in the area of King Street and James Street in St. Catharines. After checking his computer and seeing that there were two outstanding warrants in effect for the man’s arrest, the officer informed the man he was under arrest. With the assistance of several officers, the man was arrested. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the fractured nose sustained by the man.

On the night of December 30, 2018, a 24-year-old man was arrested by Peel Regional Police officers. Following a brief struggle on the grounds of the Petro Canada gas station at the corner of Kennedy and Derry Roads in Mississauga, the man was taken into custody and transported to hospital. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the serious injuries sustained by the man.

On March 16, 2019, a 20-year-old man crashed his vehicle as he attempted to exit Highway 406 onto Fourth Avenue in St. Catharines. He suffered spinal fractures and required surgery, and his 21-year-old passenger sustained facial injuries. Prior to the collision, an Ontario Provincial Police officer had briefly pursued the vehicle. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the collision.

At approximately 1 a.m. on March 10, 2019, two Ottawa Police Service (OPS) officers were on patrol near Dalhousie Street in their marked cruiser when they were flagged by an individual pointing at a man and indicating that he had assaulted several people.  After a foot chase, the officers eventually caught up with the man and took him to the ground. A struggled ensued on the ground, and the officers were able to handcuff the man after deploying a conducted energy weapon. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against an OPS officer in relation to the serious injuries sustained by the man.

The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against an Ontario Provincial Police officer who discharged his firearm at a man in the village of Whitechurch in September of 2018, resulting in the 30-year-old man sustaining a gunshot wound to the arm.

The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a Toronto Police Service officer in relation to the arrest of a 28-year-old man in the early morning hours of March 30, 2019. In the course of his apprehension, the man sustained a fracture to his left ankle.

No Grounds to Proceed with Charges in Relation to Death of Motorcyclist in Richmond Hill

In the evening of September 9, 2018, OPP officers were dispatched to the northwest corner of the Highways 407 and 404 interchange following reports of a motorcycle in a ditch. Officers searched for the motorcycle’s operator and any evidence of a collision, but nothing was found. The officers left the scene. Later that night, a motorist reporting a person lying on the shoulder of the northbound ramp from eastbound Highway 407 to Highway 404, under the Highway 407 overpass. Officers responded to the scene and, with the help of an off-duty firefighter, rendered emergency first aid to the man. The man – later determined to be the operator of the motorcycle – was transported to hospital where he was pronounced dead. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this case.

Man’s Fractured Leg in Ottawa a Result of Him Falling from Snowbank; No Basis to Lay Charges

On the morning of March 7, 2019, a 911 call was made reporting that a man had attempted to purchase merchandise with counterfeit money at the Herongate Mall in Ottawa. As a result, Ottawa Police Service (OPS) officers were dispatched to the scene. When the man saw an OPS officer, he fled out of the store and the officer pursued him on foot. The man scaled a snowbank, but collapsed to the ground on the other side of the snowbank. He was arrested. When it was apparent that he the man had injured his left leg, an ambulance transported him to hospital. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

In the early morning hours of February 23, 2019, a 33-year-old man was arrested by Toronto Police Service (TPS) officers and suffered a fractured ankle in the process. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a TPS officer in this case.

Force Used by Police on Man Armed with Knife was Reasonably Necessary; No Basis to Lay Charges in Peterborough Case

Shortly before 2 a.m. on December 1, 2018, a woman called 911 reporting that her son had stabbed her with a knife. Peterborough Police Service officers were dispatched to the Dublin Street residence. Inside the residence, the son was located armed with a knife. When the man ignored demands to drop the knife and instead advanced on an officer, he was kicked away. A conducted energy weapon was deployed, but it malfunctioned. When the man proceeded to stab himself in the neck, an officer deployed his pepper spray. The man was arrested and taken to hospital by paramedics. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to this incident.

Use of Force by Police Officers in Toronto Arrest Deemed to be Measured and Proportionate; No Charges to Issue

At approximately 10:30 p.m. on March 1, 2019, Toronto Police Service (TPS) officers arrived at a residence on St. Johns Road to investigate a domestic disturbance. Following a brief struggle, a 59-year-old man was arrested in the home. He was subsequently taken to hospital and diagnosed with a broken nose.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges any TPS officer in relation to this incident.

No Criminal Wrongdoing in Relation to Arrest of Man at Brantford Construction Site

In the early morning hours of February 17, 2019, Brantford Police Service (BPS) was made aware that a man was accessing a construction site without authorization and taking property that did not belong to him. Officers attended the scene. When the man was observed by an officer, the man fled on foot, losing his footing on several occasions given the slippery conditions. The man was eventually apprehended. He was subsequently taken to hospital and diagnosed with a fractured left rib and collapsed lung. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any BPS officer in relation to the man’s injuries.

