SIU Investigates Custody Injury in Scarborough

Mississauga (25 August, 2015) --- SIU Acting Director Joseph Martino has terminated the investigation of an incident that occurred in Scarborough in June of 2015.
 
The SIU determined that shortly after midnight on Wednesday, June 24, 2015, Durham Regional Police Service officers went to an apartment building located at 3171 Eglinton Avenue East to investigate a 39-year-old man for breaching his recognizance. The officers remained outside the apartment door of the 4th floor unit while the man went to get dressed. Instead of going back to the police officers at the door after getting dressed, the man went out onto the balcony to try to jump to the adjoining balcony. He fell to the ground and sustained serious injuries in the process. Due to the fact that the man’s injuries were not caused by any police officer, the SIU investigation has been terminated.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
