SIU Concludes Investigation into Collision in Toronto Involving Unmarked Durham Police SUV

Mississauga, ON (26 June, 2026) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Durham Regional Police Service officer committed a criminal offence in connection with concussions suffered by two people in a collision in Toronto. On April 5, 2025, an officer driving an unmarked SUV, responding to a call about a possible abduction, struck a couple in a Hyundai as they left Scarborough Town Centre.

Director Martino found the officer’s speed of 70 km/h was not a gross departure from the 50 km/h speed limit and while it was not clear why the collision could not be avoided, he did not find the officer’s driving a marked departure from a reasonable standard of care. The man, 56, and woman, 55, in the Hyundai were examined on scene by paramedics, and neither were taken to hospital. Weeks later, both were diagnosed with concussions attributed to the collision.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
