SIU Appeals for Witnesses to Incident in Hamilton

On February 9, 2006, at about 5:10 p.m., an HPS officer arrested a man for public intoxication at the LCBO store on Dundurn Street in Hamilton. The man was taken to the police station on King William Street where, at about 6:00 p.m., he was lodged in a cell. At about 11:20 p.m., officers were unable to awake him during a routine cell check. He was taken to St. Joseph's Hospital and then transferred to Hamilton General Hospital with serious head injuries.
On February 12th, at about 6:00 p.m., the man succumbed to his injuries. A post mortem examination was conducted today in Hamilton. The results of the post mortem are not being released at this time.
The SIU is focusing on the nature and extent of police involvement in the man's death. Investigators are appealing for anyone who witnessed or had contact with this man on February 9th at the LCBO store to contact the SIU at 416-622-2293 or 1-800-787-8529 ext 2293.
The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
