SIU Concludes Investigation into Man Injured by Windsor Police Officers

Mississauga, ON (23 August, 2024) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe two Windsor Police Service officers committed a criminal offence in connection with orbital bone fractures suffered by a 45-year-old man. 

On April 25, 2024, the officers went to a residence in the area of Wyandotte Street East and Lauzon Road in Windsor. The home’s proprietor called police and reported that the man was intoxicated and had been belligerent with her, and she wanted him removed from the residence. The officers spoke with the man and advised him he had to leave. At his request, the man was allowed to attend the basement to collect his things. After a time, the officers followed him to the basement. The officers became embroiled in a physical engagement with the man before handcuffing him behind the back. The man refused medical treatment. He was eventually taken into custody by Peel Regional Police officers on the strength of an outstanding warrant and transported to Brampton. In Brampton, the man was seen at hospital and diagnosed with left-sided orbital fractures.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
