SIU Concludes Investigation into Man’s Broken Wrist After Arrest by Windsor Police Officers

Mississauga, ON (30 April, 2024) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Windsor Police Service officer committed a criminal offence in connection with the serious injury suffered by a 20-year-old man. On January 1, 2024, police received 911 calls about a man causing a disturbance and assaulting people on Bruce Avenue, Shepherd Street West, York Street and Wahketa Street. The man fled police before an officer tackled him to the ground. The man punched an officer in the head. An officer again caught up to him and took him down. The man struggled and an officer punched the man in the head two or three times, and another officer discharged a conducted energy weapon. He was handcuffed and taken to hospital where he was diagnosed with a broken left wrist.
While it was not clear if the man broke his wrist before or during the police interaction, Director Martino found no basis for proceeding with charges.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
