Due to No Serious Injury, SIU Discontinues Investigation into Uxbridge Arrest by Off-Duty Toronto Officer

The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into the arrest of a 34-year-old woman in September in Uxbridge.

On September 8, 2022, a fight broke out between patrons at the One Eyed Jack Pub and Grill in Uxbridge. At the time of the fight, an off-duty Toronto Police Service officer was inside the pub with two acquaintances. The three men intervened, and the off-duty officer arrested a man and woman. Once officers with the Durham Regional Police Service arrived at the scene, the off-duty officer turned over custody of the man and woman to the police officers. The woman reported having suffered broken ribs in the incident as a result of the arrest, and the man reported having sustained a concussion.

Based on the SIU’s preliminary inquiries, including a review of medical records, Director Martino was satisfied that neither person sustained a diagnosed injury within the ‘serious injury’ mandate of the SIU. As a result, the SIU was without statutory jurisdiction to investigate the matter. The file has been closed.       

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
