SIU Investigates Fatal Collision Between a Police Cruiser and a Motorcycle in Windsor

TORONTO (14 July, 2008) --- The Special Investigations Unit (SIU) is looking into the circumstances and sequence of events surrounding a collision between a Windsor Police Service vehicle and a motorcycle that resulted in the death of the motorcyclist.

On Sunday July 13, 2008, shortly before 2 a.m., two male officers were in their marked cruiser on County Road #42 between Concession Roads #8 and #9 responding to a call about a man running into traffic when their vehicle was struck from behind by a motorcycle. The motorcyclist, 30-year-old Adam Muzyka of Windsor, was taken to hospital where he died of his injuries. There is no apparent connection between the collision and the initial call to which police were responding.

A post-mortem conducted today confirmed the cause of death as multiple trauma to the chest. Toxicology tests will be carried out.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