On the afternoon of January 3, 2019, York Regional Police received a 911 call from a Newmarket LCBO store reporting a theft in progress. Officers were dispatched to investigate. Upon arriving in the area, an officer observed the man running on the street and followed him in his cruiser. Another officer ran toward the man and tackled him to the ground. The man was arrested. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the serious injuries sustained by the man in the course of his apprehension – a dislodged front upper tooth and fracture to the back of his skull.

Charges not Warranted in Relation to Windsor Police-Involved Shooting

In the evening of September 16, 2018, Windsor Police Service officers attended a residence on Bonita Street after a woman called 911 reporting that her husband had gone outside with a gun. As officers approached the residence, they saw the man seated on the wooden deck in front of the home with a bat in his possession and a gun beside him. When the man pointed the gun at one of the officers, two officers discharged their firearms and the man was struck. The officers provided first aid until paramedics arrived. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any of the officers in this case.

No Basis to Lay Charges against York Regional Police Officers in Relation to Man’s Arrest in Toronto

On January 5, 2019, a 31-year-old man and his associate were occupants in a BMW vehicle being followed by undercover York Regional Police (YRP) officers. The men were observed entering a home in Vaughan and then exiting with property in their possession. Based on the police investigation, the decision was made to arrest both individuals for break and enter. Officers continued to track the BMW as it went into Toronto. When the BMW stopped in a driveway, officers surrounded the vehicle and pulled the man from the driver’s seat onto the ground, where he was handcuffed. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any YRP officer in relation to the broken nose sustained by the man during his arrest.

SIU Terminates Re-opened Kenora Investigation into Death of Man

On March 5, 2018, paramedics and Ontario Provincial Police officers responded to the Washagamis Bay residence of a 29-year-old man due to him being in medical distress. The man was transported to hospital where he was pronounced dead a short time later. The SIU opened a file at that time, but terminated it upon learning the cause of death was acute pneumonia. This case was later re-opened.

On the night of March 18, 2019, Peel Regional Police (PRP) received a 911 call reporting a theft in progress on Shawson Drive in Mississauga. When officers arrived, the person of interest was inside a van and officers surrounded the vehicle. The officers ordered the man to step out. The man then exited from the rear of the vehicle and ran from the officers. He was caught in short order and brought to the ground, whereupon he was arrested and handcuffed. The man was subsequently taken to hospital where he was diagnosed with a fractured right elbow. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a PRP officer in relation to this case.

In the evening hours of February 6, 2019, a 28-year-old man was arrested by Niagara Regional Police Service (NRPS) officers while in his residence in St. Catharines.  The man was subsequently taken to hospital and diagnosed with a fractured right rib. In the evening of January 1, 2019, a 27-year-old woman damaged the men’s bathroom at a London restaurant and then fled the premises. London Police Service officers attended the scene. A short while later, an officer located the woman in the rear of a property at St. George Street and proceeded to take her into custody following a physical altercation that included the officer discharging his conducted energy weapon. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to a foot injury the woman sustained.

When an officer attempted to arrest the 26-year-old man, the man resisted, and a physical altercation ensued. Other officers arrived and the man was handcuffed and put in the backseat of a cruiser. He was subsequently taken to hospital where he was diagnosed with a fractured left orbital bone. Fraudulent Calls Using SIU Phone Number

Ontario’s Special Investigations Unit has recently become aware of a group using the SIU’s toll free number to make fraudulent calls. The call appears to be coming from 1-800-787-8529. In some cases, the person is told that there is something wrong with their Social Insurance Number, and that if they don’t continue with the call by pressing ‘1’ or ‘2’, the person will be charged or jailed.

No Charges to Issue in Relation to Toronto Collision that Resulted in Serious Injuries to Three People

At about 9:30 p.m. on December 25, 2018, two Toronto Police Service officers were on patrol in their cruiser when they received a call for assistance from another officer. En route to that call, with the cruiser’s emergency lights and siren activated, the cruiser became involved in a collision with an Acura sedan in the intersection of Woodmount Avenue and Cosburn Avenue. The driver of the Acura -  a 51-year-old woman – and her two passengers – a 58-year-old man and an 80-year old man – were taken to hospital for treatment of serious injuries. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the collision.

