SIU Terminates Investigation into Elderly Man’s Alleged Injuries in Windsor

The Deputy Director of the Special Investigations Unit (SIU), Stacey O’Brien, has terminated an investigation into reported serious injuries suffered by an elderly man during an interaction with Windsor Police Service officers aboard a city bus in 2025. On February 26, 2026, the Windsor Police Service notified the SIU that they had a Law Enforcement Complaints Agency complaint about the serious injury of a bus passenger.

On July 27, 2025, officers were dispatched to a call from Transit Windsor regarding the man, who was aboard a bus, yelling and refusing to exit after being directed to do so by the driver. Officers removed the man from the bus without the use of force, according to video footage that captured the incident in part, and transported him home without incident. The man claimed he suffered elbow and wrist fractures in the interaction with officers; however, his medical records do not document any injury during hospital visits proximate to the incident. A fractured elbow is documented several months later, at which time the man reported he fell. Available records do not document any serious injury associated with the earlier interaction with police. On this record, there being no indication of any ‘serious injury’ within the mandate of the SIU, the unit was without jurisdiction to investigate the incident.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
