SIU Investigating Custody Injuries in Hamilton

Mississauga (2 July, 2014) ---
Ontario’s Special Investigations Unit (SIU) is probing the circumstances surrounding custody injuries sustained by a 44-year-old man last night in Hamilton.  

Preliminary information indicates the following:
  • On Tuesday, July 1, 2014, at approximately 9:00 p.m., officers with the Hamilton Police Service (HPS) responded to a call in relation to an intoxicated man in the area of Stinson Street and Erie Avenue.
  • The man was on a Hamilton Street Railway Bus and reported to be fighting with other passengers. 
  • During the process of arrest, there was an interaction involving the man and HPS officers. 
  • He was transported to the Hamilton Police Station when it became known that he had suffered an injury. 
  • He was taken to St. Joseph’s Hospital and diagnosed with a fractured femur and ankle. 

The SIU has assigned two investigators and one forensic investigator to probe the circumstances of this incident.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