In the evening of November 25, 2018, a Pontiac G5 sedan was involved in a collision with an Ontario Provincial Police cruiser in the area of County Road 42 and Side Road 3 & 4 Nottawasaga. Three occupants from the Pontiac, as well as the police officer, were transported to hospital for treatment. On November 26, 2018, Toronto Police Service officers attended an apartment building on McCowan Road to execute a search warrant for illegal drugs and drug paraphernalia obtained under the Controlled Drugs and Substances Act. When officers showed up at the door of a unit, a 40-year-old man was the only person present. The officers entered the apartment and confronted the man physically. During the course of that interaction, the man suffered a broken nose and laceration of his right lower eyelid. He was transported to hospital for treatment. On December 27, 2018, a 29-year-old man was lodged in a courthouse cell to await a court appearance. Following the court appearance, the man was transported to the Elgin Middlesex Detention Centre. While in the process of being admitted, the man collapsed. He was transported to hospital where he was pronounced dead. In the early morning hours of December 27, 2018, a 911 call was placed to Peel Regional Police (PRP) indicating that individuals were breaking into the Holt Renfrew store at the Square One Shopping Mall in Mississauga.  The men then exited the store and entered a nearby Porsche vehicle. When a responding police cruiser became involved in a collision with the Porsche, the occupants of the Porsche fled from the vehicle on foot. Both men were apprehended a short time later. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a PRP officer in relation to the fractured ribs sustained by one of the men who was arrested.

On the morning of December 15, 2018, a 44-year-old man was arrested by York Regional Police officers following a brief standoff at his residence in Richmond Hill. The man was lodged in cells and subsequently taken to hospital when an officer noticed swelling over the knuckles of the man’s left hand. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the man’s hand injury, likely caused when he banged his hand multiple times on the metal frame of the cell in which he was lodged.

On March 23, 2018, a 46-year-old man was observed operating a vehicle in contravention of his driving prohibition. As a result, officers arrested the man in a Dollarama store. Several days later, the man was diagnosed with a fracture to a right-sided rib. The SIU was made aware of this incident in December of 2018, after being notified by the man. On the night of October 25, 2018, Ontario Provincial Police officers were dispatched to a residence in Norfolk County after receiving a call about suspicious individuals in and around the residence. With the help of a police service dog, officers located some individuals of interest. The dog bit one of those individuals – a 23-year-old man – twice, resulting in him sustaining serious injuries. On the evening of September 16, 2018, the Kawartha Lakes Police Service was made aware of a man behaving strangely in the area of William Street North. Officers were dispatched and they located the man in some bushes on the embankment that sloped toward the Scugog River. The man fled from the officers and entered the water. Both police and the fire department attempted to locate him. His body was found the following day in the river. Following her May 2019 arrest for having breached a condition of her conditional sentence, a 39-year-old woman was in the process of being booked at the police station in Guelph when she objected to having a diamond ring removed from her finger. Officers managed to get the ring off, and the woman was lodged in a cell. Later that day, paramedics were called to examine the woman after she complained about pain in her ring finger. In the early morning hours of April 20, 2019, police received a 911 call reporting that gunshots had been heard in the area of King Street North and Hickory Street West in Waterloo, and that people were fighting. A Waterloo Regional Police Service officer traveling on King Street came upon two individuals on the roadway and struck them with the front of his cruiser. Notwithstanding the serious injuries sustained by the individuals, the Interim Director of the Special Investigations Unit, Joseph Martino, is unable to reasonably conclude that the officer committed a criminal offence.

The man refused them entry into his room and told them he was armed with knives. As two officers used a firetruck’s aerial bucket to get to the man’s bedroom window, other officers entered the bedroom using a battering ram. CEW and ARWEN discharges failed, and the man jumped through the window towards the aerial bucket. The officers in the bucket grabbed the man to prevent him from falling, but they could not get a firm grip and the man fell to the ground. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

On October 2, 2018, an Ontario Provincial Police officer in Elliot Lake located a 44-year-old man who was wanted for several offences, including break and enter. When the officer attempted to apprehend the man, the man fled. Other officers arrived and they located him – in pain – at a nearby residence. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

In the early morning hours of September 18, 2018, a 36-year-old man jumped from the Highway 401 overpass onto the Don Valley Golf Course below, suffering fatal injuries in the process. Moments prior to the fall, an OPP officer had been speaking to the man attempting to get him safely off the highway.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the man’s death.

In the early morning hours of November 5, 2018, Niagara Regional Police Service officers were dispatched to the Burgoyne Bridge after receiving reports of an individual who was threatening to jump from the bridge. When the first officer arrived at the scene, an 18-year-old female ran away, and the officer gave chase. When the female climbed over the bridge railing, the officer grabbed her to prevent her from falling. After a brief struggle, the female was able to push herself away from the officer, falling to a grassy area below. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the woman’s fall.

He had sustained a self-inflicted gunshot wound. On the morning of June 29, 2019, Ontario Provincial Police officers had blocked a portion of Highway 401 to ward off traffic from the scene of an accident a short distance west of the block. A 64-year-old man was traveling in one of the middle lanes of the express portion of Highway 401 when he came upon the road block. The man braked but was unable to avoid striking the rear portion of a stationary cruiser. On May 28, 2018, a 26-year-old woman suffered a broken shoulder when her vehicle was struck by a van being pursued by Durham Regional Police Service officers.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to this incident.

