Man’s Injuries Could Not Have Resulted from Human Generated Force; SIU Terminates Mississauga Investigation

The Director of the Special Investigations Unit, Tony Loparco, has terminated an investigation into the arrest last month of a 54-year-old man in Mississauga.

On the night of December 2, 2018, Peel Regional Police officers located a man lying on the sidewalk in the area of Lakeshore Road West and Meadow Wood Road. He was arrested for being intoxicated in a public place. Due to bleeding from the man’s head, Peel Regional Paramedic Services attended the scene. They assessed the man and determined he did not need to go to hospital. Once at the police station, it was apparent the man could not stand or support his mass without assistance. The man was transported to hospital where he was diagnosed with comminuted fractures of the proximal left tibia, fibula and femoral head.

Director Loparco said, “The medical evidence establishes that the man’s leg injury had to have resulted from a high energy impact such as being struck by a motor vehicle and could not have resulted from human generated force. Thus, it is apparent that police conduct could not have caused the man’s injury. Accordingly, I have terminated the investigation into this incident. I have also advised the police service that this is a serious fail to remain incident which falls under their mandate.”

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
