SIU Terminates Investigation Due to Man’s Lack of Serious Injury in Vaughan Arrest

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into a 42-year-old man’s reported injury after he attempted to flee Peel Regional Police officers last November in Vaughan.

On November 18, 2025, the man, sought in connection to a stolen vehicle investigation, fled in an SUV to a Petro Canada gas station on Highway 50 and Rutherford Road and tried to run away. During the arrest, the man was combative and resisted police. Two officers delivered strikes, took the man to the ground, and handcuffed him.  The man was transported to the hospital and initially diagnosed with a suspected hairline fracture. Follow-up medical imaging confirmed no fracture was present.  On this record, due to the absence of any “serious injury” within the mandate of the SIU, the unit was without jurisdiction to investigate further.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