On the morning of May 6, 2019, a civilian vehicle was involved in a motor vehicle collision with a Peel Regional Police cruiser in Brampton. The civilian driver and her son sustained injuries. On March 20, 2018, a 37-year-old man was arrested in Oshawa by the Durham Regional Police Service (DRPS) for failing to provide a breath sample. During his booking, the man was grounded by a special constable, restrained by multiple members of the DRPS and kneed twice in the right side by an officer. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in connection with the serious injuries sustained by the man.

On the morning of January 10, 2019, a York Regional Police officer stopped a van on Highway 407 to charge the driver with stunt driving and speeding. As the officer prepared his tickets, the man was seated in the backseat of the police vehicle. Shortly after, another vehicle crashed into the rear of the police vehicle. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injuries sustained by the man who was in the police vehicle.

Fraudulent Calls Using SIU Phone Number

Ontario’s Special Investigations Unit has recently become aware of a group using the SIU’s toll free number to make fraudulent calls. The call appears to be coming from 1-800-787-8529. In some cases, the person is told that there is something wrong with their Social Insurance Number, and that if they don’t continue with the call by pressing ‘1’ or ‘2’, the person will be charged or jailed.

In the early morning hours of December 25, 2017, Toronto Police Service officers responded to a Toronto hotel following a complaint of a disturbance involving a man and a woman in a unit. The man was arrested by officers following a physical struggle. He suffered injuries in the process. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the man’s arrest. The SIU was only made aware of the altercation in March of 2019, when the man notified the Unit.

On the morning of May 3, 2019, a 69-year-old man died as the result of massive injuries he suffered when he fell from the Highway 401 overpass at Kennedy Road. Prior to his fall, an Ontario Provincial Police officer was on the same overpass, attempting to talk the man away from the edge of the bridge. SIU Appealing for Potential Shooting Victim in Mississauga to Come Forward

At approximately 3 p.m. on May 25, 2019, Peel Regional Police officers were dispatched to Marmac Road in Mississauga after determining that a vehicle that had been reported stolen was in that area. While police were investigating, a man entered the vehicle and began to operate it.  Shortly thereafter, an officer discharged his firearm multiple times resulting in the vehicle’s windshield being struck. The vehicle fled until it became involved in a collision on Pettigrew Crescent. The man exited the vehicle and fled the scene on foot.

When officers located the man inside the gas station’s washroom, they asked him to exit but he refused. An exchange of gunfire ensued, and the man was killed. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in this case.

In the morning of April 17, 2018, a Toronto Police Service officer was traveling along Highway 407 when he lost control of his vehicle, causing it to slide into a pickup truck. The impact forced the pickup truck off the roadway, over the guardrail and down a hill toward railroad tracks, where it came to rest. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injuries sustained by the 69-year-old driver of the pickup truck.

In the early morning hours of June 3, 2018, Ontario Provincial Police officers were conducting a RIDE spot check program in the area of the westbound ramp from Fairview Street/Plains Road to the southbound QEW. While an officer was dealing with a vehicle driver who had been directed to provide a breath sample, the passenger exited the vehicle and attempted to disrupt the test. The passenger was eventually arrested and placed into a police vehicle. When an officer closed the door to the police vehicle, the man sustained an injury to his left foot. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in this case.

Man in Markham was Struck by Police Vehicle When he Suddenly Ran into Roadway; Charges not Warranted

On the afternoon of February 26, 2018, York Regional Police officers were conducting surveillance in Markham in relation to distraction thefts from motor vehicles. As a result of the surveillance, the decision was made to arrest a number of individuals. In the process, one of those individuals, a 40-year-old man, was struck by an unmarked police vehicle. He was transported to hospital where he was pronounced dead. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the man’s death.

Shortly before midnight on March 14, 2018, Halton Regional Police Service (HRPS) officers were dispatched to downtown Burlington because a man reportedly knifed a vehicle. Officers located the 32-year-old man, but he fled on foot after identifying himself. The officers pursued the man and he was arrested. On April 26, 2018, a 23-year-old man was diagnosed with a fractured left arm after he was arrested by Toronto Police Service officers for assaulting a Starbucks’ employee in Scarborough. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any police officer in relation to their interaction with the man.

On April 24, 2018, a man sustained a fracture to his wrist in the course of his apprehension and arrest after breaking into a garage in Kanata. While Interim Director Joseph Martino believed the man was injured when he was struck with a police baton, this did not constitute a criminal offence. As such, Interim Director Martino has determined there are no reasonable grounds to lay criminal charges against an Ottawa Police Service officer.

