SIU Concludes Investigation into Highway 400 Collision

Mississauga, ON (28 March, 2026) ---
In the morning of November 28, 2025, a man was operating his vehicle on Highway 400 when it began to lose power. The 29-year-old driver managed to maneuver the vehicle to the second-lane from the right before it stopped on the road. He was several hundred metres north of Highway 401. Activating his emergency flashers, the man stepped out of the vehicle and popped the front hood to investigate what had happened. The man had just closed the hood when an OPP cruiser slammed into the rear of the vehicle. The impact propelled the man backward on the highway. He suffered fractures of the right leg and right hand. A 25-year-old male passenger in the vehicle also suffered multiple fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the collision.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
