Criminal Charges not Warranted in Relation to Windsor Arrest
Dans la soirée du 6 août 2019, des agents du Service de police de Windsor (SPW) ont repéré un homme de 31 ans recherché pour plusieurs accusations en instance. L’homme s’est enfui à pied. Les agents se sont lancés à sa poursuite et l’ont arrêté. Ils l’ont ensuite emmené au poste de police où il a été placé dans une cellule. L’homme a par la suite été conduit à l’hôpital où on lui a diagnostiqué une fracture d’un doigt de la main gauche. Le directeur de l’Unité des enquêtes spéciales, Joseph Martino, a conclu qu’il n’y avait aucun motif raisonnable de croire qu’un agent du SPW ait commis une infraction criminelle au regard de l’arrestation et de la blessure de l’homme.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