On April 28, 2018, shortly after 2 a.m., a police officer stopped a vehicle and arrested the driver for impaired driving. When the vehicle passenger exited the vehicle and began to handle property seized from the driver that was on the hood of the vehicle, the officer directed him to stop what he was doing. The man refused and became belligerent. The officer arrested the man for public intoxication and obstruction, and in the process took him to the ground. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injury sustained by the 32-year-old man.

The LPS officer had been engaged in a brief pursuit of the vehicle just prior to the collision.

No Criminal Wrongdoing in Relation to Motorcycle Crash in Guelph

In the evening of May 21, 2018, a Guelph Police Service officer activated his emergency lighting system and attempted to stop a motorcycle in order to determine whether or not it was a motorcycle that had been reported stolen. Rather than stopping, the man sped off. At the intersection of Brant and Delaware Avenues, the man lost control of the motorcycle, causing it to slip out from under him. He then slid across the roadway and struck the opposite curb. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against the officer who had been investigating the motorcycle.

No Basis for Criminal Charges in Relation to Man’s Treatment at North Bay Police Station

At approximately 6:40 p.m. on May 24, 2018, North Bay Police Service officesr responded to the Community Counselling Centre of Nipissing to assist with a client. The client – a 43-year-old man - was arrested and transported to the police station.  Once at the station, he was initially lodged in a cell, but was transported to the hospital the following morning as he was complaining about rib pain.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any officer in relation to the man’s arrest.

Force Used Against Man in Kingston Deemed to be Reasonably Necessary; No Charges to Issue

On September 7, 2018, the Kingston Police (KP) Drug Unit conducted surveillance on two individuals and believed they were trafficking fentanyl. When a KP officer initiated a traffic stop on the truck they were in, the driver tried to flee but collided with three unmarked police vehicles. Both men were arrested. When taken to hospital, one of the men was diagnosed with a fractured scapula. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any KP officer in relation to the arrest on this date.

Brantford: No Charges to Issue after Police Cruiser Ran Over Man who - Unbeknownst to Officer – was Lying in Front of Vehicle

On May 19, 2018, a Brantford Police Service (BPS) officer responded to a radio call to attend a residence on Market Street for a possible domestic dispute.  While the officer was inside the residence responding to the call, unbeknownst to him, a 25-year-old man, who had consumed a considerable amount of alcohol and who suffered from mental health issues, approached the officer’s police vehicle and lay down on the roadway in front of it.  The officer returned to his police vehicle at approximately 1:50 a.m. and put the vehicle in motion, pinning the man underneath it. A tow truck removed the police vehicle, allowing the man to crawl out. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to the serious injury sustained by the man.

A 39-year-old man who was being investigated yesterday by the Waterloo Regional Police Service (WRPS) has died. He was pronounced dead in hospital today at 10:33 a.m. At the request of next of kin, the Unit is not releasing the man’s identity at this time. This is in accordance with the SIU’s name release policy which requires consent from next of kin.

No Criminal Wrongdoing in Relation to Greater Sudbury Collision that Resulted in Death of One Man and Serious Injuries to Another

Shortly before midnight on January 15, 2019, in the area of Municipal Road 80 and Valleyview Road in Greater Sudbury, an Audi vehicle collided with a Mitsubishi Lancer, resulting in serious injuries to both drivers. Just prior to the collision, a Greater Sudbury Police Service (GSPS) officer had been engaged in a brief attempt to pursue the Audi. On January 19, 2019, the Audi driver passed away when he was removed from life support at the hospital. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against a GSPS officer in relation to this incident.

No Charges to Issue in Relation to Man’s Death in North Bay

On the morning of February 22, 2018, North Bay Police Service officers attended a residence in relation to a domestic matter. Soon after entering the home, the officers became involved in a physical struggle with a man as they attempted to subdue him. After several minutes of attempting to grapple the man into submission, one officer deployed his CEW but this had no discernible effect. In time, the officers were finally able to gain control of the man who was believed to be suffering from a drug-induced psychosis. While waiting for an ambulance, the man’s breathing began to fail and as such, officers began to administer CPR. The paramedics took charge of the man’s treatment and eventually transported him to hospital where he was pronounced dead. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges in relation to the man’s death.

Shortly after midnight on June 7, 2018, Toronto Police Service (TPS) officers responded to a Scarborough pub after an off-duty officer reported that a man in the pub was in possession of a firearm. Officers located the man sitting in the driver’s seat of a vehicle. The officers approached the vehicle, ordering commands for the man to get out of the car. The man ignored the commands and, when one of the officers opened the driver’s side door, the man pulled out a handgun. There was an exchange of gunfire, and the man was struck. Then Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against any TPS officer in relation to the man’s death.

