SIU Closes Investigation into Toronto Custody Injury

Mississauga (23 December, 2014) ---
Ontario’s Special Investigations Unit (SIU) is probing the circumstances surrounding the custody injuries sustained by a 51-year-old man this morning in Toronto.  

Preliminary information indicates the following:
  • At approximately 11:10 a.m. on Tuesday, December 23, 2014, officers with the Toronto Police Service (TPS) responded to a call in relation to a reported break and enter at a residence on Binswood Avenue in Toronto.  
  • Upon their arrival the officers found a fire in the upstairs area of the residence.  
  • The man had collapsed and was removed from the residence by police and turned over to Emergency Medical Services. 
  • He was transported to Toronto East General Hospital for treatment. 

The SIU has assigned two investigators and one forensic investigator to probe the circumstances of this incident.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
