SIU Concludes Investigation into Peel Police Officer After Motorcycle Collision in Mississauga

Mississauga, ON (17 October, 2024) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Peel Regional Police officer committed a criminal offence in connection with a 46-year-old man seriously injured in an incident with a police vehicle in Mississauga. On June 10, 2024, the officer attempted to stop the man for making a turn onto Lakeshore Road East against a red light while on his motorcycle.

The police officer, driving a marked pick-up truck, cut across the westbound lanes in front the motorcyclist. The man attempted to swerve right around it and his motorcycle fell over. At hospital later that day, the man was diagnosed with a fractured shoulder.

Director Martino concluded that while one might question the wisdom of the maneuver performed by the officer, particularly against a motorcyclist, the evidence did not reasonably establish the officer departed markedly from a reasonable standard of care when he undertook to execute it.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