Charges not Warranted in Relation to Man’s Death in Clarksburg

On the night of January 29, 2019, Ontario Provincial Police (OPP) officers arrived at a residence in Clarksburg following information that a 57-year-old man was armed with a firearm and intending to possibly harm himself. Over the course of several hours, various efforts were made to contact the man from outside the home, but to no avail. When the Tactical Response Unit gained entry into the home’s garage, they found the man deceased. He had shot himself.  The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against an OPP officer in relation to the man’s death.

On May 27, 2018, several officers with the Toronto Police Service (TPS) attended a building located on Yonge Street after receiving a report of a man on the rooftop of the seven story building. Officers went out onto the roof where they saw the man sitting on a two foot high retaining wall, which ran along the edge of the building’s roof. When an officer asked the man if he could help, the man remained seated, with his head in his hands; he appeared to be speaking to himself. Shortly after, the man jumped from the roof.  Then Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a TPS officer in relation to the death of the 37-year-old man.

On May 18, 2018, a 29-year-old man was brought by Emergency Medical Services to Douglas Memorial Hospital’s Urgent Care Centre in Fort Erie. Sometime later, the man entered the room of another patient and stabbed him with a large hunting knife. Hospital staff fled the room and patients in the waiting room were directed to leave. The man proceeded to roam the hospital’s hallways with the knife in his hands. Niagara Regional Police Service officers responded to the hospital and shortly after located the man. When the man charged at an officer, the officer discharged his firearm, striking the man once. Then Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to this incident.

No Grounds to Lay Charges Against Officer in Almonte Who Discharged Firearm Following Attack by Dog

On the morning of June 12, 2018, officers attended a residence in the Town of Almonte in relation to an investigation. The officers arrived at the front porch of the residence and rang the doorbell. As the home’s resident opened the door, two dogs exited the house, attacking and biting the officers. In order to stop the attack, one of the officers discharged her firearm at one of the dogs; as the officer did so, the home’s resident tripped and fell in front of the officer, resulting in one of the projectiles striking her in the leg. An ambulance was summoned. Both officers were transported to hospital for treatment of dog bite injuries, and the home’s resident was taken to hospital to be treated for the firearm injury. Then Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges in this case.

No Criminal Charges Warranted in Woman’s Serious Injury in Highway 410 and Mayfield Road Collision

On June 16, 2018, a Peel Regional Police officer, in plainclothes was driving an unmarked police vehicle on Sandalwood Parkway, east of Highway 410.  The officer noticed a civilian vehicle driving erratically and commenced a vehicular pursuit. Due to the rate of speed of the civilian vehicle the pursuit was ended. A short time later the civilian vehicle exited Highway 410 at the northbound off ramp to Mayfield Road and become involved in a collision.  The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injury sustained by a 22-year-old woman in this incident.

On April 23, 2018, a 54-year-old man called 911 to report that he intended to kill himself. Upon arrival at the location that was provided by the man, an Ontario Provincial Police officer attempted to communicate with the man by calling and texting his cellphone. The officer tried to shine light into the man’s vehicle and to use the ditch as cover to get closer to the vehicle, but he was unable to see inside the vehicle. When officers got closer to the man’s vehicle by using an armoured vehicle, the man was discovered with a gunshot wound to his head and a firearm in his hands. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges in relation to the man’s death.

On the evening of February 25, 2018, a man stabbed another individual at a grocery store in Ottawa, and then fled to a nearby residential area. Ottawa Police Service officers were dispatched. When a police officer went down a narrow walkway, the person of interest jumped into the walkway with a knife in his hand, raised to shoulder height. He moved toward the officer, and when he did not comply with the officer’s commands to drop the knife, the officer shot the man multiple times. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in this case.

On April 1, 2018, Greater Sudbury Police Service officers were dispatched to the Downtown Transit Terminal after receiving a report of a man carrying two large knives, and trying to break into the terminal’s security office. When the 24-year-old man rushed towards the officers, CEWs were discharged but they appeared to have no effect. When the man ran at the officers again, one officer discharged his firearm multiple times at the man, and the man was struck. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the injury sustained by this man, or by a 39-year-old man who was in the security office at the time.

On May 11, 2018, police officers from the Toronto OPP detachment were conducting RIDE spot checks in Brampton when a vehicle drove through the spot check without stopping, striking one officer. A vehicular pursuit was commenced. Officers lost sight of the vehicle, but later came upon the vehicle which had been involved in a single vehicle collision. The driver and passenger of the vehicle were transported to hospital for treatment. No Reasonable Grounds to Believe Discharge of ARWEN at Woman in Keswick Amounted to Excessive Force

On the morning of October 3, 2018, York Regional Police was notified of a 47-year-old woman who no longer wanted to live, and wanted police officers to shoot her. Officers were dispatched to an area in Keswick. When the officers located the woman in a motor vehicle, she retrieved a machete from her vehicle and shouted at the officers to kill her. The woman then fled through a forested area and exited onto a residential street. Upon locating the woman, one officer discharged his ARWEN (Anti-Riot Weapon Enfield), striking the woman in one knee. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges in this case.

