SIU Concludes Investigation into Broken Ankle Suffered by Man in Toronto

Mississauga, ON (29 December, 2023) ---
In the evening of July 5, 2023, a York Regional Police officer was investigating a BMW in the area of Highway 400 and Steeles Avenue West when the officer came to learn that it was a vehicle of interest to the Toronto Police Service. The BMW struck the cruiser and then accelerated away. The BMW traveled through a red light and struck another vehicle. The 23-year-old BMW driver fled on foot while an officer gave chase. The man then attempted to carjack a vehicle, pointing a gun at the driver. The officer directed the man to exit at gunpoint, and the man did so. The officer then fired his conducted energy weapon (CEW) at the man and continued to discharge his CEW until the arrival of other officers. The man was transported to hospital where he was diagnosed with a fractured right ankle. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s injury.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
