SIU Concludes Investigation into Death of Man in Brampton

The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Peel Regional Police officer committed a criminal offence in connection with the death of a 34-year-old man in Brampton last year. As officers arrested the man shortly before his death, the SIU was notified and investigated.
On April 2, 2023, officers were called to the man’s apartment area of Kennedy Road North and Vodden Street East for a report that he was suffering from a mental health crisis. Officers apprehended the man under the Mental Health Act. During the man’s arrest, an officer used his knee to keep the man pinned to the floor as he was being handcuffed behind his back. Paramedics were called and the officers provided chest compressions. Paramedics arrived and took the man to hospital where he was pronounced deceased. With respect to the use of force, Director Martino was unable to reasonably conclude it was unjustified.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
