SIU Concludes Investigation into Man’s Broken Foot After Arrest in Timmins

Mississauga, ON (10 January, 2025) ---
The Special Investigations Unit found no reasonable grounds to believe a Timmins Police Service officer committed a criminal offence in connection with a broken left foot suffered by a 31-year-old man during his arrest in Timmins last September.

On September 13, 2024, police received a 911 call with a report about the man making threats. Director Joseph Martino found the depictions of force used to arrest the man were varied. One account detailed that the man was grounded and the officer delivered strikes to the body during his arrest and while at the station police pinned the man down while his handcuffs were removed.  

While it remained unclear where and how the man suffered his foot injury, Director Martino found no reasonable grounds to believe it is attributable to unlawful conduct on the part of the officer.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
