In the early morning of June 2, 2023, Peel Regional Police officers gathered outside an Etobicoke apartment to arrest a 39-year-old man who was wanted on firearm and domestic violence charges. The Tactical and Rescue Unit announced their presence outside the door, and attempts were made to enter the apartment. Upon entering, officers located the man, deceased. He was lying on the bed and was holding a gun in his right hand. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s death. There was no basis for proceeding with criminal charges in this case, and the file has been closed.

- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
