SIU Terminates Toronto Investigation

The Director of the Special Investigations Unit, Tony Loparco, has terminated an investigation a November 2018 interaction that occurred between a 28-year-old man and Toronto Police Service officers.
Shortly after midnight on November 13, 2018, employees removed a man from a bar in the Yonge Street and Gould Street area. While outside of the bar, the man was arrested by a nearby paid duty officer. When he was taken to the police station, the man complained of a sore leg and he was subsequently transported to hospital where he was diagnosed with a fractured fibula.
To locate the man, SIU investigators attended an address associated with the man, but he no longer lived there. Upon learning that the man would be in court at the end of January, investigators met with the man, but he would not provide a statement until he consulted with his counsel. One week later, the man contacted an SIU investigator to inform that he would not provide a statement or authorization for the release of medical information.
Director Loparco said, “The man would not provide a statement or consent to the release of his medical records to the SIU. Accordingly, I have terminated the investigation into this incident.”
The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
