SIU Concludes Investigation into Man’s Broken Jaw in Mississauga Arrest

The Special Investigations Unit found no reasonable grounds to believe a Peel Regional Police officer committed a criminal offence in connection with the arrest and serious injury of a 23-year-old man in Mississauga. On October 21, 2024, officers attempted to stop the man, who was driving a Mercedes, for having dark window tint in the area of Hurontario Street and Matheson Boulevard.
The man attempted to drive off and collided with the unmarked cruiser. He tried to run away. The man and officer grappled, while the other officer discharged their conductive energy weapon at the man. The man was handcuffed. The man tried to move away from the officer and the officer tripped him. The man was taken to hospital and diagnosed with a fractured jaw.
While Director Joseph Martino accepted that the man’s injury was incurred in the altercation that marked his arrest, most likely the result of the second of the two takedowns, there were no reasonable grounds to believe that the subject official comported himself other than within the limits of the criminal law.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