No Charges to Issue in Relation to Kirkland Lake Collision Between Police Vehicle and Pickup Truck

On March 13, 2018, an Ontario Provincial Police officer was driving an unmarked police vehicle on Duncan Avenue South, approaching Kirkland Street. As the officer began to execute a left turn onto Kirkland Street, a pickup truck driving behind struck the police vehicle. The officer was transported to hospital and diagnosed with a concussion, and the truck driver was later also diagnosed with a concussion. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injury sustained by the 56-year-old pickup truck driver.

No Grounds to Lay Charges in Relation to Durham Investigation

On the night of March 6, 2018, a Durham Regional Police Service (DRPS) officer attempted to stop a vehicle in Oshawa that had been reported stolen. The driver rammed the police vehicle, and then fled the scene with the officer in pursuit. Additional officers joined the pursuit, and a short time later, the vehicle became involved in a collision in Whitby. The driver fled on foot, but with the help of a police service dog, he was apprehended. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against any DRPS officer in this case.

Force Used Against Man at Toronto Police Station Deemed to be Reasonably Necessary; No Charges to Issue

On February 24, 2018, Toronto Police Service (TPS) arrested a 28-year-old man in relation to a domestic dispute, and transported him to the police station where the man acted in an uncooperative and belligerent manner. While doing a Level 3 search, the man was physically resistant and, when a handcuff was removed, he pulled away aggressively from the officers causing his face to strike against the wall. He was immediately grounded and then searched. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a TPS officer in relation to a serious injury sustained by the man.

On February 22, 2018, an Ontario Provincial Police officer stopped a driver in the Town of Port Rowan. The man produced his documents upon request, and after being asked several times, eventually exited his vehicle. Once outside the car, there was an interaction between the police officer and the man. On the night of April 21, 2018, a Cornwall Community Police Service (CCPS) officer was dispatched to a call of a domestic nature. The officer arrested a person of interest and transported him to the police station. While in the booking room, there was an interaction between the 23-year-old man and a police officer. A second officer – who had left the booking room – returned to assist. The man was handcuffed and placed into a cell. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a CCPS officer in relation to the serious injury sustained by the man.

In the afternoon hours of February 21, 2018, Toronto Police Service (TPS) officers attempted to stop a stolen vehicle on Bathurst Street. After a pursuit, the driver exited the stolen vehicle and fled. A civilian who was driving in the area blocked the man using his vehicle, and then exited the vehicle and took the man to the ground. Within seconds, TPS officers arrived and the man was arrested. On December 13, 2017, Toronto Police Service (TPS) officers responded to a Walmart store on Eglinton Avenue East as a man refused to exit a family washroom. When officers opened the washroom door, they were confronted by the man who was holding a knife in his right hand. The officers retreated. Emergency Task Force members arrived and after attempts to negotiate with the man failed, they breached the washroom door and arrested the man. On the night of February 18, 2018, Ottawa Police Service (OPS) officers responded to a 911 call regarding a man threatening to shoot people at a Boston Pizza restaurant. Upon their arrival, officers attempted to negotiate with the 60-year-old man, but he refused to leave the premises. A struggle ensued, and the man was subsequently subdued and arrested with the assistance of other officers. On February 19, 2018, a Guelph Police Service officer activated the emergency lighting system on his police cruiser in order to stop a vehicle of interest. The vehicle did not stop, but instead accelerated and sped away. The officer pursued the vehicle, but then slowed when he lost sight of it. A short distance away, the officer located the vehicle which was stuck in the ditch of the Hanlon Highway. The driver was arrested and transported to hospital for treatment. The OPP used a police dog to track him into an area with dense brush near Lake Dalrymple where he was found hanging from a tree. The police officers cut him down and tried to revive him, but the Complainant was later pronounced dead. On February 1, 2018, Durham Regional Police Service (DRPS) officers stopped a vehicle in an Oshawa parking lot after observing what they believed to be a drug transaction.  The officers approached the vehicle and asked the driver to produce his driver’s licence. Suddenly, the driver accelerated and sped out of the parking lot. A pursuit was initiated. Shortly after, the vehicle of interest left the roadway, crossed a ditch, and collided with a hydro pole, shearing it in half, before the vehicle flipped over and came to rest on its roof.  The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a DRPS officer in relation to the serious injury sustained by one of the vehicle occupants.

On February 14, 2018, a Toronto Police Service officer was dispatched to a car dealership on Dufferin Street as a 75-year-old woman refused to leave the premises. After speaking with the woman for almost 20 minutes and asking her to leave, the officer grabbed the woman’s arm to turn her around and escort her out of the dealership. The woman fell and sustained a serious injury. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in this case.

