SIU Concludes Investigation into Man’s Fall from Toronto Apartment Balcony

Mississauga, ON (21 December, 2023) ---
In the afternoon of August 23, 2023, a team of Emergency Task Force officers with the Toronto Police Service convened outside a Toronto apartment. They were there at the request of the Durham Regional Police Service, which had plans to execute a search warrant at the apartment and to arrest a 31-year-old man who was wanted for serious firearms-related offences. Shortly after ETF officers forced open the door and announced their presence, the man fell to the balcony below in his attempt to flee the apartment. The man was taken into custody. He had fractured his right arm in the fall and dislocated the right elbow. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injuries.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
