SIU Affirms Hamilton Investigation after Reopening Case

Mississauga (14 September, 2016) ---
The province’s Special Investigations Unit has been called to investigate the circumstances surrounding the injuries sustained by a 41-year-old man overnight in Hamilton. 

Preliminary information suggests the following:
  • Shortly after midnight on Wednesday, September 14, 2016, officers with the Hamilton Police Service responded to a home on Barton Street East for a domestic situation.
  • Officers recognized one of the individuals, the 41-year-old man, as being wanted on outstanding warrants.
  • The man fled by foot, going from rooftop to rooftop. The officers followed and caught up to him. A Conducted Energy Weapon was deployed.
  • The man was taken to Hamilton General Hospital for treatment of a rib injury.
    
Three investigators and one forensic investigator have been assigned to investigate this incident.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
