No Criminal Charges to Issue Against Officer Who used Police Vehicle to Strike Teenager in Mississauga

Mississauga, ON (29 May, 2024) ---
In the evening of January 30, 2024, tactical and uniform Peel Regional Police officers made their way to the area of the Erin Mills Town Centre in Mississauga following reports of young males in possession of handguns at a nearby apartment building, who had since left in the direction of the mall. In the north parking lot of the mall, an officer encountered two males on foot fitting the description of the subjects. The males fled. One of the males entered a roadway and was struck by a police vehicle being operated by an officer responding to the scene. The 16-year-old male was taken into custody and eventually transported to hospital where he was diagnosed with a fractured right ankle and big toe. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the teenager’s arrest and injuries.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