Criminal Charges not Warranted in Relation to Death of Man in Oakville

Shortly after midnight on February 21, 2018, Halton Regional Police Service officers attended a public school in Oakville after learning that a custodian was missing, and that blood could be seen inside his truck and leading to the school portables. The man was located inside a portable, and attempts were made to communicate with him. He could be seen at the door with injuries, but he did not exit or respond. When officers eventually gained entry to the portable, the man was lying on the floor, unconscious but breathing. He was observed to have a cut to his neck and his right wrist. He was transported to the hospital by ambulance, where he was pronounced dead. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges in relation to the man’s death.

Woman’s Jump from Rooftop Led to her Death; No Charges to Issue Against Officers in Mississauga

On February 21, 2018, Peel Regional Police (PRP) officers and paramedics attended a townhouse in Mississauga after a 911 call reporting that a woman was standing on the roof of the townhouse. Several officers attempted to convince the 28-year-old woman to abandon her thoughts of suicide. A short time later, the woman jumped from the roof to the pavement below. She succumbed to her injuries in hospital. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a PRP officer in this case.

On February 1, 2018, an undercover police officer purchased drugs from a 33-year-old man in an alcove on Yonge Street in Toronto. After the transaction, the officer gave a signal to nearby officers indicating that the man was to be arrested for drug trafficking. On January 31, 2018, a vehicle being operated by a 24-year-old man was involved in a collision in St. Catharines. After the driver fled the scene, the vehicle became stuck in a snowbank. The man left the vehicle and was later located and arrested by Niagara Regional Police (NRPS) officers. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against any NRPS officer in relation to the serious injury sustained by the man during his arrest.

On December 21, 2017, a Toronto Police Service officer noticed a man in a plaza who was the subject of multiple arrest warrants. When the officer pressed the man for his identity, the man fled on foot. The man was arrested shortly after. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against any Ontario Provincial Police (OPP) officer in relation to the serious injury sustained by a 28-year-old male when he was arrested on January 2, 2018. The man had attended the OPP detachment on his own accord, but when police discovered that the man had an outstanding warrant for his arrest, they arrested him after a struggle.

On December 19, 2017, officers with the Toronto Police Service (TPS) tracked two armed robbery suspects to an apartment building in Mississauga.  When two motor vehicles exited the parking garage, police arrested one of the drivers but the second driver – a 25-year-old man – attempted to flee from police. Police pursued the vehicle, and during the course of the pursuit, the man’s vehicle was rammed by five different unmarked police vehicles in an attempt to bring his motor vehicle to a stop. The man fled on foot but soon after was apprehended. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against any TPS officer in relation to the serious injury sustained by the man during his arrest.

SIU Determines Police-Involved Shooting of Man in Toronto School Yard was Justified; Criminal Charges not Warranted

On the night of December 1, 2017, a man called 911 to report that four men with firearms were trying to break into his house, and that they had then fled. Toronto Police Service officers attended the area and saw four men running towards a school.  There was an interaction between officers and one of the men, and an officer discharged his firearm. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the gunshot wound sustained by the 25-year-old man.

On the morning of January 13, 2018, a Peterborough Police Service (PPS) officer observed an individual execute a u-turn and travel in the wrong direction on a one-way street. The officer pursued this vehicle with his emergency lights and sirens activated, but the driver did not stop. Other officers joined the pursuit. A short time later, the vehicle being pursued ran a red light and collided with another vehicle. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a PPS officer in relation to the serious injuries sustained by the 55-year-old driver of the vehicle that was struck.

On the morning of December 23, 2017, Ontario Provincial Police (OPP) officers were on Highway 401 in Essex County to assist as a vehicle had gone into a ditch. While one of the officers was parked on the shoulder of the highway with his emergency lighting system activated, a civilian vehicle struck the rear of the officer’s vehicle. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in relation to the serious injuries sustained by three individuals in the civilian vehicle.

On June 29, 2017, a 69-year-old man was arrested in a park in Peterborough for being intoxicated in a public place. The man was transported to the Peterborough Police Service station. While a police officer was searching the man in the booking room, the man struck the officer in the face. The officer responded by punching the man back. The man was restrained, and then later taken to hospital where he was diagnosed with a nose fracture. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against the officer in this case.

On November 16, 2017, the Niagara Regional Police Service (NRPS) was investigating a man for a series of robberies in the St. Catharines area. Following an attempted traffic stop and then a police pursuit, the man’s vehicle collided with another vehicle. The man continued to drive, but when his vehicle finally broke down, the man exited and attempted to flee on foot. With the use of a police service dog, the man was apprehended. The Director of the Special Investigations Unit, Tony Loparco, has determined there are no reasonable grounds to lay criminal charges against a NRPS officer in this case.
