SIU Investigating Officer’s Discharge of ARWEN at Man in Mississauga

Mississauga, ON (26 October, 2024) ---
In the early morning of June 28, 2024, a team of Peel Regional Police Tactical Rescue Unit (TRU) officers were dispatched to the intersection of Elmwood Avenue and Lakeshore Road East. A man had possession of a knife, and he refused to drop the knife when asked to do so by uniformed officers. Armed with lethal and non-lethal weapons, the TRU officers took up positions around the man. He was largely unresponsive as an officer attempted to communicate with him to have him drop the weapon. At some point, two officers discharged their conducted energy weapons (CEW) and another officer fired his Anti-riot Weapon ENfield (ARWEN) once, striking the man. Another CEW was deployed, this one resulting in the man locking up and falling to the ground. The 38-year-old man was taken into custody and then to hospital. He did not sustain any serious injury. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the use of the ARWEN.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
