SIU Concludes Dutton Collision Investigation

TORONTO (28 June, 2007) --- Eight investigators from the Special Investigations Unit (SIU) are investigating the circumstances of a collision that has left a 22-year-old Kitchener man dead.

The Ontario Provincial Police (OPP) notified the SIU that at approximately 10:00 a.m. today, OPP officers were at the scene of a single tractor-trailer roll over on Highway 401, east of Currie Road. The tractor-trailer was being towed along the south shoulder of the eastbound lanes as officers in marked cruisers escorted the convoy. In the meantime, the driver of a tractor-trailer passed the police convoy and collided into the rear of another tractor-trailer. The driver of the first tractor-trailer suffered fatal injuries and was pronounced dead at the scene.

SIU investigators are probing the nature and extent of police involvement in all the circumstances surrounding the fatal collision. The highway has been re-opened.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
