SIU Concludes Investigation into Fatal Collision in Kingston

Mississauga (14 March, 2005) --- The Special Investigations Unit is investigating a motor vehicle collision that occurred at about 7:15 pm on March 12, 2005 on Division Street between Benson and Weller in Kingston, Ontario.

The SIU is appealing for anyone who witnessed any portion of this incident to contact the Unit at 416-622-1935 or 1-800-787-8529.

Initial information indicates that Kingston Police were called about reports of a vehicle driving erratically. An officer operating a marked cruiser located the vehicle, a Cavalier, and attempted to stop it to investigate the complaint. The Cavalier did not stop. It entered onto Division Street from an A & W parking lot with the police cruiser following. A short time later, the Cavalier struck a Neon vehicle. A passenger inside the Neon, Susan Hart (49 years-old), died as a result of the collision. The driver of the Neon was also injured. Neither of the two occupants of the Cavalier was hurt.

Four investigators and two forensic identification technicians have been dispatched by the SIU to investigate the incident.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
